Trgovački sud je donio privremenu mjeru kojom Tomislav Šuta ostaje na čelu "Vodovoda i kanalizacije" do okončanja tužbe.

Naime, takvom mjerom osporavaju se odluke sa Skupštine na kojoj je odlučeno da se poništava natječaj za izbor direktora i raspisuje novi.

Na prijedlog Grada Kaštela, jedinog od manjinskih suvlasnika "Vodovoda i kanalizacije", Trgovački sud je utvrdio da postupci koje je provela ova gradska vlast na čelu s gradonačelnikom Ivicom Puljkom, nisu bili u skladu sa zakonom.

- Privremena mjera stupa na snagu odmah i traje do pravomoćnog okončanja parničnog postupka koji se vodi pred Trgovačkim sudom. Žalba ne odgađa izvršenje provedbu ove privremene mjere - navedeno je u obrazloženju.

Komunalna tvrtka "Vodovod i kanalizacija" mora nadoknaditi troškove postupka privremene mjere u iznosu od 1285 eura.

U obrazloženju je, između ostalog, navedeno kako su pobijane odluke donesene običnom većinom glasova, a ne dvostrukom većinom, kako je propisano.

- Budući da pobijane odluke od strane Skupštine društva nisu donesene propisane dvostrukom većinom, već običnom većinom i to od strane samo jednog skupštinara naspram svih ostalih 12 članova društva predlagatelja osiguranja, a koji se ne slažu s tim jednim skupštinarom (Grad Split), za valjanost donijetih ovakvih odluka ne postoji dvostruka većina koja je propisana Društvenim ugovorom i Zakonom o vodnim uslugama -  stoji, između ostalog, u obrazloženju privremene mjere.

Podsjetimo, Tomislavu Šuti, inače predsjedniku splitskog HDZ-a, mandat na čelu "ViK"-a je istekao još prošle godine. Nakon toga je još šest mjeseci ostao na funkciji kao vršitelj dužnosti, a kada je i taj rok istekao splitska vlast donijela je odluku o raspisivanju novog natječaja. Pokušali su imenovati HDZ-ovog Tomislava Prljevića za novog vršitelja dužnosti. Trgovački sud i tu odluku im je poništio te je ponovo vratio Šutu kao privremenog upravitelja tvrtke.

Još jednom je takvom odlukom istaknuto kako Grad Split ne može samostalno donositi takve odluke, već ih treba usuglašavati s drugim vlasnicima, a to su gradovi i općine Kaštela, Solin, Trogir, Lećevica, Klis, Dugopolje, Marina, Muć, Podstrana, Seget, Šolta i Prgomet. U većini navedenih jedinica lokalnih samouprava predsjedava HDZ.

Trgovački sud je donio privremenu mjeru kojom Tomislav Šuta ostaje na čelu "Vodovoda i kanalizacije" do okončanja tužbe.

Naime, takvom mjerom osporavaju se odluke sa Skupštine na kojoj je odlučeno da se poništava natječaj za izbor direktora i raspisuje novi.

Na prijedlog Grada Kaštela, jedinog od manjinskih suvlasnika "Vodovoda i kanalizacije", Trgovački sud je utvrdio da postupci koje je provela ova gradska vlast na čelu s gradonačelnikom Ivicom Puljkom, nisu bili u skladu sa zakonom.

- Privremena mjera stupa na snagu odmah i traje do pravomoćnog okončanja parničnog postupka koji se vodi pred Trgovačkim sudom. Žalba ne odgađa izvršenje provedbu ove privremene mjere - navedeno je u obrazloženju.

Komunalna tvrtka "Vodovod i kanalizacija" mora nadoknaditi troškove postupka privremene mjere u iznosu od 1285 eura.

U obrazloženju je, između ostalog, navedeno kako su pobijane odluke donesene običnom većinom glasova, a ne dvostrukom većinom, kako je propisano.

- Budući da pobijane odluke od strane Skupštine društva nisu donesene propisane dvostrukom većinom, već običnom većinom i to od strane samo jednog skupštinara naspram svih ostalih 12 članova društva predlagatelja osiguranja, a koji se ne slažu s tim jednim skupštinarom (Grad Split), za valjanost donijetih ovakvih odluka ne postoji dvostruka većina koja je propisana Društvenim ugovorom i Zakonom o vodnim uslugama -  stoji, između ostalog, u obrazloženju privremene mjere.

Podsjetimo, Tomislavu Šuti, inače predsjedniku splitskog HDZ-a, mandat na čelu "ViK"-a je istekao još prošle godine. Nakon toga je još šest mjeseci ostao na funkciji kao vršitelj dužnosti, a kada je i taj rok istekao splitska vlast donijela je odluku o raspisivanju novog natječaja. Pokušali su imenovati HDZ-ovog Tomislava Prljevića za novog vršitelja dužnosti. Trgovački sud i tu odluku im je poništio te je ponovo vratio Šutu kao privremenog upravitelja tvrtke.

Još jednom je takvom odlukom istaknuto kako Grad Split ne može samostalno donositi takve odluke, već ih treba usuglašavati s drugim vlasnicima, a to su gradovi i općine Kaštela, Solin, Trogir, Lećevica, Klis, Dugopolje, Marina, Muć, Podstrana, Seget, Šolta i Prgomet. U većini navedenih jedinica lokalnih samouprava predsjedava HDZ.
