Bliže se četiri godine da Trgovački sud u Splitu svakog mjeseca donosi novo rješenje kojem se sljedećem najboljem ponuđaču dosuđuje 9 tisuća vrijednih, komunalno opremljenih kvadrata građevinskog zemljišta i tvornicu "Milsa" u stečaju u Kopilici pokraj tornja OTP banke, a nakon što prethodni najpovoljniji ponuđač nije uplatio kupovninu.
S donošenjem rješenja sud je krenuo još u kolovozu 2019. godine, nakon održane javne dražbe, na kojoj je 159 osoba i tvrtki nudilo višemilijunske iznose, a koje potom nisu morali uplatiti jer gube samo 10 lipa, koliko je iznosila jamčevina. Najbolja ponuda iznosila je skoro 5 milijuna eura.
Nedavno je na red za uplatu došla tvrtka "S.B. Toranj", koja je u vlasništvu Josipa Komara, poznatog splitskog poduzetnika. Njegovo sudjelovanje na dražbi bio je logičan potez s obzirom na to da je u susjedstvu imovine "Milsa" već realizirao dva bitna projekta - toranj OTP banke i Dalmatia Tower, najviši neboder u Hrvatskoj.

No, "S.B. Toranj" nije uplatio 3.724.202 eura kupovnine koje je ponudio na javnoj dražbi, te mu je prošlog tjedna rješenje o dosudi proglašeno nevažećim.
Nekretnine "Milsa" potom su dosuđene Martini Spajić iz Zagreba, koja ima rok od dva tjedna da sudu uplati 2.329.285 eura koje je ponudila. U suprotnom će sud nekretnine dosuditi sljedećem najboljem ponuđaču i tako sve dok jedan od njih napokon ne uplati kupovninu.
Martina Spajić je preko svog odvjetnika već obavijestila sud da će radi plaćanja kupovnine uzeti kredit, te je predložila da se prilikom upisa njezina prava vlasništva u zemljišnu knjigu upiše i založno pravo u korist banke.
Bit će zanimljivo vidjeti hoće li vrijedne nekretnine "Milsa" napokon dobiti novog vlasnika, te hoće li netko zaista preduhitriti Josipa Komara u toj kupnji.

Naime, "S.B. Toranj" napravio je neobičan korak - podnio je tužbu na rješenje kojem su mu bile dosuđene nekretnine uz obrazloženje da je nad njim na Trgovačkom sudu u Zagrebu pokrenut predstečajni postupak i da planom restrukturiranja nije planirano tih 3.724.202 eura.
Na to mu je Visoki trgovački sud u "odbijenici" napisao da je umjesto podnošenja tužbe jednostavno mogao obavijestiti splitski sud da kupovninu neće uplatili. Naizgled besmisleno podnošenje žalbe moglo bi ukazivati na to da si je Komar manjim odugovlačenjem osigurao malo više vremena za eventualno slaganje financijske konstrukcije.
Naime, ako gospođa iz Zagreba ipak ne uplati kupovninu, uskoro na red za kupnju dolazi Komarova druga tvrtka – "Hotel Westgate", koji je na dražbi "Milsa" ponudio oko 1,8 milijuna eura. To je čak oko 1,9 milijuna eura manji iznos od onog koji bi morao platiti njegov "S.B. Toranj".

Bliže se četiri godine da Trgovački sud u Splitu svakog mjeseca donosi novo rješenje kojem se sljedećem najboljem ponuđaču dosuđuje 9 tisuća vrijednih, komunalno opremljenih kvadrata građevinskog zemljišta i tvornicu "Milsa" u stečaju u Kopilici pokraj tornja OTP banke, a nakon što prethodni najpovoljniji ponuđač nije uplatio kupovninu.
S donošenjem rješenja sud je krenuo još u kolovozu 2019. godine, nakon održane javne dražbe, na kojoj je 159 osoba i tvrtki nudilo višemilijunske iznose, a koje potom nisu morali uplatiti jer gube samo 10 lipa, koliko je iznosila jamčevina. Najbolja ponuda iznosila je skoro 5 milijuna eura.
Nedavno je na red za uplatu došla tvrtka "S.B. Toranj", koja je u vlasništvu Josipa Komara, poznatog splitskog poduzetnika. Njegovo sudjelovanje na dražbi bio je logičan potez s obzirom na to da je u susjedstvu imovine "Milsa" već realizirao dva bitna projekta - toranj OTP banke i Dalmatia Tower, najviši neboder u Hrvatskoj.

No, "S.B. Toranj" nije uplatio 3.724.202 eura kupovnine koje je ponudio na javnoj dražbi, te mu je prošlog tjedna rješenje o dosudi proglašeno nevažećim.
Nekretnine "Milsa" potom su dosuđene Martini Spajić iz Zagreba, koja ima rok od dva tjedna da sudu uplati 2.329.285 eura koje je ponudila. U suprotnom će sud nekretnine dosuditi sljedećem najboljem ponuđaču i tako sve dok jedan od njih napokon ne uplati kupovninu.
Martina Spajić je preko svog odvjetnika već obavijestila sud da će radi plaćanja kupovnine uzeti kredit, te je predložila da se prilikom upisa njezina prava vlasništva u zemljišnu knjigu upiše i založno pravo u korist banke.
Bit će zanimljivo vidjeti hoće li vrijedne nekretnine "Milsa" napokon dobiti novog vlasnika, te hoće li netko zaista preduhitriti Josipa Komara u toj kupnji.

Naime, "S.B. Toranj" napravio je neobičan korak - podnio je tužbu na rješenje kojem su mu bile dosuđene nekretnine uz obrazloženje da je nad njim na Trgovačkom sudu u Zagrebu pokrenut predstečajni postupak i da planom restrukturiranja nije planirano tih 3.724.202 eura.
Na to mu je Visoki trgovački sud u "odbijenici" napisao da je umjesto podnošenja tužbe jednostavno mogao obavijestiti splitski sud da kupovninu neće uplatili. Naizgled besmisleno podnošenje žalbe moglo bi ukazivati na to da si je Komar manjim odugovlačenjem osigurao malo više vremena za eventualno slaganje financijske konstrukcije.
Naime, ako gospođa iz Zagreba ipak ne uplati kupovninu, uskoro na red za kupnju dolazi Komarova druga tvrtka – "Hotel Westgate", koji je na dražbi "Milsa" ponudio oko 1,8 milijuna eura. To je čak oko 1,9 milijuna eura manji iznos od onog koji bi morao platiti njegov "S.B. Toranj".
