Protiv rješenja Državnog inspektorata kojim je Milivoju Svaguši određena kazna u iznosu od 45.000 kuna jer nije srušio bespravno izgrađenu obiteljsku kuću na adresi Ulica Josipa Jovića 73, njegov odvjetnik Nediljko Ivančević podnio je tužbu Upravnom sudu u Splitu.

Svaguša je, naime, u zemljišnim knjigama i dalje upisan kao suvlasnik nekretnine iako je svoju polovicu za milijun eura prodao tvrtki "Centar Split" i ugovorom joj se obvezao da će u kući nastaviti živjeti.

Drugi suvlasnik kuće je tvrtka "Mejaši prvi" čiji direktor Kristijan Gelo je ovih dana platio 170.000 kuna kazne jer nije srušio tu istu nekretninu, iako je ne može srušiti dok u njoj živi Svaguša s obitelji, a radi provedbe rješenja o rušenju Državni inspektorat mu nije osigurao asistenciju policije.

Nediljko Ivančević, odvjetnik Milivoja Svaguše, za rješenje građevinske inspekcije tvrdi da je - nezakonito.

- U prvom redu Milivoj Svaguša je podnio zahtjev kojim je zatražio prekid postupka izvršenja rješenja o uklanjanju nezakonito izgrađene stambene građevine. Postupajući po navedenom zahtjevu to upravno tijelo je 12. lipnja 2017. donijelo rješenje kojim je prekinut postupak izvršenja inspekcijskog rješenja o uklanjanju od 02. svibnja 2017., sve do pravomoćnog završetka postupka za donošenja rješenja o izvedenom stanju - kazao je odvjetnik Nediljko Ivančević i nastavio:

- Očigledno je naprijed opisano rješenje kojim se suvlasnika Milivoja Svagušu prisiljava na uklanjanje opisane stambene građevine drugom novčanom kaznom od 45.000 kuna potpuno oprečno rješenju toga istog tijela kojim se prekida postupak izvršenja inspekcijskog rješenja o uklanjanju opisane stambene građevine od 12. lipnja 2017.

- Pored toga, Upravni odjel za prostorno planiranje, uređenje i zaštitu okoliša Grada Splita donio je rješenje od 2. veljače 2018. kojim odbija zahtjev Milivoja Svaguše za izdavanje rješenja o izvedenom stanju nezakonito izgrađene zgrade - napominje odvjetnik i dodaje:

- No, protiv navedenog rješenja Milivoj Svaguša je podnio žalbu drugostupanjskom tijelu koje je svojim rješenjem od 27. travnja 2018. poništilo rješenje Upravnog odjela za prostorno planiranje, uređenje i zaštitu okoliša od 02. veljače 2018.  

- Konačno, građevinska inspekcija je potpuno pogrešno odredila visinu novčane kazne. Naime, u ovoj pravnoj stvari treba primijeniti odredbe Naputka o novčanim kaznama koje izriču građevinski inspektori – kazao je odvjetnik Ivančević i napomenuo da tvrtka "Centar Split" i s njom povezna austrijska grupacija nisu njegove stranke zbog čega u njihovo ime ne može govoriti o slučaju kuće Svaguša.

Protiv rješenja Državnog inspektorata kojim je Milivoju Svaguši određena kazna u iznosu od 45.000 kuna jer nije srušio bespravno izgrađenu obiteljsku kuću na adresi Ulica Josipa Jovića 73, njegov odvjetnik Nediljko Ivančević podnio je tužbu Upravnom sudu u Splitu.

Svaguša je, naime, u zemljišnim knjigama i dalje upisan kao suvlasnik nekretnine iako je svoju polovicu za milijun eura prodao tvrtki "Centar Split" i ugovorom joj se obvezao da će u kući nastaviti živjeti.

Drugi suvlasnik kuće je tvrtka "Mejaši prvi" čiji direktor Kristijan Gelo je ovih dana platio 170.000 kuna kazne jer nije srušio tu istu nekretninu, iako je ne može srušiti dok u njoj živi Svaguša s obitelji, a radi provedbe rješenja o rušenju Državni inspektorat mu nije osigurao asistenciju policije.

Nediljko Ivančević, odvjetnik Milivoja Svaguše, za rješenje građevinske inspekcije tvrdi da je - nezakonito.

- U prvom redu Milivoj Svaguša je podnio zahtjev kojim je zatražio prekid postupka izvršenja rješenja o uklanjanju nezakonito izgrađene stambene građevine. Postupajući po navedenom zahtjevu to upravno tijelo je 12. lipnja 2017. donijelo rješenje kojim je prekinut postupak izvršenja inspekcijskog rješenja o uklanjanju od 02. svibnja 2017., sve do pravomoćnog završetka postupka za donošenja rješenja o izvedenom stanju - kazao je odvjetnik Nediljko Ivančević i nastavio:

- Očigledno je naprijed opisano rješenje kojim se suvlasnika Milivoja Svagušu prisiljava na uklanjanje opisane stambene građevine drugom novčanom kaznom od 45.000 kuna potpuno oprečno rješenju toga istog tijela kojim se prekida postupak izvršenja inspekcijskog rješenja o uklanjanju opisane stambene građevine od 12. lipnja 2017.

- Pored toga, Upravni odjel za prostorno planiranje, uređenje i zaštitu okoliša Grada Splita donio je rješenje od 2. veljače 2018. kojim odbija zahtjev Milivoja Svaguše za izdavanje rješenja o izvedenom stanju nezakonito izgrađene zgrade - napominje odvjetnik i dodaje:

- No, protiv navedenog rješenja Milivoj Svaguša je podnio žalbu drugostupanjskom tijelu koje je svojim rješenjem od 27. travnja 2018. poništilo rješenje Upravnog odjela za prostorno planiranje, uređenje i zaštitu okoliša od 02. veljače 2018.  

- Konačno, građevinska inspekcija je potpuno pogrešno odredila visinu novčane kazne. Naime, u ovoj pravnoj stvari treba primijeniti odredbe Naputka o novčanim kaznama koje izriču građevinski inspektori – kazao je odvjetnik Ivančević i napomenuo da tvrtka "Centar Split" i s njom povezna austrijska grupacija nisu njegove stranke zbog čega u njihovo ime ne može govoriti o slučaju kuće Svaguša.
