Općinski sud naložio je svojem Zemljišnoknjižnom odjelu da s 19 tisuća kvadrata zemljišta i zgrada u Hercegovačkoj ulici i na kolodvoru u Sukoišanskoj ulici koji su u vlasništvu "Prometa" izbriše predbilježbu založnog prava slovenske tvrtke "A-Cosmos" koja je upisana prije godinu dana. Eventualna žalba neće odgoditi provedbu tog rješenja.

Kako je ranije pisala "Slobodna Dalmacija", Općinski sud je krajem 2014. godine na prijedlog "A-Cosmosa" odobrio predbilježbu njegova založnog prava kao mjeru osiguranja da će od javnoga gradskog prijevoznika naplatiti sedam milijuna kuna i kamate koje se obračunavaju od 1993. godine. Naime, prethodno je Trgovački sud donio nepravomoćnu presudu prema kojoj splitska tvrtka mora isplatiti višemilijunski iznos na ime dobiti koju je imala jer je godinama bez naknade koristila devet autobusa koji su formalno bili u vlasništvu slovenske tvrtke.

Tadašnji upis predbilježbe založnog prava značio je da bi se, u slučaju da presuda Trgovačkog suda postane pravomoćna, Slovenci mogli naplatiti od vrijednosti "Prometovih" nekretnina, čak i u slučaju da ih javni prijevoznik proda.

No, Županijski sud ove je godine uvažio "Prometovu" žalbu, a prijedlog "A-Cosmosa" za osiguranjem novčane tražbine ocijenio je neosnovanim.

Slovenci nisu odustali, nego su početkom ljeta ove godine od Općinskog suda ponovno, ali pod novim brojem predmeta, tražili da im odobri upis predbilježbe založnog prava. No, nisu uspjeli jer nisu dokazali da bi se bez te privremene mjere mogli naplatiti.

Naime, "A-Cosmos" je svoj zahtjev temeljio na tvrdnji da "Promet" želi pokrenuti stečaj i da nije u stanju ispunjavati svoje redovite obveze. No, na temelju izvješća o primicima, porezu i doprinosu, te potvrde Ureda za velike porezne obveznike Porezne uprave, sud je utvrdio da javni prijevoznik nema dugova po osnovi javnih davanja i da redovito posluje. Predmet je na rješavanje bio dodijeljen Stalnoj sudskoj službi u Makarskoj.

Općinski sud naložio je svojem Zemljišnoknjižnom odjelu da s 19 tisuća kvadrata zemljišta i zgrada u Hercegovačkoj ulici i na kolodvoru u Sukoišanskoj ulici koji su u vlasništvu "Prometa" izbriše predbilježbu založnog prava slovenske tvrtke "A-Cosmos" koja je upisana prije godinu dana. Eventualna žalba neće odgoditi provedbu tog rješenja.

Kako je ranije pisala "Slobodna Dalmacija", Općinski sud je krajem 2014. godine na prijedlog "A-Cosmosa" odobrio predbilježbu njegova založnog prava kao mjeru osiguranja da će od javnoga gradskog prijevoznika naplatiti sedam milijuna kuna i kamate koje se obračunavaju od 1993. godine. Naime, prethodno je Trgovački sud donio nepravomoćnu presudu prema kojoj splitska tvrtka mora isplatiti višemilijunski iznos na ime dobiti koju je imala jer je godinama bez naknade koristila devet autobusa koji su formalno bili u vlasništvu slovenske tvrtke.

Tadašnji upis predbilježbe založnog prava značio je da bi se, u slučaju da presuda Trgovačkog suda postane pravomoćna, Slovenci mogli naplatiti od vrijednosti "Prometovih" nekretnina, čak i u slučaju da ih javni prijevoznik proda.

No, Županijski sud ove je godine uvažio "Prometovu" žalbu, a prijedlog "A-Cosmosa" za osiguranjem novčane tražbine ocijenio je neosnovanim.

Slovenci nisu odustali, nego su početkom ljeta ove godine od Općinskog suda ponovno, ali pod novim brojem predmeta, tražili da im odobri upis predbilježbe založnog prava. No, nisu uspjeli jer nisu dokazali da bi se bez te privremene mjere mogli naplatiti.

Naime, "A-Cosmos" je svoj zahtjev temeljio na tvrdnji da "Promet" želi pokrenuti stečaj i da nije u stanju ispunjavati svoje redovite obveze. No, na temelju izvješća o primicima, porezu i doprinosu, te potvrde Ureda za velike porezne obveznike Porezne uprave, sud je utvrdio da javni prijevoznik nema dugova po osnovi javnih davanja i da redovito posluje. Predmet je na rješavanje bio dodijeljen Stalnoj sudskoj službi u Makarskoj.
