Trener Mladen Miki Starčević (60), koji više desetljeća prenosi košarkaško znanje diljem Hrvatske i Europe, već 19 godina čeka da mu se plati njegov rad na klupi Splita u sezoni 2002./2003. godine. Zbog toga želi otvoriti stečaj nad Košarkaškim klubom Split. Naime, iako je Trgovački sud krajem rujna odbio njegov prijedlog za otvaranje stečaja, taj slučaj nije završen jer se odvjetnički ured koji zastupa Starčevića žalio Visokom trgovačkom sudu. 

Prijedlog za otvaranje stečaja nad legendarnim klubom njegov je pokušaj da se naplati. Kontaktirali smo ga, no on nam je kazao da prema savjetu odvjetnika ne smije komentirati slučaj koji je u tijeku, dok je za razgovor o košarci uvijek dostupan.

Zato nam ostaju suhoparne tvrdnje iz prijedloga i žalbe koje je njegova strana poslala Trgovačkom sudu u Splitu, a to je da od kluba potražuje 97.000 eura i kamatu koja teče od 2003. godine, te da za svoju tražbinu od 2014. godine ima pravomoćnu i ovršnu presudu Općinskog suda u Splitu. Njegovi odvjetnici također tvrde da mu je ta tražbina priznata u postupku predstečajne nagodbe koja je 2013. godine pokrenuta nad KK-om Split.

No, na Trgovačkom sudu kažu drugačije. Navode da, iako je KK Split u jednom trenutku naveo Starčevića kao vjerovnika zbog čije se tražbine tada vodio sudski spor, u rješenju o predstečajnoj nagodbi Starčević je izostavljen kao vjerovnik, što znači da nije sudionik predstečajne nagodbe.

Razlog tomu je što njegova tražbina očito na koncu ipak nije prijavljena u postupku nagodbe, pa nije mogla biti ni ispitana. Na sudu također navode da je točno da Starčević ima pravomoćnu presudu Općinskog suda u svoju korist, no da se očito uz pomoć nje putem Fine ne može naplatiti s računa kluba, upravo zbog toga što je tražbina nastala prije otvaranja predstečajnog postupka, a nije navedena u predstečajnoj nagodbi.

Trgovački sud također je provjerio status računa "žutih" i utvrdio da nije u blokadi, što je u neku ruku potvrda da se trener s pravomoćnom i ovršnom presudom ne može naplatiti putem Fine. Zbog toga, pretpostavlja se, problem nemogućnosti naplate pokušava premostiti zahtjevom za otvaranje stečaja.

O slučaju smo pitali KK Split, koji je veselo izišao iz predstečajne nagodbe i uredno posluje, te su kratko odgovorili: 

– Prema sklopljenoj predstečajnoj nagodbi, čije je sklapanje odobreno rješenjem Trgovačkog suda u Splitu od 21. siječnja 2015. godine (Stpn-126/2014), predmetna tražbina Mladena Starčevića nije utvrđena kao tražbina prema dužniku (KK Split, nap. a.).

Trener Mladen Miki Starčević (60), koji više desetljeća prenosi košarkaško znanje diljem Hrvatske i Europe, već 19 godina čeka da mu se plati njegov rad na klupi Splita u sezoni 2002./2003. godine. Zbog toga želi otvoriti stečaj nad Košarkaškim klubom Split. Naime, iako je Trgovački sud krajem rujna odbio njegov prijedlog za otvaranje stečaja, taj slučaj nije završen jer se odvjetnički ured koji zastupa Starčevića žalio Visokom trgovačkom sudu. 

Prijedlog za otvaranje stečaja nad legendarnim klubom njegov je pokušaj da se naplati. Kontaktirali smo ga, no on nam je kazao da prema savjetu odvjetnika ne smije komentirati slučaj koji je u tijeku, dok je za razgovor o košarci uvijek dostupan.

Zato nam ostaju suhoparne tvrdnje iz prijedloga i žalbe koje je njegova strana poslala Trgovačkom sudu u Splitu, a to je da od kluba potražuje 97.000 eura i kamatu koja teče od 2003. godine, te da za svoju tražbinu od 2014. godine ima pravomoćnu i ovršnu presudu Općinskog suda u Splitu. Njegovi odvjetnici također tvrde da mu je ta tražbina priznata u postupku predstečajne nagodbe koja je 2013. godine pokrenuta nad KK-om Split.

No, na Trgovačkom sudu kažu drugačije. Navode da, iako je KK Split u jednom trenutku naveo Starčevića kao vjerovnika zbog čije se tražbine tada vodio sudski spor, u rješenju o predstečajnoj nagodbi Starčević je izostavljen kao vjerovnik, što znači da nije sudionik predstečajne nagodbe.

Razlog tomu je što njegova tražbina očito na koncu ipak nije prijavljena u postupku nagodbe, pa nije mogla biti ni ispitana. Na sudu također navode da je točno da Starčević ima pravomoćnu presudu Općinskog suda u svoju korist, no da se očito uz pomoć nje putem Fine ne može naplatiti s računa kluba, upravo zbog toga što je tražbina nastala prije otvaranja predstečajnog postupka, a nije navedena u predstečajnoj nagodbi.

Trgovački sud također je provjerio status računa "žutih" i utvrdio da nije u blokadi, što je u neku ruku potvrda da se trener s pravomoćnom i ovršnom presudom ne može naplatiti putem Fine. Zbog toga, pretpostavlja se, problem nemogućnosti naplate pokušava premostiti zahtjevom za otvaranje stečaja.

O slučaju smo pitali KK Split, koji je veselo izišao iz predstečajne nagodbe i uredno posluje, te su kratko odgovorili: 

– Prema sklopljenoj predstečajnoj nagodbi, čije je sklapanje odobreno rješenjem Trgovačkog suda u Splitu od 21. siječnja 2015. godine (Stpn-126/2014), predmetna tražbina Mladena Starčevića nije utvrđena kao tražbina prema dužniku (KK Split, nap. a.).
