Velimir Vuković, stečajni sudac Trgovačkog suda u Splitu u stečajnom postupku nad dužnikom - tvrtkom "Sportski grad TPN" d.o.o., donio je rješenje kojim se određuje prodaja "Spaladium Arene"!

Primjenjujući pravila ovršnog postupka, sportska dvorana našla se tako na tržištu nekretnina. Razlučno pravo nad Arenom upisano je u korist Banke Austrija, Erste banke i Zagrebačke banke, koje su po dokumentima jedini vlasnici 15.706 četvornih metara građevine koja je trebala biti biser splitskog sporta, a postala je, eto, rupa bez dna.

Osim same dvorane, na tržištu će se naći i pravo građenja ispod i oko samog objekta, što je dodatnih 30.798 kvadrata. Na taj dio zemljišta Grad Split ima pravo prvokupa. Zaključkom o prodaji koji se tek treba donijeti utvrdit će se način i uvjeti same prodaje.

U obrazloženju ovog rješenja sudac Vuković podsjeća kako je 7. listopada 2014. otvoren stečajni postupak nad dužnikom "Sportski grad TPN" i da je za stečajnu upraviteljicu imenovana Natalija Mladineo.

Ona je u podnesku od 30. siječnja ove godine i predložila prodaju nekretnina, uz obrazloženje da su dana 28. prosinca 2022. nastupile posljedice blokade žiro računa stečajnog dužnika, zbog aktiviranja ovršnih rješenja u naplati komunalne i vodne naknade od strane Grada Splita.

Stečajna upraviteljica je pozvala založne vjerovnike, Županijsko državno odvjetništvo i Grad Split da uplate predujam troškova konzerviranja opreme i pripreme objekta za zatvaranje.

Svi oni su upoznati s činjenicom da prestanak rada Spaladium Arene uzrokuje nužne troškove na zaštiti opreme kako bi joj se bar donekle sačuvala vrijednost i funkcionalnost. Prema procjenama iz tvrtke "Sportski grad TPN", riječ je o 200 tisuća eura vrijednim radovima.

- Nitko od pozvanih se na poziv predujmljivanja troškova nije odazvao - ustvrdio je stečajni sudac.

Kako zakona kaže da je "...stečajni upravitelj kao dobar gospodar dužan brinuti se o završetku započetih, a neobavljenih poslova dužnika i poslova potrebnih da bi se spriječilo nastupanje štete na sredstvima dužnika...", tako je stečajna upraviteljica predložila sudu da pristupiti prodaji imovine stečajnog dužnika.

Protiv ovog rješenja dopuštena je žalba koja se može izjaviti u roku od osam dana od dana objave na mrežnoj stranici e-Oglasna ploča sudova. Žalba se podnosi Trgovačkom sudu u Splitu, pismeno u tri primjerka, a o njoj odlučuje Visoki trgovački sud Republike Hrvatske.

Velimir Vuković, stečajni sudac Trgovačkog suda u Splitu u stečajnom postupku nad dužnikom - tvrtkom "Sportski grad TPN" d.o.o., donio je rješenje kojim se određuje prodaja "Spaladium Arene"!

Primjenjujući pravila ovršnog postupka, sportska dvorana našla se tako na tržištu nekretnina. Razlučno pravo nad Arenom upisano je u korist Banke Austrija, Erste banke i Zagrebačke banke, koje su po dokumentima jedini vlasnici 15.706 četvornih metara građevine koja je trebala biti biser splitskog sporta, a postala je, eto, rupa bez dna.

Osim same dvorane, na tržištu će se naći i pravo građenja ispod i oko samog objekta, što je dodatnih 30.798 kvadrata. Na taj dio zemljišta Grad Split ima pravo prvokupa. Zaključkom o prodaji koji se tek treba donijeti utvrdit će se način i uvjeti same prodaje.

U obrazloženju ovog rješenja sudac Vuković podsjeća kako je 7. listopada 2014. otvoren stečajni postupak nad dužnikom "Sportski grad TPN" i da je za stečajnu upraviteljicu imenovana Natalija Mladineo.

Ona je u podnesku od 30. siječnja ove godine i predložila prodaju nekretnina, uz obrazloženje da su dana 28. prosinca 2022. nastupile posljedice blokade žiro računa stečajnog dužnika, zbog aktiviranja ovršnih rješenja u naplati komunalne i vodne naknade od strane Grada Splita.

Stečajna upraviteljica je pozvala založne vjerovnike, Županijsko državno odvjetništvo i Grad Split da uplate predujam troškova konzerviranja opreme i pripreme objekta za zatvaranje.

Svi oni su upoznati s činjenicom da prestanak rada Spaladium Arene uzrokuje nužne troškove na zaštiti opreme kako bi joj se bar donekle sačuvala vrijednost i funkcionalnost. Prema procjenama iz tvrtke "Sportski grad TPN", riječ je o 200 tisuća eura vrijednim radovima.

- Nitko od pozvanih se na poziv predujmljivanja troškova nije odazvao - ustvrdio je stečajni sudac.

Kako zakona kaže da je "...stečajni upravitelj kao dobar gospodar dužan brinuti se o završetku započetih, a neobavljenih poslova dužnika i poslova potrebnih da bi se spriječilo nastupanje štete na sredstvima dužnika...", tako je stečajna upraviteljica predložila sudu da pristupiti prodaji imovine stečajnog dužnika.

Protiv ovog rješenja dopuštena je žalba koja se može izjaviti u roku od osam dana od dana objave na mrežnoj stranici e-Oglasna ploča sudova. Žalba se podnosi Trgovačkom sudu u Splitu, pismeno u tri primjerka, a o njoj odlučuje Visoki trgovački sud Republike Hrvatske.
