Zbog aktualne epidemiološke situacije još uvijek traje neizvjesnost učenika i njihovih roditelja oko školskih putovanja i ekskurzija koje se ne mogu održati u ovo vrijeme. Brojni su upiti prema agencijama oko povrata uplaćenih sredstava, no malo je zadovoljnih u cijeloj priči jer agencije drže uplate zbog moratorija, a roditelji su na sto muka kako dobiti novac natrag, a u svemu ispaštaju i učenici kojima je ova godina skroz naopaka.
- Kćer mi je maturantica i, kako stvari stoje, pitanje je hoće li imati maturalni ples, a kamoli hoće li ići u Grčku na ekskurziju. Agencija Vip travel nam je javila kako se putovanje odgađa ali ,realno, kćer mi nema ni kada ići na taj put jer maturantima ranije završava nastava, slijedi im državna matura, a onda upis na fakultet. Zato se ljutim što ne dobivamo novac natrag - javlja nam jedna mama.
Ipak, kako doznajemo od nekih roditelja osnovaca, neke agencije su našle načina kako vratiti uplate roditeljima učenika poput F toursa i Magellana za tuzemna putovanja. Oni koji su htjeli novac odmah, dobili su ga umanjeno za rezervaciju. Barem nešto. No, problem su inozemna putovanja.
- Sukladno preporukama Ministarstva znanosti i obrazovanja te Ministarstva turizma naša agencija je bila primorana odgoditi sva učenička putovanja planirana za 2020. godinu do daljnjeg bez obzira na destinaciju. Sukladno epidemiološkoj situaciji organizirat ćemo zajednički sastanak s roditeljima i predstavnicima škola kada se za to stvore uvjeti i kad budemo znali više oko mogućnosti organiziranja putovanja u novom terminu.
Činjenica jest da do sada nismo uspjeli dobiti ništa povrata od naših dobavljača (avioprijevoznika, prijevoznika, hotelskih kuća...) osim u formi vaučera za korištenje u novom terminu kojeg ćemo realizirati sa školama. Svakako će roditelji koji ne žele da im dijete putuje u novom terminu dobiti cjelokupni povrat unutar zakonom propisanog roka, a mi to pokušavamo izvesti što brže i što ranije - poručili su iz splitske Vip travel agencije s kojom su trebali putovati još neki srednjoškolci i to u Italiju, te osnovci iz OŠ Split 3 kojima je destinacija trebala biti Škotska, u sklopu nastave engleskog jezika.
Ministarstvo se ne želi petljati
Iz Ministarstva znanosti i obrazovanja rečeno nam je kako ono nije organizator tih putovanja, već o navedenom odlučuju škola i roditelji. Uputili su nas na preporuke HZJZ-a vezano uz pandemiju COVID-19 koje upućuju da se sva putovanja odgode.
Smatraju da ukoliko se maturalno putovanje ne bi realiziralo zbog posebnih okolnosti uzrokovanih epidemijom bolesti COVID -19, tada bi turistička agencija mogla izdati vaučer sukladno članku 38. Zakona o pružanju usluga u turizmu, čija vrijednost mora biti najmanje jednakovrijedna uplaćenom iznosu, a prema evidenciji organizatora putovanja na dan izdavanja vaučera i ne bi mogla naplatiti naknadu za raskid ugovora.
Na temelju navedenog vaučera putnik ima pravo na kasnije putovanje kod istog organizatora ili, po isteku roka od 180 dana od prestanka posebnih okolnosti, povrat uplaćenog novca u cijelosti u roku 14 dana.
- No također smatramo da bi i dok traju posebne okolnosti turistička agencija i putnik mogli sporazumno dogovoriti drugačiji način raskida ugovora ili alternativni paket aranžman.
Ukoliko putnik ne želi na putovanje koje će se realizirati, napominjemo da u slučaju raskida, turistička agencija utvrđuje standardne naknade za raskid ugovora u općim uvjetima turističke agencije, a ako iste nisu utvrđene, iznos naknade za raskid ugovora određuje se prema cijeni paket-aranžmana umanjenoj za iznos uštede troškova organizatora i prihoda od pružanja usluga putovanja drugom korisniku, te je na zahtjev putnika turistička agencija dužna obrazložiti njezin iznos - odgovorili su nam iz Ministarstva turizma i sporta upućujući roditelje na eventualno rješavanje spora sudskim putem.
Izgleda da nema druge nego vući za rukav voditelje agencija, te škole kao posrednike ili čekati prestanak posebnih okolnosti kada bude donesena odluka o prestanku epidemije bolesti Covid-19. No, što ako agencija u međuvremenu propadne, zatvori se ili nešto slično, pojeo vuk magare?!
- Skrećemo pozornost da je jamčevina osiguranje putniku samo za slučaj nesolventnosti agencije, to jest ukoliko ona bude nesposobna za pravodobno plaćanje dospjelih obveza u iznosu i u roku dospijeća ili je u stečaju, putnik bi tek u takvim slučajevima mogao tražiti povrat novca od osiguravajućeg društva odnosno banke - savjet je iz Ministarstva obrazovanja.

Zbog aktualne epidemiološke situacije još uvijek traje neizvjesnost učenika i njihovih roditelja oko školskih putovanja i ekskurzija koje se ne mogu održati u ovo vrijeme. Brojni su upiti prema agencijama oko povrata uplaćenih sredstava, no malo je zadovoljnih u cijeloj priči jer agencije drže uplate zbog moratorija, a roditelji su na sto muka kako dobiti novac natrag, a u svemu ispaštaju i učenici kojima je ova godina skroz naopaka.
- Kćer mi je maturantica i, kako stvari stoje, pitanje je hoće li imati maturalni ples, a kamoli hoće li ići u Grčku na ekskurziju. Agencija Vip travel nam je javila kako se putovanje odgađa ali ,realno, kćer mi nema ni kada ići na taj put jer maturantima ranije završava nastava, slijedi im državna matura, a onda upis na fakultet. Zato se ljutim što ne dobivamo novac natrag - javlja nam jedna mama.
Ipak, kako doznajemo od nekih roditelja osnovaca, neke agencije su našle načina kako vratiti uplate roditeljima učenika poput F toursa i Magellana za tuzemna putovanja. Oni koji su htjeli novac odmah, dobili su ga umanjeno za rezervaciju. Barem nešto. No, problem su inozemna putovanja.
- Sukladno preporukama Ministarstva znanosti i obrazovanja te Ministarstva turizma naša agencija je bila primorana odgoditi sva učenička putovanja planirana za 2020. godinu do daljnjeg bez obzira na destinaciju. Sukladno epidemiološkoj situaciji organizirat ćemo zajednički sastanak s roditeljima i predstavnicima škola kada se za to stvore uvjeti i kad budemo znali više oko mogućnosti organiziranja putovanja u novom terminu.
Činjenica jest da do sada nismo uspjeli dobiti ništa povrata od naših dobavljača (avioprijevoznika, prijevoznika, hotelskih kuća...) osim u formi vaučera za korištenje u novom terminu kojeg ćemo realizirati sa školama. Svakako će roditelji koji ne žele da im dijete putuje u novom terminu dobiti cjelokupni povrat unutar zakonom propisanog roka, a mi to pokušavamo izvesti što brže i što ranije - poručili su iz splitske Vip travel agencije s kojom su trebali putovati još neki srednjoškolci i to u Italiju, te osnovci iz OŠ Split 3 kojima je destinacija trebala biti Škotska, u sklopu nastave engleskog jezika.
Ministarstvo se ne želi petljati
Iz Ministarstva znanosti i obrazovanja rečeno nam je kako ono nije organizator tih putovanja, već o navedenom odlučuju škola i roditelji. Uputili su nas na preporuke HZJZ-a vezano uz pandemiju COVID-19 koje upućuju da se sva putovanja odgode.
Smatraju da ukoliko se maturalno putovanje ne bi realiziralo zbog posebnih okolnosti uzrokovanih epidemijom bolesti COVID -19, tada bi turistička agencija mogla izdati vaučer sukladno članku 38. Zakona o pružanju usluga u turizmu, čija vrijednost mora biti najmanje jednakovrijedna uplaćenom iznosu, a prema evidenciji organizatora putovanja na dan izdavanja vaučera i ne bi mogla naplatiti naknadu za raskid ugovora.
Na temelju navedenog vaučera putnik ima pravo na kasnije putovanje kod istog organizatora ili, po isteku roka od 180 dana od prestanka posebnih okolnosti, povrat uplaćenog novca u cijelosti u roku 14 dana.
- No također smatramo da bi i dok traju posebne okolnosti turistička agencija i putnik mogli sporazumno dogovoriti drugačiji način raskida ugovora ili alternativni paket aranžman.
Ukoliko putnik ne želi na putovanje koje će se realizirati, napominjemo da u slučaju raskida, turistička agencija utvrđuje standardne naknade za raskid ugovora u općim uvjetima turističke agencije, a ako iste nisu utvrđene, iznos naknade za raskid ugovora određuje se prema cijeni paket-aranžmana umanjenoj za iznos uštede troškova organizatora i prihoda od pružanja usluga putovanja drugom korisniku, te je na zahtjev putnika turistička agencija dužna obrazložiti njezin iznos - odgovorili su nam iz Ministarstva turizma i sporta upućujući roditelje na eventualno rješavanje spora sudskim putem.
Izgleda da nema druge nego vući za rukav voditelje agencija, te škole kao posrednike ili čekati prestanak posebnih okolnosti kada bude donesena odluka o prestanku epidemije bolesti Covid-19. No, što ako agencija u međuvremenu propadne, zatvori se ili nešto slično, pojeo vuk magare?!
- Skrećemo pozornost da je jamčevina osiguranje putniku samo za slučaj nesolventnosti agencije, to jest ukoliko ona bude nesposobna za pravodobno plaćanje dospjelih obveza u iznosu i u roku dospijeća ili je u stečaju, putnik bi tek u takvim slučajevima mogao tražiti povrat novca od osiguravajućeg društva odnosno banke - savjet je iz Ministarstva obrazovanja.
