Trgovački sud u Splitu je protekli tjedan donio prvostupanjsku presudu u slučaju onemogućavanja tvrtke "Versus pro" u čijem je vlasništvu bio nekadašnji "B-caffe", u kapitalizaciji koncesijskog odobrenja u uvali Firule.

Podsjećamo, "B-caffe" je od Grada Splita dobio koncesijsko odobrenje za korištenje 60 od ukupno 120 metara kvadratnih štekata na plaži Firule u 2010. godini.

Budući da su u to vrijeme navedeni štekat bespravno koristila dva druga objekta, "Plava laguna" i "Firule" tadašnjeg vlasnika tvrtke "Oliva X", vlasnik "B-caffea" nikad nije uspio realizirati koncesijsko odobrenje. Iz tog je razloga 2011. godine tužio Republiku Hrvatsku i Grad Split za izmaklu dobit.

Priča o štekatu na Firulama je jedna od onih koje je teško riječima objasniti, a ne napisati (kriminalistički) roman. Bilo je tu svega, od prijetnji eksplozivnim sredstvima, fizičkih i verbalnih obračuna ugostitelja, do uklanjanja pod pratnjom interventne policije. Nastao je ilegalno prije dvadesetak godina, Ministarstvo mora je još 2003. naložilo njegovo uklanjanje s pomorskog dobra, što nije zaustavilo ugostitelje u njegovom korištenju, a očito ni Grad Split u izdavanju koncesijskih odobrenja za ovu lokaciju.

Ipak, sutkinja Marija Balić Jurišić oslobodila je Grad Split krivnje prema tužitelju, a državi naložila da "Versusu pro" pod prijetnjom ovrhe u roku od 15 dana isplati izmaklu dobit od 312.174,69 kuna te sudske troškove u iznosu od 84.470 kuna. No to nije sve, na iznos od 312.174,69 kuna država je tužitelju dužna isplatiti zatezne kamate od 1. listopada 2010. do dana isplate. Sve to, što je u Hrvatskoj i normalno, ide iz džepova poreznih obveznika.

Pažnju javnosti na ovaj slučaj, u kojem građani plaćaju neobjašnjive propuste što državnog što gradskog aparata, obratio je Ante Renić, županijski vijećnik stranke Pametno za Split i Dalmaciju.

- Iako nam se čini da živimo u uređenom društvu i pravnoj državi, često dobijemo podsjetnik da nije baš tako. Primjer je ovaj slučaj, u kojem je državu i Grad za izgubljenu dobit tužio ugostitelj kojemu je Grad Split dao koncesijsko odobrenje za dio pomorskog dobra koje je bilo nelegalno nasuto i betonirano. No to nije sve, taj isti ugostitelj nije uspio ni doći do svoje koncesije jer su taj nelegalni plato nelegalno koristili drugi ugostitelji. Nakon raznih inspekcija i pravnog ping ponga, na kraju odštetu plaća država, odnosno svi mi, dok je nelegalni plato još uvijek na svom mjestu - upozorava Renić.

Dodajmo i da je na ovu presudu moguća žalba Visokom Trgovačkom sudu u roku od osam dana.

Trgovački sud u Splitu je protekli tjedan donio prvostupanjsku presudu u slučaju onemogućavanja tvrtke "Versus pro" u čijem je vlasništvu bio nekadašnji "B-caffe", u kapitalizaciji koncesijskog odobrenja u uvali Firule.

Podsjećamo, "B-caffe" je od Grada Splita dobio koncesijsko odobrenje za korištenje 60 od ukupno 120 metara kvadratnih štekata na plaži Firule u 2010. godini.

Budući da su u to vrijeme navedeni štekat bespravno koristila dva druga objekta, "Plava laguna" i "Firule" tadašnjeg vlasnika tvrtke "Oliva X", vlasnik "B-caffea" nikad nije uspio realizirati koncesijsko odobrenje. Iz tog je razloga 2011. godine tužio Republiku Hrvatsku i Grad Split za izmaklu dobit.

Priča o štekatu na Firulama je jedna od onih koje je teško riječima objasniti, a ne napisati (kriminalistički) roman. Bilo je tu svega, od prijetnji eksplozivnim sredstvima, fizičkih i verbalnih obračuna ugostitelja, do uklanjanja pod pratnjom interventne policije. Nastao je ilegalno prije dvadesetak godina, Ministarstvo mora je još 2003. naložilo njegovo uklanjanje s pomorskog dobra, što nije zaustavilo ugostitelje u njegovom korištenju, a očito ni Grad Split u izdavanju koncesijskih odobrenja za ovu lokaciju.

Ipak, sutkinja Marija Balić Jurišić oslobodila je Grad Split krivnje prema tužitelju, a državi naložila da "Versusu pro" pod prijetnjom ovrhe u roku od 15 dana isplati izmaklu dobit od 312.174,69 kuna te sudske troškove u iznosu od 84.470 kuna. No to nije sve, na iznos od 312.174,69 kuna država je tužitelju dužna isplatiti zatezne kamate od 1. listopada 2010. do dana isplate. Sve to, što je u Hrvatskoj i normalno, ide iz džepova poreznih obveznika.

Pažnju javnosti na ovaj slučaj, u kojem građani plaćaju neobjašnjive propuste što državnog što gradskog aparata, obratio je Ante Renić, županijski vijećnik stranke Pametno za Split i Dalmaciju.

- Iako nam se čini da živimo u uređenom društvu i pravnoj državi, često dobijemo podsjetnik da nije baš tako. Primjer je ovaj slučaj, u kojem je državu i Grad za izgubljenu dobit tužio ugostitelj kojemu je Grad Split dao koncesijsko odobrenje za dio pomorskog dobra koje je bilo nelegalno nasuto i betonirano. No to nije sve, taj isti ugostitelj nije uspio ni doći do svoje koncesije jer su taj nelegalni plato nelegalno koristili drugi ugostitelji. Nakon raznih inspekcija i pravnog ping ponga, na kraju odštetu plaća država, odnosno svi mi, dok je nelegalni plato još uvijek na svom mjestu - upozorava Renić.

Dodajmo i da je na ovu presudu moguća žalba Visokom Trgovačkom sudu u roku od osam dana.

O ovome štekatu na Firulama ispisali smo kartice i kartice, a evo i sudske presude: Grad je oslobođen, a država mora ugostitelju isprsiti preko 400.000 kuna

Trgovački sud u Splitu je protekli tjedan donio prvostupanjsku presudu u slučaju onemogućavanja tvrtke "Versus pro" u čijem je vlasništvu bio nekadašnji "B-caffe", u kapitalizaciji koncesijskog odobrenja u uvali Firule.

Podsjećamo, "B-caffe" je od Grada Splita dobio koncesijsko odobrenje za korištenje 60 od ukupno 120 metara kvadratnih štekata na plaži Firule u 2010. godini.

Budući da su u to vrijeme navedeni štekat bespravno koristila dva druga objekta, "Plava laguna" i "Firule" tadašnjeg vlasnika tvrtke "Oliva X", vlasnik "B-caffea" nikad nije uspio realizirati koncesijsko odobrenje. Iz tog je razloga 2011. godine tužio Republiku Hrvatsku i Grad Split za izmaklu dobit.

Priča o štekatu na Firulama je jedna od onih koje je teško riječima objasniti, a ne napisati (kriminalisti...
