Zbog kompliciranih odnosa između investitora i Grada Splita, prometnice koje okružuju trgovački centar Mall of Split su u privatnom vlasništvu, a Grad Split to želi promijeniti. Zato je pokrenuo tužbu koju je u četvrtak u tom dijelu nepravomoćno prihvatio Trgovački sud u Splitu.

Prema presudi, tvrtka "Mejaši prvi" kao investitor te trgovačke meke na Mejašima mora izmjestiti prometnice da budu u skladu s glavnim projektom. Mora otkupiti zemljišta za sve ceste i za njih ishoditi tehničku dokumentaciju. Sve to treba napraviti u roku od šest mjeseci i sve predati Gradu Splitu koji bi se na te prometnice uknjižio, proveo tehnički nadzor i za njih dobio uporabnu dozvolu. 

Tvrtka "Mejaši prvi" te se obveze može osloboditi ako plati 27,55 milijuna kuna, odnosno oko 3,65 milijuna eura koliko Grad procjenjuje vrijednost radova neizgrađenih prometnica i otkupa zemljišta.

Glavnina tih cesta i zemljišta su prilikom podjele izvorne investitorske tvrtke "Mejaši", pripale "Mejašima devetim". Sud smatra kako to ne sprječava sestrinsku tvrtku "Mejaše prve" da ta zemljišta i prometnice s infrastrukturom otkupi i preda Gradu.

Trgovački sud je, s druge strane, odbio traženje Grada Splita da naloži trgovačkom centru da "pripremi preostale dijelove građevine Mall of Split za tehnički pregled", jer uporabna dozvola je već izdana, pa Grad ne može uvjetovati centru da neće biti otvoren ako ne preda ceste.

Sud je prihvatio zahtjev Grada da mu suprotna strana u sporu plati 1.530.000 kuna, odnosno oko 203.000 eura odvjetničkih i sudskih troškova.

Zamršeni odnosi trgovačkog centra Mall of Split na Mejašima i Grada Splita krenuli su 2011. godine kada je tadašnji gradonačelnik Željko Kerum odobrio veću izgrađenost centra pod uvjetom da investitor o svom trošku izgradi potrebne prometnice i preda ih Gradu. 

Zatim su u mandatu gradonačelnika Ive Baldasara investitoru te trgovačke meke vraćeni instrumenti osiguranja naplate potraživanja, zbog čega kasnije Grad ni sudskim putem nije uspio naplatiti milijunske kamate zbog navodno zakašnjele uplate komunalnog doprinosa.

Bitka se nastavila jer Grad Split godinama odbijao zatražiti izvlaštenje zemljišta na kojem se nalazi bespravna “kuća Svaguša”, za koju postoji rješenje o rušenju. 

Izvlaštenje tog zemljišta nužno je da bi se moglo krenuti u izgradnju cestovnog priključka koji bi, kao nastavak Ulice Domovinskog rata, spojio Mejaše i trgovački centar na Ulicu Zbora narodne garde. 

Zato "Mejaši prvi" smatraju da Grad nije ispunio svoj dio sporazuma potpisanog 2011. godine, te su "Mejaši deveti"  tužili Grad Split da plati 66 milijuna kuna za ranije spomenute prometnice na Mejašima, a to je stvar još jednog spora koji se vodi na splitskom sudu.

Zbog kompliciranih odnosa između investitora i Grada Splita, prometnice koje okružuju trgovački centar Mall of Split su u privatnom vlasništvu, a Grad Split to želi promijeniti. Zato je pokrenuo tužbu koju je u četvrtak u tom dijelu nepravomoćno prihvatio Trgovački sud u Splitu.

Prema presudi, tvrtka "Mejaši prvi" kao investitor te trgovačke meke na Mejašima mora izmjestiti prometnice da budu u skladu s glavnim projektom. Mora otkupiti zemljišta za sve ceste i za njih ishoditi tehničku dokumentaciju. Sve to treba napraviti u roku od šest mjeseci i sve predati Gradu Splitu koji bi se na te prometnice uknjižio, proveo tehnički nadzor i za njih dobio uporabnu dozvolu. 

Tvrtka "Mejaši prvi" te se obveze može osloboditi ako plati 27,55 milijuna kuna, odnosno oko 3,65 milijuna eura koliko Grad procjenjuje vrijednost radova neizgrađenih prometnica i otkupa zemljišta.

Glavnina tih cesta i zemljišta su prilikom podjele izvorne investitorske tvrtke "Mejaši", pripale "Mejašima devetim". Sud smatra kako to ne sprječava sestrinsku tvrtku "Mejaše prve" da ta zemljišta i prometnice s infrastrukturom otkupi i preda Gradu.

Trgovački sud je, s druge strane, odbio traženje Grada Splita da naloži trgovačkom centru da "pripremi preostale dijelove građevine Mall of Split za tehnički pregled", jer uporabna dozvola je već izdana, pa Grad ne može uvjetovati centru da neće biti otvoren ako ne preda ceste.

Sud je prihvatio zahtjev Grada da mu suprotna strana u sporu plati 1.530.000 kuna, odnosno oko 203.000 eura odvjetničkih i sudskih troškova.

Zamršeni odnosi trgovačkog centra Mall of Split na Mejašima i Grada Splita krenuli su 2011. godine kada je tadašnji gradonačelnik Željko Kerum odobrio veću izgrađenost centra pod uvjetom da investitor o svom trošku izgradi potrebne prometnice i preda ih Gradu. 

Zatim su u mandatu gradonačelnika Ive Baldasara investitoru te trgovačke meke vraćeni instrumenti osiguranja naplate potraživanja, zbog čega kasnije Grad ni sudskim putem nije uspio naplatiti milijunske kamate zbog navodno zakašnjele uplate komunalnog doprinosa.

Bitka se nastavila jer Grad Split godinama odbijao zatražiti izvlaštenje zemljišta na kojem se nalazi bespravna “kuća Svaguša”, za koju postoji rješenje o rušenju. 

Izvlaštenje tog zemljišta nužno je da bi se moglo krenuti u izgradnju cestovnog priključka koji bi, kao nastavak Ulice Domovinskog rata, spojio Mejaše i trgovački centar na Ulicu Zbora narodne garde. 

Zato "Mejaši prvi" smatraju da Grad nije ispunio svoj dio sporazuma potpisanog 2011. godine, te su "Mejaši deveti"  tužili Grad Split da plati 66 milijuna kuna za ranije spomenute prometnice na Mejašima, a to je stvar još jednog spora koji se vodi na splitskom sudu.

Zbog kompliciranih odnosa između investitora i Grada Splita, prometnice koje okružuju trgovački centar Mall of Split su u privatnom vlasništvu, a Grad Split to želi promijeniti. Zato je pokrenuo tužbu koju je u četvrtak u tom dijelu nepravomoćno prihvatio Trgovački sud u Splitu.

Prema presudi, tvrtka "Mejaši prvi" kao investitor te trgovačke meke na Mejašima mora izmjestiti prometnice da budu u skladu s glavnim projektom. Mora otkupiti zemljišta za sve ceste i za njih ishoditi tehničku dokumentaciju. Sve to treba napraviti u roku od šest mjeseci i sve predati Gradu Splitu koji bi se na te prometnice uknjižio, proveo tehnički nadzor i za njih dobio uporabnu dozvolu.
