Splitski poduzetnik Kristijan Gelo platio je ovih dana 170 tisuća kuna kazne u državni proračun. 

Visoke kazne od 100.000 i 70.000 kuna dobio je kao direktor tvrtke "Mejaši prvi" koja želi na mjestu bespravne kuće Svaguša i garaže na adresi Ulica Josipa Jovića 73, o svom trošku izgraditi cestovni priključak koji je tamo definiran GUP-om i koji bi kvart Mejaše i trgovački centar Mall of Split spojio s ulicama Domovinskog rata i Zbora narodne garde. 

A razlog zbog kojeg su mu određene globe je taj što ne može dovesti bagere kako bi srušio kuću Svaguša i garažu, te tako ispunio nalog građevinske inspekcije, sve dok u toj kući živi Milivoj Svaguša s obitelji.

Naime, dok je brat Milivoja Svaguše svoju polovicu kuće prodao Gelinim "Mejašima prvim", Milivoj je svoju polovicu još 2017. godine prodao tvrtki "Centar Split", Gelinom ljutom protivniku, za jedan milijun eura, te se s obitelj ugovorom obvezao "Centru Split" da će u kući nastaviti živjeti.

(Inače, tvrtka "Mejaši prvi" se kao investitor Mall of Splita godinama sudila s "Centrom Split", predstavnikom Spar grupacije, koji je kratko upravljao tim trgovačkim centrom.) 

Tako Gelo i "Mejaši prvi" kuću Svaguša ne mogu srušiti bez opasnosti da netko ne bude ozlijeđen, jer policijsku asistenciju radi udaljavanja obitelji iz nelegalnog objekta ne mogu dobiti ni kao fizička ni kao pravna osoba jer nemaju javne ovlasti.

Policijsku asistenciju prilikom rušenja objekta zato može dobiti građevinska inspekcija. No, ona uporno ne odgovara na Geline molbe.

Umjesto toga inspekcija se pretvara da su dopisi Kristijana Gele zapravo žalba na rješenja o rušenju, koju "žalbu" onda odbacuje.

- Uopće se nisam žalio na doneseno rješenje o rušenju, već sam od vas samo tražio asistenciju u provođenju i izvršenju vašeg rješenja. Stoga ne razumijem vašu formulaciju "žalba se odbacuje". 

- Ako zaista želite da se vaše rješenje provede, onda jednostavno zatražite asistenciju policije i objekt će se odmah rušiti. Ako vam nije stalo da se vaše rješenje provede, onda se jednostavno oglušite na moj zahtjev za asistencijom i svakih godinu-dvije dana pošaljite novo rješenje o novčanoj kazni. 

- Po vama će se tako ovaj predmet voditi sigurno još pet godina. Možda mislite da je to standard hrvatske administracije. Kada bih imao pravnih mogućnosti tražiti sudsku presudu i sudsku pomoć u rješavanju ovog predmeta, sigurno bih to učinio. 

- Međutim ne mogu tužiti Svagušu što živi u kući, a ne mogu tužiti ni vas jer se vaše odluke provode na osnovu upravnog akta. Zaključak je da ništa ne mogu napraviti osim gledati kako hrvatska administracija funkcionira.

- Vaša nada je možda da ćete za pet godina otići u mirovinu pa se više nećete morati baviti ovim predmetom. A meni, kao hrvatskom građaninu koji zastupa strane vlasnike, ne preostaje ništa drugo nego se beskrajno sramiti dok objašnjavam na koji način funkcionira naša hrvatska administracija i birokracija - napisao je Kristijan Gelo u dopisu kojeg je uputio građevinskom inspektoru.

Da se donese rješenje o rušenju navijao je upravo Gelo i ono je na snazi od 2017. godine. Osim njega, kaznu zbog neizvršavanja naloga inspekcije dobio je i Milivoj Svaguša, i to u iznosu od 45 tisuća kuna. Naime, on se službeno i dalje vodi kao suvlasnik kuće jer "Centar Split" nije zatražio da se upiše u zemljišne knjige, već je kupoprodajni ugovor tek zabilježen u obliku tzv. plombe na nekretnini.

To je drugi put da su Gelo i Svaguša kažnjeni, a prvi put su globljeni sa 70.000 i 30.000 kuna.

Tek nakon što im se izrekne šest kazni, građevinska inspekcija će krenuti s rušenjem u svom angažmanu.

Odgovore smo u ponedjeljak ujutro zatražili od Državnog inspektorata pri kojem je građevinska inspekcija.

Splitski poduzetnik Kristijan Gelo platio je ovih dana 170 tisuća kuna kazne u državni proračun. 

Visoke kazne od 100.000 i 70.000 kuna dobio je kao direktor tvrtke "Mejaši prvi" koja želi na mjestu bespravne kuće Svaguša i garaže na adresi Ulica Josipa Jovića 73, o svom trošku izgraditi cestovni priključak koji je tamo definiran GUP-om i koji bi kvart Mejaše i trgovački centar Mall of Split spojio s ulicama Domovinskog rata i Zbora narodne garde. 

A razlog zbog kojeg su mu određene globe je taj što ne može dovesti bagere kako bi srušio kuću Svaguša i garažu, te tako ispunio nalog građevinske inspekcije, sve dok u toj kući živi Milivoj Svaguša s obitelji.

Naime, dok je brat Milivoja Svaguše svoju polovicu kuće prodao Gelinim "Mejašima prvim", Milivoj je svoju polovicu još 2017. godine prodao tvrtki "Centar Split", Gelinom ljutom protivniku, za jedan milijun eura, te se s obitelj ugovorom obvezao "Centru Split" da će u kući nastaviti živjeti.

(Inače, tvrtka "Mejaši prvi" se kao investitor Mall of Splita godinama sudila s "Centrom Split", predstavnikom Spar grupacije, koji je kratko upravljao tim trgovačkim centrom.) 

Tako Gelo i "Mejaši prvi" kuću Svaguša ne mogu srušiti bez opasnosti da netko ne bude ozlijeđen, jer policijsku asistenciju radi udaljavanja obitelji iz nelegalnog objekta ne mogu dobiti ni kao fizička ni kao pravna osoba jer nemaju javne ovlasti.

Policijsku asistenciju prilikom rušenja objekta zato može dobiti građevinska inspekcija. No, ona uporno ne odgovara na Geline molbe.

Umjesto toga inspekcija se pretvara da su dopisi Kristijana Gele zapravo žalba na rješenja o rušenju, koju "žalbu" onda odbacuje.

- Uopće se nisam žalio na doneseno rješenje o rušenju, već sam od vas samo tražio asistenciju u provođenju i izvršenju vašeg rješenja. Stoga ne razumijem vašu formulaciju "žalba se odbacuje". 

- Ako zaista želite da se vaše rješenje provede, onda jednostavno zatražite asistenciju policije i objekt će se odmah rušiti. Ako vam nije stalo da se vaše rješenje provede, onda se jednostavno oglušite na moj zahtjev za asistencijom i svakih godinu-dvije dana pošaljite novo rješenje o novčanoj kazni. 

- Po vama će se tako ovaj predmet voditi sigurno još pet godina. Možda mislite da je to standard hrvatske administracije. Kada bih imao pravnih mogućnosti tražiti sudsku presudu i sudsku pomoć u rješavanju ovog predmeta, sigurno bih to učinio. 

- Međutim ne mogu tužiti Svagušu što živi u kući, a ne mogu tužiti ni vas jer se vaše odluke provode na osnovu upravnog akta. Zaključak je da ništa ne mogu napraviti osim gledati kako hrvatska administracija funkcionira.

- Vaša nada je možda da ćete za pet godina otići u mirovinu pa se više nećete morati baviti ovim predmetom. A meni, kao hrvatskom građaninu koji zastupa strane vlasnike, ne preostaje ništa drugo nego se beskrajno sramiti dok objašnjavam na koji način funkcionira naša hrvatska administracija i birokracija - napisao je Kristijan Gelo u dopisu kojeg je uputio građevinskom inspektoru.

Da se donese rješenje o rušenju navijao je upravo Gelo i ono je na snazi od 2017. godine. Osim njega, kaznu zbog neizvršavanja naloga inspekcije dobio je i Milivoj Svaguša, i to u iznosu od 45 tisuća kuna. Naime, on se službeno i dalje vodi kao suvlasnik kuće jer "Centar Split" nije zatražio da se upiše u zemljišne knjige, već je kupoprodajni ugovor tek zabilježen u obliku tzv. plombe na nekretnini.

To je drugi put da su Gelo i Svaguša kažnjeni, a prvi put su globljeni sa 70.000 i 30.000 kuna.

Tek nakon što im se izrekne šest kazni, građevinska inspekcija će krenuti s rušenjem u svom angažmanu.

Odgovore smo u ponedjeljak ujutro zatražili od Državnog inspektorata pri kojem je građevinska inspekcija.

Splitski poduzetnik Kristijan Gelo platio je ovih dana 170 tisuća kuna kazne u državni proračun. 

Visoke kazne od 100.000 i 70.000 kuna dobio je kao direktor tvrtke "Mejaši prvi" koja želi na mjestu bespravne kuće Svaguša i garaže na adresi Ulica Josipa Jovića 73, o svom trošku izgraditi cestovni priključak koji je tamo definiran GUP-om i koji bi kvart Mejaše i trgovački centar Mall of Split spojio s ulicama Domovinskog rata i Zbora narodne garde. 

A razlog zbog kojeg su mu određene globe je taj što ne može dovesti bagere kako bi srušio kuću Svaguša i garažu, te tako ispunio nalog građevinske inspekcije, sve dok u toj kući živi Milivoj Svaguša s obitelji.
