Gong je danas, putem svog Facebook profila, komentirao ponovljene kotarske izbore u Splitu; konkretno, na Mertojaku i Splitu 3. Objava se zove "Dužnost je biračkih odbora da osiguravaju pravilnost i tajnost glasanja", a problematizira navodni potez lokalnog HDZ-ovca koji je člana biračkog odbora tražio da mu podastre detalje o onima koji su izašli na biralište.

Napisano prenosimo u cijelosti:

"Iako Gong nije promatrao izbore za članove vijeća gradskih kotareva Mertojak i Split 3, zaprimili smo e-mail nadležnog Izbornog povjerenstva u kojem upozoravaju na ozbiljnu pritužbu na izborni proces i traže naš komentar.

U zapisniku biračkog odbora navodi se kako je jedna članica biračkog odbora zaprimila od lokalnog HDZ-ovca WhatsApp poruku s listom birača tražeći odgovor jesu li izašli na biralište, te da se nakon toga prijetilo članu biračkog odbora koji je razotkrio spornu praksu.

Dužnost je biračkih odbora da osiguravaju pravilnost i tajnost glasanja. Nedopustivo je da članica biračkog odbora kontaminira proces i pruža podatke o izašlim glasačima bilo kome, a kamoli političkoj stranci koja to može koristiti to za pritisak ili ucjenu.

Ovime se direktno otvara prostor za povredu slobode odlučivanja i tajnosti glasanja. Ne samo da se ovakvom praksom krši članak 4. Zakona o lokalnim izborima prema kojem nitko ne može zahtijevati izjašnjenje birača o njegovom glasačkom opredjeljenju, već postoje i elementi kršenja odredaba Kaznenog zakona. Prema Kaznenom zakonu, čin povrede slobode odlučivanja i tajnosti glasanja definiran je na način: “Tko silom, ozbiljnom prijetnjom, podmićivanjem ili na drugi protuzakonit način utječe na birača da na izborima glasuje na određeni način ili da ne glasuje”(čl. 333.), te “Tko na izborima povrijedi tajnost glasovanja ili bez pristanka birača objavi kako je on glasovao” (čl. 336).

Pozivamo DORH da se uključi u istragu i utvrdi da li je bilo povrede biračkog prava. Nije nepoznato da je političkim strankama bitna stega članova i simpatizera te njhov izlazak na izbore u što većem broju. No, pravila demokratskih izbora s razlogom štite tajnost izbora, a ovakve dojave mogu predstavljati podlogu za pritisak na birače.

Isto tako, izvaci iz Popisa birača predstavljaju izborni materijal kojim se služiti može samo izborna administracija, a “uspoređivanje bilježaka” drugih aktera s biračkim odborima nije dozvoljena. Birački odbori ne služe strankama za kontrolu biračke stege.

Ako su navodi iz prijave utemeljeni, Gong smatra da postoje osnove za zaključak o teškoj povredi regularnosti izbora, u najmanju ruku na dotičnom biračkom mjestu. Za to je propisana kazna zatvora od šest mjeseci do pet godina, odnosno zatvor do jedne godine", poručili su iz Gonga.

"Iako Gong nije promatrao izbore za članove vijeća gradskih kotareva Mertojak i Split 3, zaprimili smo e-mail nadležnog Izbornog povjerenstva u kojem upozoravaju na ozbiljnu pritužbu na izborni proces i traže naš komentar.

U zapisniku biračkog odbora navodi se kako je jedna članica biračkog odbora zaprimila od lokalnog HDZ-ovca WhatsApp poruku s listom birača tražeći odgovor jesu li izašli na biralište, te da se nakon toga prijetilo članu biračkog odbora koji je razotkrio spornu praksu.

Dužnost je biračkih odbora da osiguravaju pravilnost i tajnost glasanja. Nedopustivo je da članica biračkog odbora kontaminira proces i pruža podatke o izašlim glasačima bilo kome, a kamoli političkoj stranci koja to može koristiti to za pritisak ili ucjenu.

Ovime se direktno otvara prostor za povredu slobode odlučivanja i tajnosti glasanja. Ne samo da se ovakvom praksom krši članak 4. Zakona o lokalnim izborima prema kojem nitko ne može zahtijevati izjašnjenje birača o njegovom glasačkom opredjeljenju, već postoje i elementi kršenja odredaba Kaznenog zakona. Prema Kaznenom zakonu, čin povrede slobode odlučivanja i tajnosti glasanja definiran je na način: “Tko silom, ozbiljnom prijetnjom, podmićivanjem ili na drugi protuzakonit način utječe na birača da na izborima glasuje na određeni način ili da ne glasuje”(čl. 333.), te “Tko na izborima povrijedi tajnost glasovanja ili bez pristanka birača objavi kako je on glasovao” (čl. 336).

Pozivamo DORH da se uključi u istragu i utvrdi da li je bilo povrede biračkog prava. Nije nepoznato da je političkim strankama bitna stega članova i simpatizera te njhov izlazak na izbore u što većem broju. No, pravila demokratskih izbora s razlogom štite tajnost izbora, a ovakve dojave mogu predstavljati podlogu za pritisak na birače.

Isto tako, izvaci iz Popisa birača predstavljaju izborni materijal kojim se služiti može samo izborna administracija, a “uspoređivanje bilježaka” drugih aktera s biračkim odborima nije dozvoljena. Birački odbori ne služe strankama za kontrolu biračke stege.

Ako su navodi iz prijave utemeljeni, Gong smatra da postoje osnove za zaključak o teškoj povredi regularnosti izbora, u najmanju ruku na dotičnom biračkom mjestu. Za to je propisana kazna zatvora od šest mjeseci do pet godina, odnosno zatvor do jedne godine", poručili su iz Gonga.

Gong je danas, putem svog Facebook profila, komentirao ponovljene kotarske izbore u Splitu; konkretno, na Mertojaku i Splitu 3. Objava se zove "Dužnost je biračkih odbora da osiguravaju pravilnost i tajnost glasanja", a problematizira navodni potez lokalnog HDZ-ovca koji je člana biračkog odbora tražio da mu podastre detalje o onima koji su izašli na biralište.
