Dio kuća na Marjanu koje se nalaze u zoni R3, u području predviđenom za rekreaciju, teoretski bi mogle postati - restorani?!
Naime, u rekreacijskoj zoni logično je dozvoljena gradnja ugostiteljskih objekata. Zoran primjer je zemljište na Prvoj vodi u vlasništvu obitelji Željka Keruma, kojeg su samo prosvjedi zaustavili u podizanju restorana na toj lokaciji.
- Takvih objekata je desetak. Ja prvi mogu tražiti da mi se dio kuće legalizira kao restoran jer se nalazi u zoni u kojoj je to dozvoljeno.
Dio kuća je i u zoni u kojoj su predviđene društvene djelatnosti. To je područje kod bivše Ivaniševićeve vile. Tu se mogu otvoriti galerije, muzeji, čak i vjerski objekti: crkve ili džamije - kaže Goran Jugović iz udruge Merjan.
Jugović poziva novu gradsku vlast da strogo poštuje zakone i procedure, kako su to i proklamirali u predizbornoj kampanji.
- Komisija za urbanizam Grada Splita iznašla je način za legalizaciju kuća na poluotoku Marjanu o čemu se nužno mora raspravljati na idućoj sjednici Vijeća.
Od toga se ne može pobjeći. Prijedlog komisije je da se, poput objekata građenih na Medvednici ili Telašćici, naše kuće proglase tradicijskom naseobinom - veli Jugović.

Zadatak Komisije za urbanizam je da sagleda ukupno stanje u urbanizmu Grada Splita, odnosno daje mišljenja, prijedloge i primjedbe na prijedloge akata prostorno planske dokumentacije u fazi pripreme nacrta prijedloga akata iz nadležnosti Gradskoga vijeća, odnosno prije utvrđivanja prijedloga od strane Gradonačelnika. Njime je u prošlom sazivu presjedao Ante Čikotić.
Raniji prijedlog da se objekti na Marjanu izgrađeni bez dozvola proglase tradicijskim gradnjom, a kako bi ih se ostavilo u prostoru, nije prošao, jer oni to uistinu nisu. Takvo je mišljenje, objašnjava Jugović, dalo Ministarstvo kulture.
- No, zato je Ministarstvo graditeljstva i prostornog uređenja konstatiralo da se tu radi o tradicijskim naseobinama, a ne o tradicijskoj gradnji, a po tom osnovu kuće bi trebale biti legalizirane - uvjeren je naš sugovornik.
Mogu li Republika Hrvatska i Grad Split inicirati donošenja posebnog zakona koji bi riješio ovu situaciju i omogućio Splićanima da postanu punopravnim vlasnicima kuća na Marjanu?

- Mogu, ali nije potrebno. Na temelju odluke Gradskog vijeća Splita o prijedlogu Komisije za urbanizam koja je savjetodavno tijelo istog tog Vijeća, može se prihvatiti mišljenje nadležnog ministarstva da je riječ o tradicijskoj naseobini i na tom osnovu legalizirati postojeće objekte jer su takvi slučajevi u nas poznati - veli Jugović.
Kako sada stvari stoje, 70-ak kuća na brdu iznad Splita, od kojih su mnoge građene prije nego je Marjan proglašen park šumom, ne mogu se legalizirati prema Zakonu o postupanju s nezakonito izgrađenim zgradama.
To znači da će nova gradska vlast morati takvo što konstatirati i odbiti zahtjeve kao neosnovane. Nakon toga je na potezu Građevinska inspekcija koja bi trebala vlasnicima takvih objekata izdati rješenja o uklanjanju.
Ukratko; čim u Banovini izvade ove predmete iz ladica, po sili zakona na takve će se zahtjeve odgovoriti negativno i predati palicu građevinskim inspektorima.

Na koncu bi Ministarstvo graditeljstva i prostornog uređenja bilo to koje raspisuje natječaj na kojem bira tvrtke koje će uklanjati objekte, što se obično događa jednom ili dvaput godišnje.
- To što ste naveli ne stoji iz više razloga. Kao prvo, nema sedamdesetak kuća jer su u međuvremenu neke legalizirane, poput "Džungle" na Zvončacu, a kao drugo, nitko ne može i ne smije prejudicirati da će zahtjevi za legalizaciju a priori biti odbijeni, a kako je to izjavio zamjenik gradonačelnika Bojan Ivošević, koji to sada demantira - rezolutan je Jugović.

Apsurdno je da ono što se dozvolilo zaslužnom građaninu Goranu Ivaniševiću ili što je silom isposlovao ratni invalid Vladimir Benac, koji je kao taoca držao gradonačelnika Ivana Škarića, nije i ostalima; s tim da su Ivanišević i Benac izgradili kućerine, a u slučaju Splićana koji traže legalizaciju na Marjanu u najvećem broju slučajeva radi se o manjim objektima od kojih se dio nekada nalazio izvan granica park šume.

Dio kuća na Marjanu koje se nalaze u zoni R3, u području predviđenom za rekreaciju, teoretski bi mogle postati - restorani?!
Naime, u rekreacijskoj zoni logično je dozvoljena gradnja ugostiteljskih objekata. Zoran primjer je zemljište na Prvoj vodi u vlasništvu obitelji Željka Keruma, kojeg su samo prosvjedi zaustavili u podizanju restorana na toj lokaciji.
- Takvih objekata je desetak. Ja prvi mogu tražiti da mi se dio kuće legalizira kao restoran jer se nalazi u zoni u kojoj je to dozvoljeno.
Dio kuća je i u zoni u kojoj su predviđene društvene djelatnosti. To je područje kod bivše Ivaniševićeve vile. Tu se mogu otvoriti galerije, muzeji, čak i vjerski objekti: crkve ili džamije - kaže Goran Jugović iz udruge Merjan.
Jugović poziva novu gradsku vlast da strogo poštuje zakone i procedure, kako su to i proklamirali u predizbornoj kampanji.
- Komisija za urbanizam Grada Splita iznašla je način za legalizaciju kuća na poluotoku Marjanu o čemu se nužno mora raspravljati na idućoj sjednici Vijeća.
Od toga se ne može pobjeći. Prijedlog komisije je da se, poput objekata građenih na Medvednici ili Telašćici, naše kuće proglase tradicijskom naseobinom - veli Jugović.

Zadatak Komisije za urbanizam je da sagleda ukupno stanje u urbanizmu Grada Splita, odnosno daje mišljenja, prijedloge i primjedbe na prijedloge akata prostorno planske dokumentacije u fazi pripreme nacrta prijedloga akata iz nadležnosti Gradskoga vijeća, odnosno prije utvrđivanja prijedloga od strane Gradonačelnika. Njime je u prošlom sazivu presjedao Ante Čikotić.
Raniji prijedlog da se objekti na Marjanu izgrađeni bez dozvola proglase tradicijskim gradnjom, a kako bi ih se ostavilo u prostoru, nije prošao, jer oni to uistinu nisu. Takvo je mišljenje, objašnjava Jugović, dalo Ministarstvo kulture.
- No, zato je Ministarstvo graditeljstva i prostornog uređenja konstatiralo da se tu radi o tradicijskim naseobinama, a ne o tradicijskoj gradnji, a po tom osnovu kuće bi trebale biti legalizirane - uvjeren je naš sugovornik.
Mogu li Republika Hrvatska i Grad Split inicirati donošenja posebnog zakona koji bi riješio ovu situaciju i omogućio Splićanima da postanu punopravnim vlasnicima kuća na Marjanu?

- Mogu, ali nije potrebno. Na temelju odluke Gradskog vijeća Splita o prijedlogu Komisije za urbanizam koja je savjetodavno tijelo istog tog Vijeća, može se prihvatiti mišljenje nadležnog ministarstva da je riječ o tradicijskoj naseobini i na tom osnovu legalizirati postojeće objekte jer su takvi slučajevi u nas poznati - veli Jugović.
Kako sada stvari stoje, 70-ak kuća na brdu iznad Splita, od kojih su mnoge građene prije nego je Marjan proglašen park šumom, ne mogu se legalizirati prema Zakonu o postupanju s nezakonito izgrađenim zgradama.
To znači da će nova gradska vlast morati takvo što konstatirati i odbiti zahtjeve kao neosnovane. Nakon toga je na potezu Građevinska inspekcija koja bi trebala vlasnicima takvih objekata izdati rješenja o uklanjanju.
Ukratko; čim u Banovini izvade ove predmete iz ladica, po sili zakona na takve će se zahtjeve odgovoriti negativno i predati palicu građevinskim inspektorima.

Na koncu bi Ministarstvo graditeljstva i prostornog uređenja bilo to koje raspisuje natječaj na kojem bira tvrtke koje će uklanjati objekte, što se obično događa jednom ili dvaput godišnje.
- To što ste naveli ne stoji iz više razloga. Kao prvo, nema sedamdesetak kuća jer su u međuvremenu neke legalizirane, poput "Džungle" na Zvončacu, a kao drugo, nitko ne može i ne smije prejudicirati da će zahtjevi za legalizaciju a priori biti odbijeni, a kako je to izjavio zamjenik gradonačelnika Bojan Ivošević, koji to sada demantira - rezolutan je Jugović.

Apsurdno je da ono što se dozvolilo zaslužnom građaninu Goranu Ivaniševiću ili što je silom isposlovao ratni invalid Vladimir Benac, koji je kao taoca držao gradonačelnika Ivana Škarića, nije i ostalima; s tim da su Ivanišević i Benac izgradili kućerine, a u slučaju Splićana koji traže legalizaciju na Marjanu u najvećem broju slučajeva radi se o manjim objektima od kojih se dio nekada nalazio izvan granica park šume.
