Vrhovni sud potvrdio je presudu splitskog Županijskog suda prema kojoj je, na samom izmaku 2016. godine, na dvije godine zatvora zbog zlouporabe položaja i ovlasti, osuđen Srđan Kačić Bartulović, bivši HDZ-ov zamjenik načelnika hvarske općine Sućuraj i potpredsjednik Općinskog vijeća.

Kačić Bartulović zbog pozne dobi od 73 godine i teško narušenog zdravstvenog stanja vjerojatno nikad neće zapravo završiti iza rešetaka, no zanimljivo je da je ovaj slučaj praktički "na mišiće izgurao" tadašnji odvjetnik Općine Jadran Franceschi nakon što je DORH odbacio kaznenu prijavu koju je on podnio. Odvjetnik je tad preuzeo progon u ime općine, ali je i preko svojih veza isposlovao da DORH progon ipak pokrene.

Pokrenuta je istraga, no postupak je obustavljen odlukom Županijskog suda, ali je išla je žalba Vrhovnom sudu koji je, pak, poništio tu odluku i krenuo je sudski postupak.

Bivši je donačelnik osuđen jer je, obzirom na funkcije koje je obnašao od 14. srpnja do 10. listopada 2005., neistinito prikazao stanje kako bi protuzakonito stekao pravo vlasništva nad oko 14 i pol tisuća četvornih metara zemlje u atraktivnoj uvali Mlaska. On je, po presudi, osobno 14. srpnja 2005. podnio tužbu protiv Općine Sućuraj radi utvrđivanja prava vlasništva nad 14.445 četvornih metara zemlje u toj uvali, po procjeni poreznika, vrijednih najmanje šest milijuna i 875 tisuća kuna. Za toliko je u presudi navedeno da je oštećena država.

Neistinito je naveo da je zemljište stekao dosjelošću te je priložio rješenje iz katastra znajući da je početkom 2005. godine upisan kao posjednik zemljišta na manjem dijelu od oko 6500 četvornih metara, i to na temelju ugovora o darovanju od Vidosave Jeličić od 15. prosinca 2004. godine.

Prema presudi, o svojoj tužbi nikoga u Općini nije obavijestio niti je poduzeo išta da bi netko drugi zastupao Općinu. Znao je da je to atraktivno zemljište uz more u građevinskom području te da je na tom zemljištu od 1979. godine izgrađen autokamp s tri zgrade s pristupnim putovima, priključenom strujom i vodom, a koje je od Općine sudskim putem potraživala tvrtka “Sućuraj” d.d.

Nakon što je Općinski sud u Starom Gradu 22. srpnja 2005. godine dostavio Općini Sućuraj njegovu tužbu radi odgovora i kad je 16. kolovoza iste godine tužba s pozivom zaprimljena u Općini Sućuraj, Kačić Bartulović je, kao zamjenik tadašnjeg načelnika Vladimira Rudana, iskoristio to što njega nije bilo te je uzeo i tužbu i poziv kako bi onemogućio odgovor, a da nikome nije rekao za dopise. Zato tužena Općina Sućuraj nije podnijela odgovor na tužbu. Kada je Općinski sud u Starom Gradu zaprimio uredno potpisanu dostavnicu, a bez odgovora na tužbu, bez održane je rasprave 20. rujna 2005. donio presudu zbog ogluhe.

U njoj je potpuno prihvaćen tužbeni zahtjev bivšeg zamjenika načelnika te je utvrđeno da je on vlasnik navedenih nekretnina u cijelosti i da je ovlašten ishoditi uknjižbu prava vlasništva uz prethodno brisanje istog prava s imena “Općenarodna imovina − mjesni Narodni odbor Sućuraj”.

Ta je presuda dostavljena Općini 30. rujna 2005., a Kačić Bartulović je, opet, iskoristio odsutnost načelnika Rudana te je uzeo presudu bez njegova znanja. Općina nije uložila žalbu te je presuda postala pravomoćna 18. listopada 2005. godine.

Na osnovi te pravomoćne presude i požurnice banke, Srđan Kačić Bartulović je 10. studenog 2005. podnio prijedlog za uknjižbu te je uknjižio pravo vlasništva, a time je oštetio državu nešto manje od sedam milijuna kuna. Nakon što se uknjižio, zemlju je u travnju 2008. dao u zakup tvrtki "Nova Mlaska" po cijeni od 100 eura po četvornome metru.

- Utvrđeno je i da je optuženik dvije godine prije podnošenjka tužbe za utvrđenje prava vlasništva ponudio sporno zemljište na prodaju odvjetniku iz Italije što samo za sebe govori da su sve daljnje radnje bile poduzete da se Općina Sućuraj zapravo isključi iz postupka štio je omogućilo donošenje presude zbog ogluhe - navodi se, uz ostalo, u odluci Vrhovnog suda.

Dodaju i da je okrivljeni naveo u žalbi da izrečenu kaznu, koju mu je "odrezalo" sudsko vijeće na čelu sa sucem Mlađanom Prvanom smatra krajnje neprimjerenom jer je "prvostupanjski sud bio impresioniran atraktivnošću predmetnog zemljišta", no da je sud pravilno utvrdio i ocijenio sve okolnosti koje utječu na odabir i vrstu kazne.

Vrhovni sud potvrdio je presudu splitskog Županijskog suda prema kojoj je, na samom izmaku 2016. godine, na dvije godine zatvora zbog zlouporabe položaja i ovlasti, osuđen Srđan Kačić Bartulović, bivši HDZ-ov zamjenik načelnika hvarske općine Sućuraj i potpredsjednik Općinskog vijeća.

Kačić Bartulović zbog pozne dobi od 73 godine i teško narušenog zdravstvenog stanja vjerojatno nikad neće zapravo završiti iza rešetaka, no zanimljivo je da je ovaj slučaj praktički "na mišiće izgurao" tadašnji odvjetnik Općine Jadran Franceschi nakon što je DORH odbacio kaznenu prijavu koju je on podnio. Odvjetnik je tad preuzeo progon u ime općine, ali je i preko svojih veza isposlovao da DORH progon ipak pokrene.

Pokrenuta je istraga, no postupak je obustavljen odlukom Županijskog suda, ali je išla je žalba Vrhovnom sudu koji je, pak, poništio tu odluku i krenuo je sudski postupak.

Bivši je donačelnik osuđen jer je, obzirom na funkcije koje je obnašao od 14. srpnja do 10. listopada 2005., neistinito prikazao stanje kako bi protuzakonito stekao pravo vlasništva nad oko 14 i pol tisuća četvornih metara zemlje u atraktivnoj uvali Mlaska. On je, po presudi, osobno 14. srpnja 2005. podnio tužbu protiv Općine Sućuraj radi utvrđivanja prava vlasništva nad 14.445 četvornih metara zemlje u toj uvali, po procjeni poreznika, vrijednih najmanje šest milijuna i 875 tisuća kuna. Za toliko je u presudi navedeno da je oštećena država.

Neistinito je naveo da je zemljište stekao dosjelošću te je priložio rješenje iz katastra znajući da je početkom 2005. godine upisan kao posjednik zemljišta na manjem dijelu od oko 6500 četvornih metara, i to na temelju ugovora o darovanju od Vidosave Jeličić od 15. prosinca 2004. godine.

Prema presudi, o svojoj tužbi nikoga u Općini nije obavijestio niti je poduzeo išta da bi netko drugi zastupao Općinu. Znao je da je to atraktivno zemljište uz more u građevinskom području te da je na tom zemljištu od 1979. godine izgrađen autokamp s tri zgrade s pristupnim putovima, priključenom strujom i vodom, a koje je od Općine sudskim putem potraživala tvrtka “Sućuraj” d.d.

Nakon što je Općinski sud u Starom Gradu 22. srpnja 2005. godine dostavio Općini Sućuraj njegovu tužbu radi odgovora i kad je 16. kolovoza iste godine tužba s pozivom zaprimljena u Općini Sućuraj, Kačić Bartulović je, kao zamjenik tadašnjeg načelnika Vladimira Rudana, iskoristio to što njega nije bilo te je uzeo i tužbu i poziv kako bi onemogućio odgovor, a da nikome nije rekao za dopise. Zato tužena Općina Sućuraj nije podnijela odgovor na tužbu. Kada je Općinski sud u Starom Gradu zaprimio uredno potpisanu dostavnicu, a bez odgovora na tužbu, bez održane je rasprave 20. rujna 2005. donio presudu zbog ogluhe.

U njoj je potpuno prihvaćen tužbeni zahtjev bivšeg zamjenika načelnika te je utvrđeno da je on vlasnik navedenih nekretnina u cijelosti i da je ovlašten ishoditi uknjižbu prava vlasništva uz prethodno brisanje istog prava s imena “Općenarodna imovina − mjesni Narodni odbor Sućuraj”.

Ta je presuda dostavljena Općini 30. rujna 2005., a Kačić Bartulović je, opet, iskoristio odsutnost načelnika Rudana te je uzeo presudu bez njegova znanja. Općina nije uložila žalbu te je presuda postala pravomoćna 18. listopada 2005. godine.

Na osnovi te pravomoćne presude i požurnice banke, Srđan Kačić Bartulović je 10. studenog 2005. podnio prijedlog za uknjižbu te je uknjižio pravo vlasništva, a time je oštetio državu nešto manje od sedam milijuna kuna. Nakon što se uknjižio, zemlju je u travnju 2008. dao u zakup tvrtki "Nova Mlaska" po cijeni od 100 eura po četvornome metru.

- Utvrđeno je i da je optuženik dvije godine prije podnošenjka tužbe za utvrđenje prava vlasništva ponudio sporno zemljište na prodaju odvjetniku iz Italije što samo za sebe govori da su sve daljnje radnje bile poduzete da se Općina Sućuraj zapravo isključi iz postupka štio je omogućilo donošenje presude zbog ogluhe - navodi se, uz ostalo, u odluci Vrhovnog suda.

Dodaju i da je okrivljeni naveo u žalbi da izrečenu kaznu, koju mu je "odrezalo" sudsko vijeće na čelu sa sucem Mlađanom Prvanom smatra krajnje neprimjerenom jer je "prvostupanjski sud bio impresioniran atraktivnošću predmetnog zemljišta", no da je sud pravilno utvrdio i ocijenio sve okolnosti koje utječu na odabir i vrstu kazne.
