Odlukom sutkinje splitskog Općinskog suda Julijane Ponoš, Hrvatska Provincija sv. Jeronima franjevaca konventualaca te njen sada već bivši član, fra Gracijan Gašperov koji je odlukom Pape Frane krajem srpnja 2018. godine izbačen uz crkvenih redova zbog pedofilije, morat će solidarno jednoj od fratrovih žrtvi isplatiti ukupno 90 tisuća kuna odštete! Uz to računaju se i kamate od 2018. godine, a morat će žrtvi podmiriti i 12 tisuća kuna sudskih troškova, piše Slobodna Dalmacija.

Ova je presuda zasad nepravomoćna, no važna jer je sud na osnovu iskaza žrtve, kombiniranog psihijatrijsko-psihološkog vještačenja te svjedočenja fra Ambroza, Gracijanovog subrata iz reda kojem se žrtva povjerila, zaključio da je istina da je tada 15-godišnji mladić uz Splita bio spolno zlostavljan od strane Gracijana u sakristiji samostana sv. Frane.

- Iako mnogi smatraju ovo mojom pobjedom, doduše nepravomoćnom, kao katolik sam uništen. Šteta moje boli procijenjena je na razinu klevete, to nisam zadovoljan. Novi biskup i čelnik HBK trebao bi biti pomoć i podrška najranjivijima, razgovarati sa žrtvama. Ja nemam vise volju za životom, dugo već pijem lijekove. Imam lijekove. Cijeli život dokazujem da je istina - istina. Tražim biskupov prijem kao čin kršćanstva i pomoć, razumijevanje i podršku. Ovo nije moj rat s crkvom, ja nisam neprijatelj, ja sam samo rekao istinu i onda sam prisiljen ići u sudski proces. Crkva to treba cijeniti - kazao nam je danas 40-godišnji Splićanin koji je u listopadu 1997. godine bio fratrova žrtva.

Sutkinja je u presudi, uz ostalo, navela i da se, obzirom na to da je vrh reda još u prosincu 2017.godine obaviješten o "neprimjerenom ponašanju" fra Gracijana prema nekoliko osoba, a da je nadležno ŽDO o tome službeno obaviješteno tek u travnju 2018. godine, stječe dojam da je Provincija znala za neprimjereno ponašanje svog fratra godinama prije negoli su o tome obavijestili Nadbiskupiju Splitsko-makarsku. Naime, žrtva je i od njih tražila odštetu, no sud je ocijenio da oni ne snose nikakvu odgovornost jer su, po saznanju o događaju, odmah poduzeli sve što je u njihovoj nadležnosti. To da je Provincija znala što se događa potvrđuje i činjenica da je žrtva na nagovor fra Ambroza sve prijavila ovom crkvenom redu još krajem 2011. godine. 

Sam je izbačeni fratar na sudu tvrdio da nikad žrtvu nije vidio, da ništa nije istina i da nikoga nikad nije zlostavljao. Nije znao objasniti zašto je u svom zahtjevu za razrješenjem napisao da je "svjestan svojih pogrešaka prema žrtvama" i da razrješenje traži zbog pravde prema žrtvama. Kazao je da je, ako je pogreška nekog zagrliti, onda on i pogriješio, no da smatra da nije bilo nikakve zle namjere u tome što je nekog zagrlio. Nije želio pojasniti zašto je tražio razrješenje iz reda te je ponovio da nikog nije zlostavljao i da se ne sjeća da je imao seksualne kontakte s osobama koje su ga tada prijavile.

Odlukom sutkinje splitskog Općinskog suda Julijane Ponoš, Hrvatska Provincija sv. Jeronima franjevaca konventualaca te njen sada već bivši član, fra Gracijan Gašperov koji je odlukom Pape Frane krajem srpnja 2018. godine izbačen uz crkvenih redova zbog pedofilije, morat će solidarno jednoj od fratrovih žrtvi isplatiti ukupno 90 tisuća kuna odštete! Uz to računaju se i kamate od 2018. godine, a morat će žrtvi podmiriti i 12 tisuća kuna sudskih troškova, piše Slobodna Dalmacija.

Ova je presuda zasad nepravomoćna, no važna jer je sud na osnovu iskaza žrtve, kombiniranog psihijatrijsko-psihološkog vještačenja te svjedočenja fra Ambroza, Gracijanovog subrata iz reda kojem se žrtva povjerila, zaključio da je istina da je tada 15-godišnji mladić uz Splita bio spolno zlostavljan od strane Gracijana u sakristiji samostana sv. Frane.

- Iako mnogi smatraju ovo mojom pobjedom, doduše nepravomoćnom, kao katolik sam uništen. Šteta moje boli procijenjena je na razinu klevete, to nisam zadovoljan. Novi biskup i čelnik HBK trebao bi biti pomoć i podrška najranjivijima, razgovarati sa žrtvama. Ja nemam vise volju za životom, dugo već pijem lijekove. Imam lijekove. Cijeli život dokazujem da je istina - istina. Tražim biskupov prijem kao čin kršćanstva i pomoć, razumijevanje i podršku. Ovo nije moj rat s crkvom, ja nisam neprijatelj, ja sam samo rekao istinu i onda sam prisiljen ići u sudski proces. Crkva to treba cijeniti - kazao nam je danas 40-godišnji Splićanin koji je u listopadu 1997. godine bio fratrova žrtva.

Sutkinja je u presudi, uz ostalo, navela i da se, obzirom na to da je vrh reda još u prosincu 2017.godine obaviješten o "neprimjerenom ponašanju" fra Gracijana prema nekoliko osoba, a da je nadležno ŽDO o tome službeno obaviješteno tek u travnju 2018. godine, stječe dojam da je Provincija znala za neprimjereno ponašanje svog fratra godinama prije negoli su o tome obavijestili Nadbiskupiju Splitsko-makarsku. Naime, žrtva je i od njih tražila odštetu, no sud je ocijenio da oni ne snose nikakvu odgovornost jer su, po saznanju o događaju, odmah poduzeli sve što je u njihovoj nadležnosti. To da je Provincija znala što se događa potvrđuje i činjenica da je žrtva na nagovor fra Ambroza sve prijavila ovom crkvenom redu još krajem 2011. godine. 

Sam je izbačeni fratar na sudu tvrdio da nikad žrtvu nije vidio, da ništa nije istina i da nikoga nikad nije zlostavljao. Nije znao objasniti zašto je u svom zahtjevu za razrješenjem napisao da je "svjestan svojih pogrešaka prema žrtvama" i da razrješenje traži zbog pravde prema žrtvama. Kazao je da je, ako je pogreška nekog zagrliti, onda on i pogriješio, no da smatra da nije bilo nikakve zle namjere u tome što je nekog zagrlio. Nije želio pojasniti zašto je tražio razrješenje iz reda te je ponovio da nikog nije zlostavljao i da se ne sjeća da je imao seksualne kontakte s osobama koje su ga tada prijavile.

Splitski fratar izbačen zbog pedofilije mora žrtvi isplatiti odštetu! Sud potvrdio da je mladića zlostavljao u sakristiji, razgovarali smo sa žrtvom: ‘Nisam zadovoljan...‘

Odlukom sutkinje splitskog Općinskog suda Julijane Ponoš, Hrvatska Provincija sv. Jeronima franjevaca konventualaca te njen sada već bivši član, fra Gracijan Gašperov koji je odlukom Pape Frane krajem srpnja 2018. godine izbačen uz crkvenih redova zbog pedofilije, morat će solidarno jednoj od fratrovih žrtvi isplatiti ukupno 90 tisuća kuna odštete! Uz to računaju se i kamate od 2018. godine, a morat će žrtvi podmiriti i 12 tisuća kuna sudskih troškova, piše Slobodna Dalmacija.

Ova je presuda zasad nepravomoćna, no važna jer je sud na osnovu iskaza žrtve, kombiniranog psihijatrijsko-psihološkog vještačenja te svjedočenja fra Ambroza, Gracijanovog subrata iz reda kojem se žrtva povjerila, zaključio da je istina da je tada 15-godišnji mladić uz Splita bio spolno zlostavljan od strane Gracijana u sakristiji samostana sv. Frane.

- Iako mnogi smatraju ovo mojom pobjedom, doduše nepravomoćnom, kao katolik sam uništen. Šteta moje boli procijenjena je na razinu klevete, to nisam zadovoljan. Novi biskup i čelnik HBK trebao bi biti pomoć i podrška najranjivijima, razgovarati sa žrtvama. Ja nemam vise volju za životom, dugo već pijem lijekove. Imam lijekove. Cijeli život dokazujem da je istina - istina. Tražim biskupov prijem kao čin kršćanstva i pomoć, razumijevanje i podršku. Ovo nije moj rat s crkvom, ja nisam neprijatelj, ja sam samo rekao istinu i onda sam prisiljen ići u sudski proces. Crkva to treba cijeniti - kazao nam je danas 40-godišnji Splićanin koji je u listopadu 1997. godine bio fratrova žrtva.
