Oko 63 posto starijih osoba koje su potpisale ugovor o dosmrtnom ili doživotnom uzdržavanju, nije se raspitalo o svojim pravima, upozorila je u četvrtak pučka pravobraniteljica Tena Šimonović Einwalter zatraživši obavezno savjetovanje prije potpisivanja takvih ugovora, piše HINA.

Starije osobe često su izložene zlouporabi ugovora o doživotnom i dosmrtnom uzdržavanju, rekla je pravobraniteljica uoči Međunarodnog dana starijih osoba koji se obilježava u subotu, 1.listopada.

Većina njih, oko 63 posto, nije upoznata sa svojim pravima ni s obvezama davatelja uzdržavanja, jer se o tim pitanjima kod nikoga nisu raspitali prije nego što su dali svoj potpis, pokazali su rezultati istraživanja iz 2019. godine.

"Zato je kroz Zakon o obveznim odnosima potrebno uvesti obavezu prethodnog savjetovanja i primatelja i davatelja uzdržavanja, o učincima i dosezima takvih ugovora, te osnovati registar ugovora o doživotnom i dosmrtnom uzdržavanju", istaknula je Šimonović Einwalter u priopćenju.

Značajna razlika između ove dvije vrste ugovora je što kod doživotnog uzdržavanja davatelj uzdržavanja imovinu može prepisati na sebe tek nakon smrti starije osobe, dok kod dosmrtnog uzdržavanja to može učiniti odmah nakon potpisivanja ugovora.

"Iako ovi ugovori starijim osobama donose mir i dostojanstvo u trenucima kad su zbog narušenog zdravlja izrazito ranjivi i nemoćni, još uvijek postoji značajan prostor za zlouporabe koje mogu dovesti do ekonomskog nasilja, zanemarivanja i zlostavljanja te kršenja njihovih ljudskih prava", kazala je pravobraniteljica.

Osim uvođenja registra navedenih ugovora i obveznog savjetovanja prije potpisivanja, potrebne su promjene i na sudovima. Naime, postupke za raskid ugovora o doživotnom ili dosmrtnom uzdržavanju treba urediti kao žurne postupke, smatra Šimonović Einwalter.

"U slučaju kad davatelj uzdržavanja ne izvršava svoje obveze, ugovor se može raskinuti. No, u praksi ovi sudski postupci traju dugo, što ima osobito otegotan učinak s obzirom na životnu dob primatelja uzdržavanja, koji ponekad umiru ne dočekavši raskid ugovora, bez adekvatne njege i skrbi", upozorila je.

Ove je godine ipak došlo do pozitivnih iskoraka kao što je novi Zakon o socijalnoj skrbi kojim je starijim osobama osigurano pravo na zajamčenu minimalnu naknadu, smještaj i pomoć u kući ako pokrenu postupak raskida ugovora.

Prema popisu stanovništva iz 2021., više od petine stanovnika Hrvatske osobe su starije životne dobi, koje su najizloženije riziku od siromaštva, a nedostaju im kapaciteti u programima dugotrajnoj skrbi.

Oko 63 posto starijih osoba koje su potpisale ugovor o dosmrtnom ili doživotnom uzdržavanju, nije se raspitalo o svojim pravima, upozorila je u četvrtak pučka pravobraniteljica Tena Šimonović Einwalter zatraživši obavezno savjetovanje prije potpisivanja takvih ugovora, piše HINA.

Starije osobe često su izložene zlouporabi ugovora o doživotnom i dosmrtnom uzdržavanju, rekla je pravobraniteljica uoči Međunarodnog dana starijih osoba koji se obilježava u subotu, 1.listopada.

Većina njih, oko 63 posto, nije upoznata sa svojim pravima ni s obvezama davatelja uzdržavanja, jer se o tim pitanjima kod nikoga nisu raspitali prije nego što su dali svoj potpis, pokazali su rezultati istraživanja iz 2019. godine.

"Zato je kroz Zakon o obveznim odnosima potrebno uvesti obavezu prethodnog savjetovanja i primatelja i davatelja uzdržavanja, o učincima i dosezima takvih ugovora, te osnovati registar ugovora o doživotnom i dosmrtnom uzdržavanju", istaknula je Šimonović Einwalter u priopćenju.

Značajna razlika između ove dvije vrste ugovora je što kod doživotnog uzdržavanja davatelj uzdržavanja imovinu može prepisati na sebe tek nakon smrti starije osobe, dok kod dosmrtnog uzdržavanja to može učiniti odmah nakon potpisivanja ugovora.

"Iako ovi ugovori starijim osobama donose mir i dostojanstvo u trenucima kad su zbog narušenog zdravlja izrazito ranjivi i nemoćni, još uvijek postoji značajan prostor za zlouporabe koje mogu dovesti do ekonomskog nasilja, zanemarivanja i zlostavljanja te kršenja njihovih ljudskih prava", kazala je pravobraniteljica.

Osim uvođenja registra navedenih ugovora i obveznog savjetovanja prije potpisivanja, potrebne su promjene i na sudovima. Naime, postupke za raskid ugovora o doživotnom ili dosmrtnom uzdržavanju treba urediti kao žurne postupke, smatra Šimonović Einwalter.

"U slučaju kad davatelj uzdržavanja ne izvršava svoje obveze, ugovor se može raskinuti. No, u praksi ovi sudski postupci traju dugo, što ima osobito otegotan učinak s obzirom na životnu dob primatelja uzdržavanja, koji ponekad umiru ne dočekavši raskid ugovora, bez adekvatne njege i skrbi", upozorila je.

Ove je godine ipak došlo do pozitivnih iskoraka kao što je novi Zakon o socijalnoj skrbi kojim je starijim osobama osigurano pravo na zajamčenu minimalnu naknadu, smještaj i pomoć u kući ako pokrenu postupak raskida ugovora.

Prema popisu stanovništva iz 2021., više od petine stanovnika Hrvatske osobe su starije životne dobi, koje su najizloženije riziku od siromaštva, a nedostaju im kapaciteti u programima dugotrajnoj skrbi.

Oko 63 posto starijih osoba koje su potpisale ugovor o dosmrtnom ili doživotnom uzdržavanju, nije se raspitalo o svojim pravima, upozorila je u četvrtak pučka pravobraniteljica Tena Šimonović Einwalter zatraživši obavezno savjetovanje prije potpisivanja takvih ugovora, piše HINA.

Starije osobe često su izložene zlouporabi ugovora o doživotnom i dosmrtnom uzdržavanju, rekla je pravobraniteljica uoči Međunarodnog dana starijih osoba koji se obilježava u subotu, 1.listopada.

Većina njih, oko 63 posto, nije upoznata sa svojim pravima ni s obvezama davatelja uzdržavanja, jer se o tim pitanjima kod nikoga nisu raspitali prije nego što su dali svoj potpis, pokazali su rezultati istraživanja iz 2019. godine.

"Zato je kroz Zakon o obveznim odnosima potrebno uvesti obavezu prethodnog savjetovanja i primatelja i davatelja uzdržavanja, o učincima i dosezima takvih ugovora, te osnovati registar ugovora o doživotnom i dosmrtnom uzdržavanju", istaknula je Šimonović Einwalter u priopćenju.

Značajna razlika između ove dvije vrste ugovora je što kod doživotnog uzdržavanja davatelj uzdržavanja imovinu može prepisati na sebe tek nakon smrti starije osobe, dok kod dosmrtnog uzdržavanja to može učiniti odmah nakon potpisivanja ugovora.

"Iako ovi ugovori starijim osobama donose mir i dostojanstvo u trenucima kad su zbog narušenog zdravlja izrazito ranjivi i nemoćni, još uvijek postoji značajan prostor za zlouporabe koje mogu dovesti do ekonomskog nasilja, zanemarivanja i zlostavljanja te kršenja njihovih ljudskih prava", kazala je pravobraniteljica.

Osim uvođenja registra navedenih ugovora i obveznog savjetovanja prije potpisivanja, potrebne su promjene i na sudovima. Naime, postupke za raskid ugovora o doživotnom ili dosmrtnom uzdržavanju treba urediti kao žurne postupke, smatra Šimonović Einwalter.

"U slučaju kad davatelj uzdržavanja ne izvršava svoje obveze, ugovor se može raskinuti. No, u praksi ovi sudski postupci traju dugo, što ima osobito otegotan učinak s obzirom na životnu dob primatelja uzdržavanja, koji ponekad umiru ne dočekavši raskid ugovora, bez adekvatne njege i skrbi", upozorila je.

Ove je godine ipak došlo do pozitivnih iskoraka kao što je novi Zakon o socijalnoj skrbi kojim je starijim osobama osigurano pravo na zajamčenu minimalnu naknadu, smještaj i pomoć u kući ako pokrenu postupak raskida ugovora.
