Građani zemalja Europske unije mogli bi tužiti svoje vlade za financijsku naknadu ako im nedopuštene razine onečišćenja zraka naruše zdravlje, rekla je u četvrtak savjetnica najvišeg suda u Europi.

Mišljenje savjetnice slijedi nakon serije presuda na luksemburškom Sudu Europske unije proteklih godina, kojima je desetak članica EU-a, uključujući Francusku, Poljsku, Italiju i Rumunjsku, proglašeno krivima za nedopušteno zagađenje zraka.

"Odvjetnica Juliane Kokott smatra da bi kršenje ograničenja zaštite kvalitete zraka prema zakonima EU-a moglo povećati pravo na naknadu od države", priopćio je sud, donosi Hina

Kokott je dodala da je češći slučaj da pravnu zaštitu trebaju siromašnije zajednice koje žive i rade u visoko zagađenim područjima.

Rekla je, međutim, da bilo koji pojedinac koji zatraži naknadu mora dokazati da je šteta za njihovo zdravlje izravno uzrokovana zagađenjem zraka. Vlada također može izbjeći odgovornost ako dokaže da bi ograničenja zagađenja i dalje bila prekršena i da je postojao dostatan plan kvalitete zraka, rekla je Kokott.

Mišljenja savjetnice suda su neobvezujuća, no sud EU-a se uglavnom slaže s njima u presudama koje uslijede.

Mišljenje je konkretno povezano sa slučajem stanovnika Pariza koji je tražio 21 milijun eura naknade od francuske vlade, na temelju toga da mu je zagađenje zraka oštetilo zdravlje te da se vlada nije pobrinula da onečišćenje bude u skladu s europskim ograničenjima.

Sud u Versaillesu koji je rješavao spor zatražio je od suda EU-a da razjasni mogu li pojedinci tražiti takvu naknadu.

Pariz je prekršio zakonska ograničenja dušikova dioksida između 2010. i 2019., prema ranijim presudama suda EU-a. To je isto učinjeno 2020., presudilo je Francusko državno vijeće.

U nastojanju da smanji preuranjene smrti povezane sa zagađenim zrakom, EU će predložiti unaprjeđenje svojih ograničenja pnečišćenja kako bi se bolje uskladila sa strogim pravilima Svjetske zdravstvene organizacije.

Građani zemalja Europske unije mogli bi tužiti svoje vlade za financijsku naknadu ako im nedopuštene razine onečišćenja zraka naruše zdravlje, rekla je u četvrtak savjetnica najvišeg suda u Europi.

Mišljenje savjetnice slijedi nakon serije presuda na luksemburškom Sudu Europske unije proteklih godina, kojima je desetak članica EU-a, uključujući Francusku, Poljsku, Italiju i Rumunjsku, proglašeno krivima za nedopušteno zagađenje zraka.

"Odvjetnica Juliane Kokott smatra da bi kršenje ograničenja zaštite kvalitete zraka prema zakonima EU-a moglo povećati pravo na naknadu od države", priopćio je sud, donosi Hina

Kokott je dodala da je češći slučaj da pravnu zaštitu trebaju siromašnije zajednice koje žive i rade u visoko zagađenim područjima.

Rekla je, međutim, da bilo koji pojedinac koji zatraži naknadu mora dokazati da je šteta za njihovo zdravlje izravno uzrokovana zagađenjem zraka. Vlada također može izbjeći odgovornost ako dokaže da bi ograničenja zagađenja i dalje bila prekršena i da je postojao dostatan plan kvalitete zraka, rekla je Kokott.

Mišljenja savjetnice suda su neobvezujuća, no sud EU-a se uglavnom slaže s njima u presudama koje uslijede.

Mišljenje je konkretno povezano sa slučajem stanovnika Pariza koji je tražio 21 milijun eura naknade od francuske vlade, na temelju toga da mu je zagađenje zraka oštetilo zdravlje te da se vlada nije pobrinula da onečišćenje bude u skladu s europskim ograničenjima.

Sud u Versaillesu koji je rješavao spor zatražio je od suda EU-a da razjasni mogu li pojedinci tražiti takvu naknadu.

Pariz je prekršio zakonska ograničenja dušikova dioksida između 2010. i 2019., prema ranijim presudama suda EU-a. To je isto učinjeno 2020., presudilo je Francusko državno vijeće.

U nastojanju da smanji preuranjene smrti povezane sa zagađenim zrakom, EU će predložiti unaprjeđenje svojih ograničenja pnečišćenja kako bi se bolje uskladila sa strogim pravilima Svjetske zdravstvene organizacije.

Građani Europske unije mogu tužiti svoje države zbog nečistog zraka koji im je uništio zdravlje. Slijede li tužbe i zbog odlagališta otpada?

Građani zemalja Europske unije mogli bi tužiti svoje vlade za financijsku naknadu ako im nedopuštene razine onečišćenja zraka naruše zdravlje, rekla je u četvrtak savjetnica najvišeg suda u Europi.

Mišljenje savjetnice slijedi nakon serije presuda na luksemburškom Sudu Europske unije proteklih godina, kojima je desetak članica EU-a, uključujući Francusku, Poljsku, Italiju i Rumunjsku, proglašeno krivima za nedopušteno zagađenje zraka.

"Odvjetnica Juliane Kokott smatra da bi kršenje ograničenja zaštite kvalitete zraka prema zakonima EU-a moglo povećati pravo na naknadu od države", priopćio je sud, donosi Hina

Kokott je dodala da je češći slučaj da pravnu zaštitu trebaju siromašnije zajednice koje žive i rade u visoko zagađenim područjima.

Rekla je, međutim, da bilo koji pojedinac koji zatraži naknadu mora dokazati da je šteta za njihovo zdravlje izravno uzrokovana zagađenjem zraka. Vlada također može izbjeći odgovornost ako dokaže da bi ograničenja zagađenja i dalje bila prekršena i da je postojao dostatan plan kvalitete zraka, rekla je Kokott.

Mišljenja savjetnice suda su neobvezujuća, no sud EU-a se uglavnom slaže s njima u presudama koje uslijede.

Mišljenje je konkretno povezano sa slučajem stanovnika Pariza koji je tražio 21 milijun eura naknade od francuske vlade, na temelju toga da mu je zagađenje zraka oštetilo zdravlje te da se vlada nije pobrinula da onečišćenje bude u skladu s europskim ograničenjima.

Sud u Versaillesu koji je rješavao spor zatražio je od suda EU-a da razjasni mogu li pojedinci tražiti takvu naknadu.
