Izvanraspravno vijeće Županijskog suda u Zagrebu odbilo je u utorak žalbe svih okrivljenika na određivanje istražnog zatvora u aferi Softver, doznaje Hina iz izvora bliksih istrazi.

Odlukom suda u pritvoru ostaju bivša ministrica europskih fondova i regionalnog razvoja Gabrijela Žalac, bivši ravnatelj Središnje agencije za financiranje i ugovaranje programa i projekata EU (SAFU) Tomislav Petric i vlasnici IT tvrtki Mladen Šimunac te Marko Jukić. 

Protiv njih je Ured europskog tužitelja (EPPO) pokrenuo istragu zbog sumnje da su nezakonitostima s novcem iz EU fondova oštetili EU i RH za 1,8 milijuna eura.

Bivšoj ministrici, nekadašnjem ravnatelju SAFU-a te dvojici poduzetnika odbijena je žalba na prvo određivanje istražnog zatvora od kojega će proteći mjesec dana u petak 10. prosinca, kada će izvanraspravno vijeće ponovno odlučivati o zahtjevu tužiteljstva da se okrivljenicima produlji pritvor za dodatnih dva mjeseca.

Uz to, izvanraspravno vijeće ukinulo je za Petrica prvostupanjsku odluku po kojoj je pritvoren zbog opasnosti od ponavljanja kazenenog djela budući da je u međuvremenu razriješen dužnosti u SAFU-u, doznaje Hina iz izvora bliskih istrazi.    

Policijski nacionalni ured za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK) je podnio kaznenu prijavu EPPO-u protiv Žalac, Petrica, Šimunca i Jukića zbog sumnje da su sklopili štetan pravni posao kojim je isplaćen višestruko veći iznos od tržišne vrijednosti isporučenog proizvoda u iznosu od 13,4 milijuna kuna na štetu financijskih interesa Europske unije i Republike Hrvatske.

Žalac se sumnjiči za zlouporabu položaja i ovlasti i trgovanje utjecajem, Petric za zlouporabu položaja i ovlasti, Šimunac za poticanje na zlouporabu položaja i ovlasti, a Jukić za pomaganje u zlouporabi položaja i ovlasti.

EPPO je precizirao kako sumnjiči Žalac da je kao ministrica te predsjednica upravnog vijeća SAFU sudjelovala u namještanju posla nabave informatičkog sustava za strateško planiranje i upravljanje razvojem za Šimunčeve i Jukićeve tvrtke za vrijeme dok je bila odgovorna za zakonito provođenje postupaka javne nabave u ministarstvu te za predlaganje imenovanja i razrješenja ravnatelja SAFU-a.

Žalac je, smatra tužiteljstvo, kao članica upravnog vijeća SAFU-a zatražila od Petrica da kao ravnatelj agencije nadležne za prethodnu kontrolu postupaka javne nabave financirane iz sredstava EU osigura da SAFU ne osporava pregovarački postupak javne nabave softvera koji su Šimunac i Jukić te njihove tvrtke imali na raspolaganj, a na što je Petric pristao.

Šimunac je potom, znajući da su natječajni uvjeti prilagođeni njegovom softveru, dogovorio s Jukićem da ispred svojih tvrtki podnese ponudu u precijenjenom iznosu od 12,9 milijuna kuna bez PDV-a za isti softver kojeg su ponudili i na ranijem natječaju iz 2017. godine.

Na natječaj su se javile jedino dvije Jukićeve tvrtke, dok je ponuda nakon pregleda ocjenjena važećom, pri čemu je nerealno ugovorena cijena u iznosu od 16,2 milijuna kuna, a koja je i plaćena.

Time je, dodala je policija, sklopljen štetan ugovor kojim je isplataćen višestruko veći iznos od tržišne vrijednosti isporučenog proizvoda u iznosu od 13,4 milijuna kuna na štetu financijskih interesa EU i RH.

Postupak protiv Žalac i ostalih najprije je vodio Uskok koji je zatvorio slučaj, a kasnije ga je preuzeo Ured europskog tužitelja koji je pokrenuo istragu.

Izvanraspravno vijeće Županijskog suda u Zagrebu odbilo je u utorak žalbe svih okrivljenika na određivanje istražnog zatvora u aferi Softver, doznaje Hina iz izvora bliksih istrazi.

Odlukom suda u pritvoru ostaju bivša ministrica europskih fondova i regionalnog razvoja Gabrijela Žalac, bivši ravnatelj Središnje agencije za financiranje i ugovaranje programa i projekata EU (SAFU) Tomislav Petric i vlasnici IT tvrtki Mladen Šimunac te Marko Jukić. 

Protiv njih je Ured europskog tužitelja (EPPO) pokrenuo istragu zbog sumnje da su nezakonitostima s novcem iz EU fondova oštetili EU i RH za 1,8 milijuna eura.

Bivšoj ministrici, nekadašnjem ravnatelju SAFU-a te dvojici poduzetnika odbijena je žalba na prvo određivanje istražnog zatvora od kojega će proteći mjesec dana u petak 10. prosinca, kada će izvanraspravno vijeće ponovno odlučivati o zahtjevu tužiteljstva da se okrivljenicima produlji pritvor za dodatnih dva mjeseca.

Uz to, izvanraspravno vijeće ukinulo je za Petrica prvostupanjsku odluku po kojoj je pritvoren zbog opasnosti od ponavljanja kazenenog djela budući da je u međuvremenu razriješen dužnosti u SAFU-u, doznaje Hina iz izvora bliskih istrazi.    

Policijski nacionalni ured za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK) je podnio kaznenu prijavu EPPO-u protiv Žalac, Petrica, Šimunca i Jukića zbog sumnje da su sklopili štetan pravni posao kojim je isplaćen višestruko veći iznos od tržišne vrijednosti isporučenog proizvoda u iznosu od 13,4 milijuna kuna na štetu financijskih interesa Europske unije i Republike Hrvatske.

Žalac se sumnjiči za zlouporabu položaja i ovlasti i trgovanje utjecajem, Petric za zlouporabu položaja i ovlasti, Šimunac za poticanje na zlouporabu položaja i ovlasti, a Jukić za pomaganje u zlouporabi položaja i ovlasti.

EPPO je precizirao kako sumnjiči Žalac da je kao ministrica te predsjednica upravnog vijeća SAFU sudjelovala u namještanju posla nabave informatičkog sustava za strateško planiranje i upravljanje razvojem za Šimunčeve i Jukićeve tvrtke za vrijeme dok je bila odgovorna za zakonito provođenje postupaka javne nabave u ministarstvu te za predlaganje imenovanja i razrješenja ravnatelja SAFU-a.

Žalac je, smatra tužiteljstvo, kao članica upravnog vijeća SAFU-a zatražila od Petrica da kao ravnatelj agencije nadležne za prethodnu kontrolu postupaka javne nabave financirane iz sredstava EU osigura da SAFU ne osporava pregovarački postupak javne nabave softvera koji su Šimunac i Jukić te njihove tvrtke imali na raspolaganj, a na što je Petric pristao.

Šimunac je potom, znajući da su natječajni uvjeti prilagođeni njegovom softveru, dogovorio s Jukićem da ispred svojih tvrtki podnese ponudu u precijenjenom iznosu od 12,9 milijuna kuna bez PDV-a za isti softver kojeg su ponudili i na ranijem natječaju iz 2017. godine.

Na natječaj su se javile jedino dvije Jukićeve tvrtke, dok je ponuda nakon pregleda ocjenjena važećom, pri čemu je nerealno ugovorena cijena u iznosu od 16,2 milijuna kuna, a koja je i plaćena.

Time je, dodala je policija, sklopljen štetan ugovor kojim je isplataćen višestruko veći iznos od tržišne vrijednosti isporučenog proizvoda u iznosu od 13,4 milijuna kuna na štetu financijskih interesa EU i RH.

Postupak protiv Žalac i ostalih najprije je vodio Uskok koji je zatvorio slučaj, a kasnije ga je preuzeo Ured europskog tužitelja koji je pokrenuo istragu.

Gabrijeli Žalac i svim ostalim okrivljenicima u aferi Softver je odbijena žalba, ostaju i dalje iza rešetaka istražnog zatvora

Izvanraspravno vijeće Županijskog suda u Zagrebu odbilo je u utorak žalbe svih okrivljenika na određivanje istražnog zatvora u aferi Softver, doznaje Hina iz izvora bliksih istrazi.

Odlukom suda u pritvoru ostaju bivša ministrica europskih fondova i regionalnog razvoja Gabrijela Žalac, bivši ravnatelj Središnje agencije za financiranje i ugovaranje programa i projekata EU (SAFU) Tomislav Petric i vlasnici IT tvrtki Mladen Šimunac te Marko Jukić. 

Protiv njih je Ured europskog tužitelja (EPPO) pokrenuo istragu zbog sumnje da su nezakonitostima s novcem iz EU fondova oštetili EU i RH za 1,8 milijuna eura.

Bivšoj ministrici, nekadašnjem ravnatelju SAFU-a te dvojici poduzetnika odbijena je žalba na prvo određivanje istražnog zatvora od kojega će proteći mjesec dana u petak 10. prosinca, kada će izvanraspravno vijeće ponovno odlučivati o zahtjevu tužiteljstva da se okrivljenicima produlji pritvor za dodatnih dva mjeseca.

Uz to, izvanraspravno vijeće ukinulo je za Petrica prvostupanjsku odluku po kojoj je pritvoren zbog opasnosti od ponavljanja kazenenog djela budući da je u međuvremenu razriješen dužnosti u SAFU-u, doznaje Hina iz izvora bliskih istrazi.    

Policijski nacionalni ured za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK) je podnio kaznenu prijavu EPPO-u protiv Žalac, Petrica, Šimunca i Jukića zbog sumnje da su sklopili štetan pravni posao kojim je isplaćen višestruko veći iznos od tržišne vrijednosti isporučenog proizvoda u iznosu od 13,4 milijuna kuna na štetu financijskih interesa Europske unije i Republike Hrvatske.

Žalac se sumnjiči za zlouporabu položaja i ovlasti i trgovanje utjecajem, Petric za zlouporabu položaja i ovlasti, Šimunac za poticanje na zlouporabu položaja i ovlasti, a Jukić za pomaganje u zlouporabi položaja i ovlasti.
