Županijski sud u Rijeci presudom Gž-1776/2019 pravomoćno je potvrdio 28. listopada 2020. presudu Općinskog suda u Rijeci i utvrdio da Raiffeisenbank Austria mora vratiti preplaćene kamate i platiti pripadajuće zatezne kamate iz nepoštenoga kunskog kredita, izvijestili su iz udruge Franak.

Presudu riječke sutkinje Kristine Aničić Vukelić potvrdilo je Vijeće ŽS Rijeka u sastavu Filka Pejković, predsjednica Vijeća, Svjetlana Pražić izvjestiteljica te Dubravka Srećec Fletko, članica Vijeća.

Zastupnik tužitelja Gorana Petešića bio je riječki odvjetnik Marko Vučinić.

Kako je navedeno u priopćenju udruge Franak, RBA mora zajedno sa zateznim kamatama uplatiti tužitelju oko 32.000 kuna, osim toga još i 9.000 kuna sudskih i odvjetničkih troškova u kreditu realiziranom u iznosu od 141.000 kuna.

Prema obrazloženju, općinski i županijski sud utvrdili su sljedeće:

1. Tuženik nije dokazao da se pregovaralo o ugovornoj kamatnoj stopi.

2. Odredba u dijelu kojim je ugovorena promjena redovne kamatne stope u skladu s odlukom tužene banke predstavlja odredbu koja nije lako razumljiva i koja suprotno načelu savjesnosti i poštenja uzrokuje značajnu neravnotežu u pravima i obvezama ugovornih strana, sve na štetu tužitelja kao potrošača posljedično čemu se takva ugovorna odredba smatra nepoštenom.

3. Tom ugovornom odredbom nisu definirani niti ugovoreni bilo kakvi parametri te uvjeti koji prate promjenu prvotno ugovorene promjenjive kamatne stope, već se takvom odredbom ugovora tuženoj banci kao drugoj, i to jačoj ugovornoj strani, ostavlja mogućnost da ugovornu promjenjivu kamatnu stopu određuje svojim jednostranim odlukama.

4. Da bi sporna odredba Ugovora o kreditu bila lako razumljiva ona je trebala sadržavati jasno naznačene i objašnjene razloge te kriterije za promjenu ugovorene kamatne stope, tako da je tužitelj kao potrošač na temelju tih jasnih i razumljivih kriterija u vrijeme sklapanja ugovora mogao jasno predvidjeti ekonomske posljedice koje iz toga za njega proizlaze.

5. Ugovorna odredba u dijelu kojim je ugovorena promjena redovne kamatne stope u skladu s odlukom tužene banke stvara neravnotežu u odnosima između stranaka te neravnopravnost sudionika u obvezno pravnom odnosu na štetu potrošača tužitelja.

6. Kako je u smislu Zakona o zaštiti potrošača odredba kojom je ugovorena mogućnost promjene redovne kamatne stope u skladu s odlukom banke nepoštena odnosno ništava, to je tužbeni zahtjev tužitelja u dijelu u kojem zahtijeva utvrđenje ništavosti tog dijela predmetne ugovorne odredbe valjalo prihvatiti.

7. Zastare potraživanja preplaćenih kamata nema, što je u skladu s pravnim shvaćanjem Vrhovnoga suda RH Su-IV-47/2020-2 od 30. siječnja 2020., kojim je utvrđeno da zastara potraživanja počinje teći danom pravomoćnosti presude kojom se utvrđuje ništetnost.

Županijski sud u Rijeci presudom Gž-1776/2019 pravomoćno je potvrdio 28. listopada 2020. presudu Općinskog suda u Rijeci i utvrdio da Raiffeisenbank Austria mora vratiti preplaćene kamate i platiti pripadajuće zatezne kamate iz nepoštenoga kunskog kredita, izvijestili su iz udruge Franak.

Presudu riječke sutkinje Kristine Aničić Vukelić potvrdilo je Vijeće ŽS Rijeka u sastavu Filka Pejković, predsjednica Vijeća, Svjetlana Pražić izvjestiteljica te Dubravka Srećec Fletko, članica Vijeća.

Zastupnik tužitelja Gorana Petešića bio je riječki odvjetnik Marko Vučinić.

Kako je navedeno u priopćenju udruge Franak, RBA mora zajedno sa zateznim kamatama uplatiti tužitelju oko 32.000 kuna, osim toga još i 9.000 kuna sudskih i odvjetničkih troškova u kreditu realiziranom u iznosu od 141.000 kuna.

Prema obrazloženju, općinski i županijski sud utvrdili su sljedeće:

1. Tuženik nije dokazao da se pregovaralo o ugovornoj kamatnoj stopi.

2. Odredba u dijelu kojim je ugovorena promjena redovne kamatne stope u skladu s odlukom tužene banke predstavlja odredbu koja nije lako razumljiva i koja suprotno načelu savjesnosti i poštenja uzrokuje značajnu neravnotežu u pravima i obvezama ugovornih strana, sve na štetu tužitelja kao potrošača posljedično čemu se takva ugovorna odredba smatra nepoštenom.

3. Tom ugovornom odredbom nisu definirani niti ugovoreni bilo kakvi parametri te uvjeti koji prate promjenu prvotno ugovorene promjenjive kamatne stope, već se takvom odredbom ugovora tuženoj banci kao drugoj, i to jačoj ugovornoj strani, ostavlja mogućnost da ugovornu promjenjivu kamatnu stopu određuje svojim jednostranim odlukama.

4. Da bi sporna odredba Ugovora o kreditu bila lako razumljiva ona je trebala sadržavati jasno naznačene i objašnjene razloge te kriterije za promjenu ugovorene kamatne stope, tako da je tužitelj kao potrošač na temelju tih jasnih i razumljivih kriterija u vrijeme sklapanja ugovora mogao jasno predvidjeti ekonomske posljedice koje iz toga za njega proizlaze.

5. Ugovorna odredba u dijelu kojim je ugovorena promjena redovne kamatne stope u skladu s odlukom tužene banke stvara neravnotežu u odnosima između stranaka te neravnopravnost sudionika u obvezno pravnom odnosu na štetu potrošača tužitelja.

6. Kako je u smislu Zakona o zaštiti potrošača odredba kojom je ugovorena mogućnost promjene redovne kamatne stope u skladu s odlukom banke nepoštena odnosno ništava, to je tužbeni zahtjev tužitelja u dijelu u kojem zahtijeva utvrđenje ništavosti tog dijela predmetne ugovorne odredbe valjalo prihvatiti.

7. Zastare potraživanja preplaćenih kamata nema, što je u skladu s pravnim shvaćanjem Vrhovnoga suda RH Su-IV-47/2020-2 od 30. siječnja 2020., kojim je utvrđeno da zastara potraživanja počinje teći danom pravomoćnosti presude kojom se utvrđuje ništetnost.

Pravomoćna presuda u Rijeci: RBA mora vratiti preplaćene kamate i platiti zatezne kamate iz kunskog kredita

Županijski sud u Rijeci presudom Gž-1776/2019 pravomoćno je potvrdio 28. listopada 2020. presudu Općinskog suda u Rijeci i utvrdio da Raiffeisenbank Austria mora vratiti preplaćene kamate i platiti pripadajuće zatezne kamate iz nepoštenoga kunskog kredita, izvijestili su iz udruge Franak.

Presudu riječke sutkinje Kristine Aničić Vukelić potvrdilo je Vijeće ŽS Rijeka u sastavu Filka Pejković, predsjednica Vijeća, Svjetlana Pražić izvjestiteljica te Dubravka Srećec Fletko, članica Vijeća.

Zastupnik tužitelja Gorana Petešića bio je riječki odvjetnik Marko Vučinić.

Kako je navedeno u priopćenju udruge Franak, RBA mora zajedno sa zateznim kamatama uplatiti tužitelju oko 32.000 kuna, osim toga još i 9.000 kuna sudskih i odvjetničkih troškova u kreditu realiziranom u izn...
