Na djelomično uvjetnu kaznu zatvora od dvije godine nepravomoćno je u srijedu na Županijskom sudu u Zadru osuđen 49-godišnji otac V.B. koji je prošle godine u Rašteviću 26-godišnjem sinu zadao dva uboda nožem u leđa, nakon čega se i sam pokušao ubiti ubodom srce. Presudom sutkinje Dijane Grancarić, 49-godišnjak će odslužiti zatvorsku kaznu od šest mjeseci, a ostali dio samo ukoliko u roku tri godine kušnje počini novo kazneno djelo.

Sutkinja mu je odredila kaznu ispod zakonskog minimuma od pet godina za kazneno djelo pokušaja ubojstva jer je u postupku utvrđeno da postoje posebno izražene olakotne okolnosti koje opravdavaju primjenu instituta ublažavanja kazne.

- Svrha kazneno pravne sankcije ostvarit će se u cijelosti i bez izvršenja - rekla je sutkinja Grancarić u dijelu obrazloženja presude kojom nisu utvrđene otegotne okolnosti za strožu kaznu. U odmjeravanju kazne sud je, naime, cijenio sve utvrđene olakotne okolnosti njegovo duboko kajanje, priznanje kaznenog djela, kao i činjenicu da je to što je učinio oca duboko potreslo zbog čega je pokušao izvršiti samoubojstvo. Olakotna okolnost mu je bilo i držanje pred sudom, smanjena ubrojivost, sudioništvo u Domovinskom ratu, te činjenica što je otac još dvoje malodobne djece, te što prije nije bio osuđivan.

Do krvavog obračuna došlo je 21. svibnja 2019., u dvorištu susjedne kuće oca i sina u Rašteviću. Nakon kraće prepirke, otac je sinu dok je ulazio u automobil zadao dva uboda nožem u leđa i jedan u nadlakticu. U daljnjem napadu spriječio ga je susjed Ivan Klarica, a otac se nakon toga i sam pokušao ubiti. Pronađen je s nožem u prsima, ali su mu ozlijede bile lakše. Sinu je nože uspio probiti prsište, te je on samo zbog pravovremeno ukazane medicinske pomoći preživio. Navodno mu je, prema pričama mještana, zamjerao način vođenja života, a posebno sklonost opijatima.

U sudskom postupku je utvrđeno da je postupao s namjerom, ali je u trenutku počinjenja kaznenog djela bio smanjeno ubrojiv jer je bio pod utjecajem najmanje 1.53 promila alkohola. Sutkinja mu je nakon izricanja presude zbog toga odredila I obavezno liječenje od alkohola, a oslobođen je plaćanja troškova sudskog postupka jer bi zbog niskih primanja doveo u pitanje svoje uzdržavanje obitelji.

Dok je tužiteljstvo tražilo strožu kaznu smatrajući da je otac ozbljno ugrozio život sina jer mu je nožem probio prsište, njegov odvjetnik Ivica Letinić rekao je kako ga je napao u afektivnom stanju kojem su prethodile specifične obiteljske okolnosti. Naglasio je kako je otac bio izvrgnut verbalnom, a ponekad i fizičkom šikaniranju sina. Otac i sin su se u međuvremenu pomirili. Sin je odselio u Nizozemsku, a prethodno je izjavio kako je ocu oprostio tega ne želi ni za što teretiti.

Na djelomično uvjetnu kaznu zatvora od dvije godine nepravomoćno je u srijedu na Županijskom sudu u Zadru osuđen 49-godišnji otac V.B. koji je prošle godine u Rašteviću 26-godišnjem sinu zadao dva uboda nožem u leđa, nakon čega se i sam pokušao ubiti ubodom srce. Presudom sutkinje Dijane Grancarić, 49-godišnjak će odslužiti zatvorsku kaznu od šest mjeseci, a ostali dio samo ukoliko u roku tri godine kušnje počini novo kazneno djelo.

Sutkinja mu je odredila kaznu ispod zakonskog minimuma od pet godina za kazneno djelo pokušaja ubojstva jer je u postupku utvrđeno da postoje posebno izražene olakotne okolnosti koje opravdavaju primjenu instituta ublažavanja kazne.

- Svrha kazneno pravne sankcije ostvarit će se u cijelosti i bez izvršenja - rekla je sutkinja Grancarić u dijelu obrazloženja presude kojom nisu utvrđene otegotne okolnosti za strožu kaznu. U odmjeravanju kazne sud je, naime, cijenio sve utvrđene olakotne okolnosti njegovo duboko kajanje, priznanje kaznenog djela, kao i činjenicu da je to što je učinio oca duboko potreslo zbog čega je pokušao izvršiti samoubojstvo. Olakotna okolnost mu je bilo i držanje pred sudom, smanjena ubrojivost, sudioništvo u Domovinskom ratu, te činjenica što je otac još dvoje malodobne djece, te što prije nije bio osuđivan.

Do krvavog obračuna došlo je 21. svibnja 2019., u dvorištu susjedne kuće oca i sina u Rašteviću. Nakon kraće prepirke, otac je sinu dok je ulazio u automobil zadao dva uboda nožem u leđa i jedan u nadlakticu. U daljnjem napadu spriječio ga je susjed Ivan Klarica, a otac se nakon toga i sam pokušao ubiti. Pronađen je s nožem u prsima, ali su mu ozlijede bile lakše. Sinu je nože uspio probiti prsište, te je on samo zbog pravovremeno ukazane medicinske pomoći preživio. Navodno mu je, prema pričama mještana, zamjerao način vođenja života, a posebno sklonost opijatima.

U sudskom postupku je utvrđeno da je postupao s namjerom, ali je u trenutku počinjenja kaznenog djela bio smanjeno ubrojiv jer je bio pod utjecajem najmanje 1.53 promila alkohola. Sutkinja mu je nakon izricanja presude zbog toga odredila I obavezno liječenje od alkohola, a oslobođen je plaćanja troškova sudskog postupka jer bi zbog niskih primanja doveo u pitanje svoje uzdržavanje obitelji.

Dok je tužiteljstvo tražilo strožu kaznu smatrajući da je otac ozbljno ugrozio život sina jer mu je nožem probio prsište, njegov odvjetnik Ivica Letinić rekao je kako ga je napao u afektivnom stanju kojem su prethodile specifične obiteljske okolnosti. Naglasio je kako je otac bio izvrgnut verbalnom, a ponekad i fizičkom šikaniranju sina. Otac i sin su se u međuvremenu pomirili. Sin je odselio u Nizozemsku, a prethodno je izjavio kako je ocu oprostio tega ne želi ni za što teretiti.

Za zločin u Rašteviću gdje je sinu zadao dva uboda nožem u leđa, nakon čega se i sam pokušao ubiti - šest mjeseci zatvora!

Na djelomično uvjetnu kaznu zatvora od dvije godine nepravomoćno je u srijedu na Županijskom sudu u Zadru osuđen 49-godišnji otac V.B. koji je prošle godine u Rašteviću 26-godišnjem sinu zadao dva uboda nožem u leđa, nakon čega se i sam pokušao ubiti ubodom srce. Presudom sutkinje Dijane Grancarić, 49-godišnjak će odslužiti zatvorsku kaznu od šest mjeseci, a ostali dio samo ukoliko u roku tri godine kušnje počini novo kazneno djelo.

Sutkinja mu je odredila kaznu ispod zakonskog minimuma od pet godina za kazneno djelo pokušaja ubojstva jer je u postupku utvrđeno da postoje posebno izražene olakotne okolnosti koje opravdavaju primjenu instituta ublažavanja kazne.

- Svrha kazneno pravne sankcije ostvarit će se u cijelosti i bez izvršenja - rekla je sutkinja Grancarić u dijelu obrazloženja presude kojom nisu utvrđene otegotne okolnosti za strožu kaznu. U odmjeravanju kazne sud je, naime, cijenio sve utvrđene olakotne okolnosti njegovo duboko kajanje, priznanje kaznenog djela, kao i činjenicu da je to što je učinio oca duboko potreslo zbog čega je pokušao izvršiti samoubojstvo. Olakotna okolnost mu je bilo i držanje pred sudom, smanjena ubrojivost, sudioništvo u Domovinskom ratu, te činjenica što je otac još dvoje malodobne djece, te što prije nije bio osuđivan.

Do krvavog obračuna došlo je 21. svibnja 2019., u dvorištu susjedne kuće oca i sina u Rašteviću. Nakon kraće prepirke, otac je sinu dok je ulazio u automobil zadao dva uboda nožem u leđa i jedan u nadlakticu. U daljnjem napadu spriječio ga je susjed Ivan Klarica, a otac se nakon toga i sam pokušao ubiti. Pronađen je s nožem u prsima, ali su mu ozlijede bile lakše. Sinu je nože uspio probiti prsište, te je on samo zbog pravovremeno ukazane medicinske pomoći preživio. Navodno mu je, prema pričama mještana, zamjerao način vođenja života, a posebno sklonost opijatima.

U sudskom postupku je utvrđeno da je postupao s namjerom, ali je u trenutku počinjenja kaznenog djela bio smanjeno ubrojiv jer je bio pod utjecajem najmanje 1.53 promila alkohola. Sutkinja mu je nakon izricanja presude zbog toga odredila I obavezno liječenje od alkohola, a oslobođen je plaćanja troškova sudskog postupka jer bi zbog niskih primanja doveo u pitanje svoje uzdržavanje obitelji.

Dok je tužiteljstvo tražilo strožu kaznu smatrajući da je otac ozbljno ugrozio život sina jer mu je nožem probio prsište, njegov odvjetnik Ivica Letinić rekao je kako ga je napao u afektivnom stanju kojem su prethodile specifične obiteljske okolnosti. Naglasio je kako je otac bio izvrgnut verbalnom, a ponekad i fizičkom šikaniranju sina. Otac i sin su se u međuvremenu pomirili. Sin je odselio u Nizozemsku, a prethodno je izjavio kako je ocu oprostio tega ne želi ni za što teretiti.
