U ponovljenom suđenju na splitskom sudu Stjepan Ringwald, Jerko Pirić i Vlado Zolota dobili su identične kazne kao i prvoga puta. Zbog ubojstva Karmelina Fistonića Ringwald je dobio 19, Pirić 18, a Zolota 17 godina. 

Okrivljeni su nezadovoljni presudom i negodovanje je počelo još dok je sudac Ivanišević čitao obrazloženje iste. Svoje nezadovoljstvo prvo je otkrio Pirić koji jedini sjedio.

- To je sramota!, povikao je prije no što su ga pravosudni policajci izveli iz dvorane. Nakon njega isto su zatražili i Zolota i Ringwald pa tako nitko od trojice okrivljenih nije do kraja saslušao obrazloženje suca. 

U publici se nalazi i jedna od članica Pirićeve obitelji koja je na ponovljenu presudu glasno negodovala. 

- Ovo je sve namišteno, vikala je ženska osoba koja, po uzoru na okrivljene izvedena iz dvorane suda. 

Podsjetimo, trojac je okrivljen za ubojstvo Karmelina Fistanića na predjelu Brzet kod Omiša u studenom 2019. godine oko 14 sati. U preminulog je iz pištolja ispaljeno šest metaka. 

Prema optužnici ŽDO-a pucao je Ringwald od kojeg je Jerko Pirić naručio ubojstvo dok je Vlado Zolota toga dana pratio i dojavljivao ubojici kretanje žrtve. Šibenčanin Ringwald je, s prethodno ukradenim motociklom, pratio Fistonića koji je oko 14 sati na Brzetu zaustavio svoj automobil kako bi on i djevojka pojeli hranu kupljenu u obližnjem fast foodu. U tom trenutku kroz dijelom otvoreni prozor Ringwald u Fistonića ispaljuje šest metaka. Na prvom suđenju Ringwald je dobio 19, Pirić 18, a Zolota 17 godina robije, a te su kazne sada i ponovljene. 

Izjave za medije nakon čitanje presude dali su i odvjetnici okrivljenih. 

- Ja bih samo kazala da je moja stranka i dalje nevina, neovisno o izrečenoj kazni i to zbog presumpcije nevinosti. Ponovno se potvrdilo da ovaj sud svoju kvalitetu rada dokazuje kroz izricanje gotovo maksimalnih kazni. Obrani nije omogućeno izvođenje niti jednog dokaza. Današnje obrazloženje suda je sramotno jer se ne mogu davati samo one okolnosti koje ide u prilog ovakvoj presudi. Nije navedeno ni da je uništen taj "famozni" krvni trag što znači da se uopće ne može provjeriti. Isto tako, ne može se zanemariti da su osobe A, B i C jedino mogle biti utvrđene biometrijom, a ne audiovizualnim vještakom. Ovdje je presudnu ulogu imao informatičar, a njegovih prihvaćanjem bi se u pitanje dovela opstojnost ovoga djela, kazala je Doris Košta, odvjetnica Jerka Pirića. 

- Idemo dalje, nismo iznenađeni. Mislim da tako misle i kolege. U konačnici ćemo pokazati koliko je besmislena ovakva presuda, dodala je. 

Osvrnula se i na burnu reakciju svojeg klijenta koja je bila dramatičnija od one njegovih suokrivljenika. 

- On je bio revoltiran ovakvim obrazloženjem i statusom kojeg smo imali tijekom postupka. Moram kazati da sam i ja razmišljala da napravim nešto. Ne znam na koji način obrana u ovakvom hrvatskom pravosuđu može biti od koristi branjenicima. Klasični fikus, zaključila je odvjetnica. 

Odvjetnik Boris Majić, koji u ovom procesu brani prvookrivljenog Stjepana Ringwalda, također je komentirao novu presudu. 

- Sami ste čuli i vidjeli da je presuda na tragu prošle koja je nesporno bila ukinuta nakon žalbi branitelja. Nadamo da se da će biti i ova. Sve što imam kazati o presudi i načinu vođenja postupka izjavit ću u svojoj žalbi koja će uslijediti, kazao je Majić.

U ponovljenom suđenju na splitskom sudu Stjepan Ringwald, Jerko Pirić i Vlado Zolota dobili su identične kazne kao i prvoga puta. Zbog ubojstva Karmelina Fistonića Ringwald je dobio 19, Pirić 18, a Zolota 17 godina. 

Okrivljeni su nezadovoljni presudom i negodovanje je počelo još dok je sudac Ivanišević čitao obrazloženje iste. Svoje nezadovoljstvo prvo je otkrio Pirić koji jedini sjedio.

- To je sramota!, povikao je prije no što su ga pravosudni policajci izveli iz dvorane. Nakon njega isto su zatražili i Zolota i Ringwald pa tako nitko od trojice okrivljenih nije do kraja saslušao obrazloženje suca. 

U publici se nalazi i jedna od članica Pirićeve obitelji koja je na ponovljenu presudu glasno negodovala. 

- Ovo je sve namišteno, vikala je ženska osoba koja, po uzoru na okrivljene izvedena iz dvorane suda. 

Podsjetimo, trojac je okrivljen za ubojstvo Karmelina Fistanića na predjelu Brzet kod Omiša u studenom 2019. godine oko 14 sati. U preminulog je iz pištolja ispaljeno šest metaka. 

Prema optužnici ŽDO-a pucao je Ringwald od kojeg je Jerko Pirić naručio ubojstvo dok je Vlado Zolota toga dana pratio i dojavljivao ubojici kretanje žrtve. Šibenčanin Ringwald je, s prethodno ukradenim motociklom, pratio Fistonića koji je oko 14 sati na Brzetu zaustavio svoj automobil kako bi on i djevojka pojeli hranu kupljenu u obližnjem fast foodu. U tom trenutku kroz dijelom otvoreni prozor Ringwald u Fistonića ispaljuje šest metaka. Na prvom suđenju Ringwald je dobio 19, Pirić 18, a Zolota 17 godina robije, a te su kazne sada i ponovljene. 

Izjave za medije nakon čitanje presude dali su i odvjetnici okrivljenih. 

- Ja bih samo kazala da je moja stranka i dalje nevina, neovisno o izrečenoj kazni i to zbog presumpcije nevinosti. Ponovno se potvrdilo da ovaj sud svoju kvalitetu rada dokazuje kroz izricanje gotovo maksimalnih kazni. Obrani nije omogućeno izvođenje niti jednog dokaza. Današnje obrazloženje suda je sramotno jer se ne mogu davati samo one okolnosti koje ide u prilog ovakvoj presudi. Nije navedeno ni da je uništen taj "famozni" krvni trag što znači da se uopće ne može provjeriti. Isto tako, ne može se zanemariti da su osobe A, B i C jedino mogle biti utvrđene biometrijom, a ne audiovizualnim vještakom. Ovdje je presudnu ulogu imao informatičar, a njegovih prihvaćanjem bi se u pitanje dovela opstojnost ovoga djela, kazala je Doris Košta, odvjetnica Jerka Pirića. 

- Idemo dalje, nismo iznenađeni. Mislim da tako misle i kolege. U konačnici ćemo pokazati koliko je besmislena ovakva presuda, dodala je. 

Osvrnula se i na burnu reakciju svojeg klijenta koja je bila dramatičnija od one njegovih suokrivljenika. 

- On je bio revoltiran ovakvim obrazloženjem i statusom kojeg smo imali tijekom postupka. Moram kazati da sam i ja razmišljala da napravim nešto. Ne znam na koji način obrana u ovakvom hrvatskom pravosuđu može biti od koristi branjenicima. Klasični fikus, zaključila je odvjetnica. 

Odvjetnik Boris Majić, koji u ovom procesu brani prvookrivljenog Stjepana Ringwalda, također je komentirao novu presudu. 

- Sami ste čuli i vidjeli da je presuda na tragu prošle koja je nesporno bila ukinuta nakon žalbi branitelja. Nadamo da se da će biti i ova. Sve što imam kazati o presudi i načinu vođenja postupka izjavit ću u svojoj žalbi koja će uslijediti, kazao je Majić.
