Bivši predsjednik Uprave farmaceutske tvrtke Farmal Dražen Dedi nepravomoćno je danas, nakon desetogodišnjega kaznenog postupka, osuđen na četiri godine zatvora te 120.000 kuna novčane kazne u slučaju poznatom kao afera Farmal ili Hipokrat.

U tom je predmetu već osuđeno oko 360 liječnika obiteljske medicine iz čitave Hrvatske. Od početna 364 okrivljenika ostalo ih je još troje, no i njima bi uskoro pred istim sudom trebala biti izrečena presuda.

Riječ je, barem po broju okrivljenika, o daleko najvećem predmetu ikad pokrenutom pred nekim hrvatskim sudom, a prvookrivljenom Dediju te bivšem čelništvu Farmala - Jasni Majhen, izvršnoj direktorici korporativnih poslova, i trojici direktora za regije - na teret se stavljalo da su od 2009. do 2012. preko mreže posrednika, a kako bi osigurali da liječnici obiteljske medicine propisuju što više njihovih lijekova, organizirali podmićivanje liječnika bonovima, novcem, raznim darovima i slično.

Plan je bio da liječnici dobivaju između 5 i 10 posto vrijednosti lijekova koje su propisali, a "farmalovci" su uredno vodili evidenciju koliko tih lijekova koji liječnik propisuje te ga sukladno tome i nagrađivali. Upravo te evidencije pronađene u njihovim službenim računalima, a koje je krajem 2012., kada je akcija počela, zaplijenio USKOK, postale su i glavni dokaz protiv "farmalovaca", ali i golemog broja liječnika koje je USKOK optužio za primanje mita.

Nakon provedene istrage USKOK je 2013. podignuo optužnicu protiv ukupno 364 osobe predvođene Dedijem, a najveći dio optuženika činili su liječnici obiteljske medicine.

Još u fazi potvrđivanja optužnice, odnosno odlučivanja pred tzv. optužnim vijećem, oko 90 posto okrivljenika, točnije njih 325, odlučilo se nagoditi s USKOK-om te su im na temelju nagodbi izrečene ili uvjetne zatvorske kazne ili pak kazne zamijenjene radom za opće dobro. No, osim toga svi su dobili i sporedne novčane kazne te se računa da je USKOK za državni proračun od tih kazni "uprihodio" oko milijun eura.

Preostalih 39 okrivljenika, predvođenih Dedijem, odlučili su se za suđenje, tvrdeći da nisu krivi. Nakon jedne promjene sudskog vijeća suđenje je počelo prije četiri godine, a s vremenom je i među preostalih 39 okrivljenika bilo sve više onih sklonih priznanju krivnje te su im sukcesivno izricane presude.

Danas je tako red došao i na Dedija koji, međutim, krivnju nije priznao. Naime, tvrdio je da se ono što su radili nikako ne može smatrati kaznenim djelom.

"Potpuno je neživotno i nelogično da se pod korist u smislu kaznenog zakona u odnosu liječnika i farmaceutske tvrtke ima smatrati svaki odnos koji podrazumijeva neki oblik razmjene, kao da postoje farmaceutske tvrtke koje plaćaju liječnicima kongrese i vrše druge oblike prijenosa vrijednosti prema zdravstvenim djelatnicima iz, ne znam ni sam kako to nazvati, humanih razloga ili bez razloga. Naprosto je neživotno i nelogično da neka farmaceutska tvrtka potroši na kongrese nekoliko milijuna kuna, a da pritom ne očekuje neki oblik razmjene", rekao je optuženi Dražen Dedi.

Dedi je također ustvrdio kako liječnici prema zakonu nisu ni službene niti odgovorne osobe da bi ih se moglo podmićivati. Međutim, sudsko vijeće odbacilo je ove navode obrane zaključivši kako se liječnici obiteljske medicine u kontekstu ovoga slučaja ipak mogu smatrati odgovornim osobama, prije svega zbog svoje ovlasti da prepisuju lijekove.

Bivši predsjednik Uprave farmaceutske tvrtke Farmal Dražen Dedi nepravomoćno je danas, nakon desetogodišnjega kaznenog postupka, osuđen na četiri godine zatvora te 120.000 kuna novčane kazne u slučaju poznatom kao afera Farmal ili Hipokrat.

U tom je predmetu već osuđeno oko 360 liječnika obiteljske medicine iz čitave Hrvatske. Od početna 364 okrivljenika ostalo ih je još troje, no i njima bi uskoro pred istim sudom trebala biti izrečena presuda.

Riječ je, barem po broju okrivljenika, o daleko najvećem predmetu ikad pokrenutom pred nekim hrvatskim sudom, a prvookrivljenom Dediju te bivšem čelništvu Farmala - Jasni Majhen, izvršnoj direktorici korporativnih poslova, i trojici direktora za regije - na teret se stavljalo da su od 2009. do 2012. preko mreže posrednika, a kako bi osigurali da liječnici obiteljske medicine propisuju što više njihovih lijekova, organizirali podmićivanje liječnika bonovima, novcem, raznim darovima i slično.

Plan je bio da liječnici dobivaju između 5 i 10 posto vrijednosti lijekova koje su propisali, a "farmalovci" su uredno vodili evidenciju koliko tih lijekova koji liječnik propisuje te ga sukladno tome i nagrađivali. Upravo te evidencije pronađene u njihovim službenim računalima, a koje je krajem 2012., kada je akcija počela, zaplijenio USKOK, postale su i glavni dokaz protiv "farmalovaca", ali i golemog broja liječnika koje je USKOK optužio za primanje mita.

Nakon provedene istrage USKOK je 2013. podignuo optužnicu protiv ukupno 364 osobe predvođene Dedijem, a najveći dio optuženika činili su liječnici obiteljske medicine.

Još u fazi potvrđivanja optužnice, odnosno odlučivanja pred tzv. optužnim vijećem, oko 90 posto okrivljenika, točnije njih 325, odlučilo se nagoditi s USKOK-om te su im na temelju nagodbi izrečene ili uvjetne zatvorske kazne ili pak kazne zamijenjene radom za opće dobro. No, osim toga svi su dobili i sporedne novčane kazne te se računa da je USKOK za državni proračun od tih kazni "uprihodio" oko milijun eura.

Preostalih 39 okrivljenika, predvođenih Dedijem, odlučili su se za suđenje, tvrdeći da nisu krivi. Nakon jedne promjene sudskog vijeća suđenje je počelo prije četiri godine, a s vremenom je i među preostalih 39 okrivljenika bilo sve više onih sklonih priznanju krivnje te su im sukcesivno izricane presude.

Danas je tako red došao i na Dedija koji, međutim, krivnju nije priznao. Naime, tvrdio je da se ono što su radili nikako ne može smatrati kaznenim djelom.

"Potpuno je neživotno i nelogično da se pod korist u smislu kaznenog zakona u odnosu liječnika i farmaceutske tvrtke ima smatrati svaki odnos koji podrazumijeva neki oblik razmjene, kao da postoje farmaceutske tvrtke koje plaćaju liječnicima kongrese i vrše druge oblike prijenosa vrijednosti prema zdravstvenim djelatnicima iz, ne znam ni sam kako to nazvati, humanih razloga ili bez razloga. Naprosto je neživotno i nelogično da neka farmaceutska tvrtka potroši na kongrese nekoliko milijuna kuna, a da pritom ne očekuje neki oblik razmjene", rekao je optuženi Dražen Dedi.

Dedi je također ustvrdio kako liječnici prema zakonu nisu ni službene niti odgovorne osobe da bi ih se moglo podmićivati. Međutim, sudsko vijeće odbacilo je ove navode obrane zaključivši kako se liječnici obiteljske medicine u kontekstu ovoga slučaja ipak mogu smatrati odgovornim osobama, prije svega zbog svoje ovlasti da prepisuju lijekove.

Pravosudni epilog najveće korupcijske afere našeg zdravstva: Ovaj čovjek osuđen je zbog davanja mita liječnicima

Bivši predsjednik Uprave farmaceutske tvrtke Farmal Dražen Dedi nepravomoćno je danas, nakon desetogodišnjega kaznenog postupka, osuđen na četiri godine zatvora te 120.000 kuna novčane kazne u slučaju poznatom kao afera Farmal ili Hipokrat.

U tom je predmetu već osuđeno oko 360 liječnika obiteljske medicine iz čitave Hrvatske. Od početna 364 okrivljenika ostalo ih je još troje, no i njima bi uskoro pred istim sudom trebala biti izrečena presuda.

Riječ je, barem po broju okrivljenika, o daleko najvećem predmetu ikad pokrenutom pred nekim hrvatskim sudom, a prvookrivljenom Dediju te bivšem čelništvu Farmala - Jasni Majhen, izvršnoj direktorici korporativnih poslova, i trojici direktora za regije - na teret se stavljalo da su od 2009. do 2012. preko mreže posrednika, a kako bi osigurali da liječnici obiteljske medicine propisuju što više njihovih lijekova, organizirali podmićivanje liječnika bonovima, novcem, raznim darovima i slično.

Plan je bio da liječnici dobivaju između 5 i 10 posto vrijednosti lijekova koje su propisali, a "farmalovci" su uredno vodili evidenciju koliko tih lijekova koji liječnik propisuje te ga sukladno tome i nagrađivali. Upravo te evidencije pronađene u njihovim službenim računalima, a koje je krajem 2012., kada je akcija počela, zaplijenio USKOK, postale su i glavni dokaz protiv "farmalovaca", ali i golemog broja liječnika koje je USKOK optužio za primanje mita.

Nakon provedene istrage USKOK je 2013. podignuo optužnicu protiv ukupno 364 osobe predvođene Dedijem, a najveći dio optuženika činili su liječnici obiteljske medicine.

Još u fazi potvrđivanja optužnice, odnosno odlučivanja pred tzv. optužnim vijećem, oko 90 posto okrivljenika, točnije njih 325, odlučilo se nagoditi s USKOK-om te su im na temelju nagodbi izrečene ili uvjetne zatvorske kazne ili pak kazne zamijenjene radom za opće dobro. No, osim toga svi su dobili i sporedne novčane kazne te se računa da je USKOK za državni proračun od tih kazni "uprihodio" oko milijun eura.

Preostalih 39 okrivljenika, predvođenih Dedijem, odlučili su se za suđenje, tvrdeći da nisu krivi.
