- Određujem novo vještačenje, i to kombinirano sudsko-medicinsko i radiološko. Vještačenje će se provesti na Medicinskom fakultetu u Zagrebu – „odrezala“ je Mitra Meštrović, sutkinja zadarskog Općinskog suda, u četvrtak na ponovljenom suđenju Jakovu Suraću (45), optuženom za premlaćivanje Hrvoja Bajla (34) u Zadru u lipnju 2018. godine.

Ovaj se slučaj prati s velikom pozornošću, ne samo zato što se radi o poznatom bivšem nogometašu i kapetanu NK Zadra Jakovu Suraću, te o poznatom novinaru Hrvoju Bajlu, vlasniku portala Zadar News, već i stoga što je cijelo suđenje prepuno obrata.

Svojevrstan obrat dogodio se i u četvrtak u sudnici, jer unatoč tome što je svjedočio zagrebački sudski medicinski vještak dr. Davor Mayer, sutkinja Meštrović je na kraju ročišta ipak, na prijedlog Suraćevog branitelja Ive Brkića, naložila novo, kombinirano vještačenje.

Vještak Mayer, naime, u svojem je vještačenju koristio isključivo medicinsku dokumentaciju iz sudskog spisa, što je na koncu uzrujalo Brkića.

- Sud je naložio vještačenje, a prema tom nalogu u vještačenju je trebalo koristiti medicinsku dokumentaciju, potom RTG snimke, te kao treće i ostalu dokumentaciju iz Opće bolnice Zadar. Da li ste vi postupili po takvom nalogu suda? – upitao je Brkić vještaka Mayera.

Mayer je odvratio da nije ocijenio potrebnim pribaviti RTG snimku za potrebe ovog vještačenja.

- Raspoloživa medicinska dokumentacija sadržavala je i očitanje RTG obrade, dakle nalaz radiologa. Nije bilo elemenata temeljem kojih bih uvidio potrebu za pribavom dodatne dokumentacije. Prema mom iskustvu, Sud često nalogom obuhvati mogućnost da vještak pribavi dodatnu dokumentaciju, pa sam ja tako i shvatio nalog suda, radilo se samo o mogućnosti, ne nalogu – ustvrdio je Mayer.

Kako je javnosti poznato, Jakov Surać je optužen da je 24. lipnja 2018. na parkiralištu u Zadru u večernjim satima zaprijetio Bajlu da će mu, nastavi li pisati o njegovim prijateljima Zdravku Livakoviću, Božidaru Kalmeti i HDZ-u „odrubiti glavu“, te da će završiti kao Pukanić. Potom ga je, navodi se u optužnici, šakama udarao po glavi i tijelu, oborio na tlo i nastavio tući nogama, pri čemu je Bajlo zadobio prijelom desne nadlaktice, podljev oka, oguljotine leđa i krvne podljeve vlasišta.

Na suđenju, kod sutkinje Mitre Meštrović, Surać je u ožujku prošle godine kažnjen uvjetnom zatvorskom kaznom od deset mjeseci, s rokom kušnje od tri godine, no 22. siječnja ove godine Županijski sud u Bjelovaru preinačio je prvostupanjsku presudu i uvjetnu zatvorsku kaznu preinačio na bezuvjetnu zatvorsku kaznu od 10 mjeseci.

Surać je, pak, preko svog odvjetnika mr. sc. Ive Brkića podnio zahtjev za obnovom postupka, čemu mu je udovoljeno – prvo ročište na Općinskom sudu u Zadru održano je upravo u četvrtak, 3. prosinca, na kojem je naloženo novo vještačenje, a slijedeće je ročište zakazano u veljači iduće godine.

- Određujem novo vještačenje, i to kombinirano sudsko-medicinsko i radiološko. Vještačenje će se provesti na Medicinskom fakultetu u Zagrebu – „odrezala“ je Mitra Meštrović, sutkinja zadarskog Općinskog suda, u četvrtak na ponovljenom suđenju Jakovu Suraću (45), optuženom za premlaćivanje Hrvoja Bajla (34) u Zadru u lipnju 2018. godine.

Ovaj se slučaj prati s velikom pozornošću, ne samo zato što se radi o poznatom bivšem nogometašu i kapetanu NK Zadra Jakovu Suraću, te o poznatom novinaru Hrvoju Bajlu, vlasniku portala Zadar News, već i stoga što je cijelo suđenje prepuno obrata.

Svojevrstan obrat dogodio se i u četvrtak u sudnici, jer unatoč tome što je svjedočio zagrebački sudski medicinski vještak dr. Davor Mayer, sutkinja Meštrović je na kraju ročišta ipak, na prijedlog Suraćevog branitelja Ive Brkića, naložila novo, kombinirano vještačenje.

Vještak Mayer, naime, u svojem je vještačenju koristio isključivo medicinsku dokumentaciju iz sudskog spisa, što je na koncu uzrujalo Brkića.

- Sud je naložio vještačenje, a prema tom nalogu u vještačenju je trebalo koristiti medicinsku dokumentaciju, potom RTG snimke, te kao treće i ostalu dokumentaciju iz Opće bolnice Zadar. Da li ste vi postupili po takvom nalogu suda? – upitao je Brkić vještaka Mayera.

Mayer je odvratio da nije ocijenio potrebnim pribaviti RTG snimku za potrebe ovog vještačenja.

- Raspoloživa medicinska dokumentacija sadržavala je i očitanje RTG obrade, dakle nalaz radiologa. Nije bilo elemenata temeljem kojih bih uvidio potrebu za pribavom dodatne dokumentacije. Prema mom iskustvu, Sud često nalogom obuhvati mogućnost da vještak pribavi dodatnu dokumentaciju, pa sam ja tako i shvatio nalog suda, radilo se samo o mogućnosti, ne nalogu – ustvrdio je Mayer.

Kako je javnosti poznato, Jakov Surać je optužen da je 24. lipnja 2018. na parkiralištu u Zadru u večernjim satima zaprijetio Bajlu da će mu, nastavi li pisati o njegovim prijateljima Zdravku Livakoviću, Božidaru Kalmeti i HDZ-u „odrubiti glavu“, te da će završiti kao Pukanić. Potom ga je, navodi se u optužnici, šakama udarao po glavi i tijelu, oborio na tlo i nastavio tući nogama, pri čemu je Bajlo zadobio prijelom desne nadlaktice, podljev oka, oguljotine leđa i krvne podljeve vlasišta.

Na suđenju, kod sutkinje Mitre Meštrović, Surać je u ožujku prošle godine kažnjen uvjetnom zatvorskom kaznom od deset mjeseci, s rokom kušnje od tri godine, no 22. siječnja ove godine Županijski sud u Bjelovaru preinačio je prvostupanjsku presudu i uvjetnu zatvorsku kaznu preinačio na bezuvjetnu zatvorsku kaznu od 10 mjeseci.

Surać je, pak, preko svog odvjetnika mr. sc. Ive Brkića podnio zahtjev za obnovom postupka, čemu mu je udovoljeno – prvo ročište na Općinskom sudu u Zadru održano je upravo u četvrtak, 3. prosinca, na kojem je naloženo novo vještačenje, a slijedeće je ročište zakazano u veljači iduće godine.

- Određujem novo vještačenje, i to kombinirano sudsko-medicinsko i radiološko. Vještačenje će se provesti na Medicinskom fakultetu u Zagrebu – „odrezala“ je Mitra Meštrović, sutkinja zadarskog Općinskog suda, u četvrtak na ponovljenom suđenju Jakovu Suraću (45), optuženom za premlaćivanje Hrvoja Bajla (34) u Zadru u lipnju 2018. godine.
