Predsjednik Vrhovnog suda Radovan Dobronić kazao je u ponedjeljak da je u većini europskih zemalja sucima zabranjeno dodatno zarađivanje na arbitražama, u ostalima je dopušteno uz strogo propisane uvjete, ali "nigdje osim u Hrvatskoj nema ovakvog rješenja totalne slobode".

Iako sustav zbog toga generalno nije ugrožen jer tek 20 posto sudaca povremeno zarađuje na arbitražama u javnosti se ipak ostavlja loš dojam i postavlja pitanje koliko je to u skladu sa sudačkim statusom, kazao je Dobronić na okruglom stolu o izvansudskim aktivnostima sudaca.

Vrhovni sud na taj je skup uz suce, pozvao predstavnike izvršne i zakonodavne vlasti, sudačkih udruga, Državnog sudbenog vijeća (DSV), akademske zajednice i predstavnike Hrvatskog novinarskog društva.

Dobronić je kazao i da u hrvatskim zakonima i etičkom kodeksu koji reguliraju rad sudaca van sudova ne piše ništa pogrešno, ali kad se radi usporedba s ostalim članicama EU jasno je da one na tom području imaju precizniju regulaciju i odredbe.

Dodao je da naš sustav po tom pitanju strši od europske prakse te da neki suci za arbitraže u raznim komorama ili primjerice nogometnom savezu dobivaju prihode koji odgovaraju njihovoj godišnjoj plaći.

Plaćena predavanja i članci, zapošljavanje članova obitelji, tužbe protiv novinara...

Osim arbitraža Dobronić želi utvrditi i pravila za plaćena predavanja i objavljivanje stručnih članaka, ali i zapošljavanje obitelji i bliskih osoba u pravosudnom sustavu. Sve to bile su i teme upitnika koje je ranije poslao predsjednicima sudova, a za koji Dobronić kaže da mu nije bila svrha prikupljanje osobnih podataka već donošenje ograničenja koja proizlaze iz potrebe da sudac u cijelosti zadrži svoju profesionalnu poziciju.

Govoreći o problematici djece sudaca koja su suci, savjetnici ili sudski službenici Dobronić je podsjetio da sudstvo kao javna služba mora biti podjednako dostupna svima.

"Na sud može biti primljen sučev rod, ali ne ako je malo nego znatno bolji od prvog sljedećeg kandidata. Sve drugo stvorit će trajnu sumnju da se zlorabi javna služba, a nažalost imamo takvih slučajeva i ne u malom broju".

Dobronić je problematizirao i tužbe sudaca protiv novinara, podsjećajući kako je i Europski sud za ljudska prava zaključio da su suci kao javne osobe podložni kritici i moraju je prihvatiti. No, iz pojedinih odštetnih zahtjeva može se zaključiti da suci na taj način žele doći do novca i zaplašiti novinare da ne pišu kritički. To nije dobro jer cijeli sustav dovodi do problema, a suce neugodnu poziciju, zaključio je Dobronić.

Josipović: Naznaka novih vjetrova u pravosuđu

Predsjednik Udruge hrvatskih sudaca Damir Kontrec podržao je Dobronićevu inicijativu kao dobronamjernu, ali i ukazao na niz drugih problema u sustavu od plaća, uvjeta rada, infrastrukture, ali i zanemarivanja stabilne sudske prakse i njene dostupnosti.

Profesor sa zagrebačkog Pravnog fakulteta i bivši predsjednik RH Ivo Josipović raspravu je nazvao naznakom novih vjetrova u pravosuđu. Za hrvatski pravni sustav, koji je drugačiji nego u tzv. starim demokracijama, kazao je da je neuspjeli eksperiment, barem ako je suditi prema ugledu koji suci uživaju u društvu.

Državni tajnik u Ministarstvu pravosuđa i uprave Josip Salapić rekao je da i izvršnu vlast zabrinjava percepcija negativnosti pravosuđa, posebno u osoba koje smatraju da je sustav korumpiran, a nikada nisu imali ni jedan postupak pred sudom.

Predsjednik saborskog Odbora za pravosuđe Mišel Jakšić kazao je da suci trebaju politici pomoći da napravi distinkciju što suci smiju, a što ne smiju raditi, dok je sudačke tužbe protiv novinara nazvao žešćom svinjarijom.

Predsjednik HND-a Hrvoje Zovko ocijenio je da su tužbe protiv novinara pokušaj zastrašivanja, podsjetivši da je protiv novinara i medija trenutno podignuta 951 tužba s odštetnim zahtjevima od ukupno 80 milijuna kuna.

Predsjednik Vrhovnog suda Radovan Dobronić kazao je u ponedjeljak da je u većini europskih zemalja sucima zabranjeno dodatno zarađivanje na arbitražama, u ostalima je dopušteno uz strogo propisane uvjete, ali "nigdje osim u Hrvatskoj nema ovakvog rješenja totalne slobode".

Iako sustav zbog toga generalno nije ugrožen jer tek 20 posto sudaca povremeno zarađuje na arbitražama u javnosti se ipak ostavlja loš dojam i postavlja pitanje koliko je to u skladu sa sudačkim statusom, kazao je Dobronić na okruglom stolu o izvansudskim aktivnostima sudaca.

Vrhovni sud na taj je skup uz suce, pozvao predstavnike izvršne i zakonodavne vlasti, sudačkih udruga, Državnog sudbenog vijeća (DSV), akademske zajednice i predstavnike Hrvatskog novinarskog društva.

Dobronić je kazao i da u hrvatskim zakonima i etičkom kodeksu koji reguliraju rad sudaca van sudova ne piše ništa pogrešno, ali kad se radi usporedba s ostalim članicama EU jasno je da one na tom području imaju precizniju regulaciju i odredbe.

Dodao je da naš sustav po tom pitanju strši od europske prakse te da neki suci za arbitraže u raznim komorama ili primjerice nogometnom savezu dobivaju prihode koji odgovaraju njihovoj godišnjoj plaći.

Plaćena predavanja i članci, zapošljavanje članova obitelji, tužbe protiv novinara...

Osim arbitraža Dobronić želi utvrditi i pravila za plaćena predavanja i objavljivanje stručnih članaka, ali i zapošljavanje obitelji i bliskih osoba u pravosudnom sustavu. Sve to bile su i teme upitnika koje je ranije poslao predsjednicima sudova, a za koji Dobronić kaže da mu nije bila svrha prikupljanje osobnih podataka već donošenje ograničenja koja proizlaze iz potrebe da sudac u cijelosti zadrži svoju profesionalnu poziciju.

Govoreći o problematici djece sudaca koja su suci, savjetnici ili sudski službenici Dobronić je podsjetio da sudstvo kao javna služba mora biti podjednako dostupna svima.

"Na sud može biti primljen sučev rod, ali ne ako je malo nego znatno bolji od prvog sljedećeg kandidata. Sve drugo stvorit će trajnu sumnju da se zlorabi javna služba, a nažalost imamo takvih slučajeva i ne u malom broju".

Dobronić je problematizirao i tužbe sudaca protiv novinara, podsjećajući kako je i Europski sud za ljudska prava zaključio da su suci kao javne osobe podložni kritici i moraju je prihvatiti. No, iz pojedinih odštetnih zahtjeva može se zaključiti da suci na taj način žele doći do novca i zaplašiti novinare da ne pišu kritički. To nije dobro jer cijeli sustav dovodi do problema, a suce neugodnu poziciju, zaključio je Dobronić.

Josipović: Naznaka novih vjetrova u pravosuđu

Predsjednik Udruge hrvatskih sudaca Damir Kontrec podržao je Dobronićevu inicijativu kao dobronamjernu, ali i ukazao na niz drugih problema u sustavu od plaća, uvjeta rada, infrastrukture, ali i zanemarivanja stabilne sudske prakse i njene dostupnosti.

Profesor sa zagrebačkog Pravnog fakulteta i bivši predsjednik RH Ivo Josipović raspravu je nazvao naznakom novih vjetrova u pravosuđu. Za hrvatski pravni sustav, koji je drugačiji nego u tzv. starim demokracijama, kazao je da je neuspjeli eksperiment, barem ako je suditi prema ugledu koji suci uživaju u društvu.

Državni tajnik u Ministarstvu pravosuđa i uprave Josip Salapić rekao je da i izvršnu vlast zabrinjava percepcija negativnosti pravosuđa, posebno u osoba koje smatraju da je sustav korumpiran, a nikada nisu imali ni jedan postupak pred sudom.

Predsjednik saborskog Odbora za pravosuđe Mišel Jakšić kazao je da suci trebaju politici pomoći da napravi distinkciju što suci smiju, a što ne smiju raditi, dok je sudačke tužbe protiv novinara nazvao žešćom svinjarijom.

Predsjednik HND-a Hrvoje Zovko ocijenio je da su tužbe protiv novinara pokušaj zastrašivanja, podsjetivši da je protiv novinara i medija trenutno podignuta 951 tužba s odštetnim zahtjevima od ukupno 80 milijuna kuna.
