Ministar obrane Mario Banožić bio je u sukobu interesa kada je sam sebi dodijelio državni stan u centru Zagreba, odlučio je Visoki upravni sud RH.

Banožić je pravomoćno kažnjen zbog sukoba interesa odlukom Visokog upravnog suda RH koji je odbio njegovu žalbu na nepravomoćnu presudu Upravnog suda u Zagrebu. Podsjetimo, i tom ranijom presudom bio je potvrđen sukob interesa kod dodjele državnog stana te se na nju ministar žalio, javlja HRT.

Sudski postupak pokrenuo je sam ministar Banožić nakon što je Povjerenstvo za odlučivanje o sukobu interesa utvrdilo kako je sam sebi dodijelio državni stan u vrijeme dok je bio ministar državne imovine. Odluku o dodjeli stana samome sebi osobno je potpisao iako to, kako je utvrdilo povjerenstvo, nije u skladu sa Zakonom o sprječavanju sukoba interesa, 

Također, Banožiću su na raspolaganju bila još dva manja državna stana, ali si je Banožić odabrao najveći.

Sada presudom Visoki upravni sud RH zaključuje kako je to učinio zbog utjecaja privatnog interesa.

Banožić je u žalbi tvrdio kako nigdje nije propisano da on kao ministar ne smije potpisati odluku o dodjeli stana. On to tumači kako je dopušteno ono što nije zabranjeno. No Visoki upravni sud RH ne misli tako. Sud navodi kako je u Ministarstvu državne imovine bila određena osoba koja mijenja ministra u slučaju spriječenosti te da je ta osoba trebala potpisati odluku kojom se Banožiću dodjeljuje veliki stan u središtu Zagreba. U ovom slučaju to je bio tadašnji državni tajnik Krunoslav Katičić.

Banožić je imao pravo na državni stan, no morao se, prema Zakonu o sprječavanju sukoba interesa, izuzeti iz odlučivanja o tome. Pogrešno je, navodi Visoki upravni sud, shvatio da ga Katičić mijenja samo kada je on kao ministar fizički odsutan, zanemarivši da ga može zamijeniti i u slučaju spriječenosti pravne naravi, kao što je to bila dodjela stana.

Ministar je imao pravo na stan. Bio je u stanu od 32 m2 i zatražio je veći. Pripadala ga je kvadratura do 60 m2. Na raspolaganju je su bila tri stana 53 m2, 73 m2 i 90 m2. On si je dodijelio najveći, od 90 m2.

Nakon što je Banožiću Upravni sud u Zagrebu odbio tužbu žalio se Visokom upravnom sudu koji mu je žalbu sada i odbio, zaključivši da je Banožić doista pretpostavio svoj privatni interes javnom. Besplatno korištenje državnog stana, po stavu Visokog upravnog suda doista je značajan privatni interes.

Banožić sada zbog sukoba interesa morati platiti novčanu kaznu od 930 eura odnosno 7.000 kuna.

Pravomoćnu presudu Visokog upravnog suda RH ministar Banožić može još pokušati srušiti na Ustavnom sudu RH, piše HRT.

Ministar obrane Mario Banožić bio je u sukobu interesa kada je sam sebi dodijelio državni stan u centru Zagreba, odlučio je Visoki upravni sud RH.

Banožić je pravomoćno kažnjen zbog sukoba interesa odlukom Visokog upravnog suda RH koji je odbio njegovu žalbu na nepravomoćnu presudu Upravnog suda u Zagrebu. Podsjetimo, i tom ranijom presudom bio je potvrđen sukob interesa kod dodjele državnog stana te se na nju ministar žalio, javlja HRT.

Sudski postupak pokrenuo je sam ministar Banožić nakon što je Povjerenstvo za odlučivanje o sukobu interesa utvrdilo kako je sam sebi dodijelio državni stan u vrijeme dok je bio ministar državne imovine. Odluku o dodjeli stana samome sebi osobno je potpisao iako to, kako je utvrdilo povjerenstvo, nije u skladu sa Zakonom o sprječavanju sukoba interesa, 

Također, Banožiću su na raspolaganju bila još dva manja državna stana, ali si je Banožić odabrao najveći.

Sada presudom Visoki upravni sud RH zaključuje kako je to učinio zbog utjecaja privatnog interesa.

Banožić je u žalbi tvrdio kako nigdje nije propisano da on kao ministar ne smije potpisati odluku o dodjeli stana. On to tumači kako je dopušteno ono što nije zabranjeno. No Visoki upravni sud RH ne misli tako. Sud navodi kako je u Ministarstvu državne imovine bila određena osoba koja mijenja ministra u slučaju spriječenosti te da je ta osoba trebala potpisati odluku kojom se Banožiću dodjeljuje veliki stan u središtu Zagreba. U ovom slučaju to je bio tadašnji državni tajnik Krunoslav Katičić.

Banožić je imao pravo na državni stan, no morao se, prema Zakonu o sprječavanju sukoba interesa, izuzeti iz odlučivanja o tome. Pogrešno je, navodi Visoki upravni sud, shvatio da ga Katičić mijenja samo kada je on kao ministar fizički odsutan, zanemarivši da ga može zamijeniti i u slučaju spriječenosti pravne naravi, kao što je to bila dodjela stana.

Ministar je imao pravo na stan. Bio je u stanu od 32 m2 i zatražio je veći. Pripadala ga je kvadratura do 60 m2. Na raspolaganju je su bila tri stana 53 m2, 73 m2 i 90 m2. On si je dodijelio najveći, od 90 m2.

Nakon što je Banožiću Upravni sud u Zagrebu odbio tužbu žalio se Visokom upravnom sudu koji mu je žalbu sada i odbio, zaključivši da je Banožić doista pretpostavio svoj privatni interes javnom. Besplatno korištenje državnog stana, po stavu Visokog upravnog suda doista je značajan privatni interes.

Banožić sada zbog sukoba interesa morati platiti novčanu kaznu od 930 eura odnosno 7.000 kuna.

Pravomoćnu presudu Visokog upravnog suda RH ministar Banožić može još pokušati srušiti na Ustavnom sudu RH, piše HRT.

Ministar obrane Mario Banožić bio je u sukobu interesa kada je sam sebi dodijelio državni stan u centru Zagreba, odlučio je Visoki upravni sud RH.

Banožić je pravomoćno kažnjen zbog sukoba interesa odlukom Visokog upravnog suda RH koji je odbio njegovu žalbu na nepravomoćnu presudu Upravnog suda u Zagrebu. Podsjetimo, i tom ranijom presudom bio je potvrđen sukob interesa kod dodjele državnog stana te se na nju ministar žalio, javlja HRT.

Sudski postupak pokrenuo je sam ministar Banožić nakon što je Povjerenstvo za odlučivanje o sukobu interesa utvrdilo kako je sam sebi dodijelio državni stan u vrijeme dok je bio ministar državne imovine. Odluku o dodjeli stana samome sebi osobno je potpisao iako to, kako je utvrdilo povjerenstvo, nije u skladu sa Zakonom o sprječavanju sukoba interesa, 

Također, Banožiću su na raspolaganju bila još dva manja državna stana, ali si je Banožić odabrao najveći.

Sada presudom Visoki upravni sud RH zaključuje kako je to učinio zbog utjecaja privatnog interesa.

Banožić je u žalbi tvrdio kako nigdje nije propisano da on kao ministar ne smije potpisati odluku o dodjeli stana. On to tumači kako je dopušteno ono što nije zabranjeno. No Visoki upravni sud RH ne misli tako. Sud navodi kako je u Ministarstvu državne imovine bila određena osoba koja mijenja ministra u slučaju spriječenosti te da je ta osoba trebala potpisati odluku kojom se Banožiću dodjeljuje veliki stan u središtu Zagreba. U ovom slučaju to je bio tadašnji državni tajnik Krunoslav Katičić.

Banožić je imao pravo na državni stan, no morao se, prema Zakonu o sprječavanju sukoba interesa, izuzeti iz odlučivanja o tome. Pogrešno je, navodi Visoki upravni sud, shvatio da ga Katičić mijenja samo kada je on kao ministar fizički odsutan, zanemarivši da ga može zamijeniti i u slučaju spriječenosti pravne naravi, kao što je to bila dodjela stana.

Ministar je imao pravo na stan. Bio je u stanu od 32 m2 i zatražio je veći. Pripadala ga je kvadratura do 60 m2. Na raspolaganju je su bila tri stana 53 m2, 73 m2 i 90 m2. On si je dodijelio najveći, od 90 m2.
