Nakon trećeg po redu suđenja na šibenskom Općinskom sudu, ugostitelj Miljenko Žaja Krojf (65) iz Tomislavgrada, nogometni menadžer Siniša Šošo (56) iz Sinja te Tonći Botica (60) iz Otoka oslobođeni su nepravomoćno krivnje da su, sada već (pra)davnog 21. svibnja 2004. godine u Rogoznici iznudili Nenada Skejića.

Prema optužnici ODO-a Šibenik, njih su trojica prije više od 19 godina došli u marinu "Frapa" gdje ih u slastičarni, sukladno njihovom traženju, dočekao Skejić.

On je prvo Botici rekao da mu ništa ne duguje, a radilo se o utjerivanju oko 200 tisuća dolara duga te da ako i postoji neki dug da će o tome odlučiti sud. Botica je na to kazao da on "j... sud i da će on to riješiti na brži način", a onda se u razgovor uključio Miljenko Žaja te je Skejića pitao zna li on tko je on rekavši mu da je on "Krojf" te da je o njemu mogao čitati u novinama.

Tada se u priču uključuje i Šošo, koji je Skejiću rekao da njega već dobro zna i da će ga još bolje upoznati te da on dobro zna koga je on dirao i da je njemu prosuti mozak isto kao oštećeniku popiti kavu sa ženom. Botica nakon toga govori Skejiću da više nema ništa s njim i da je otad dužan Krojfu i Šoši.

Krojf tada, kako ga se teretilo, govori Skejiću da je njemu ubiti čovjeka kao Skejiću reći djetetu dobro jutro, a Šošo je podigao majicu i kazao: "Hoćeš da ti sada prospem mozak?". Na to je Žaja rekao Šoši "pusti ima vremena za to, nemoj sada i nemoj ovdje" te je pojašnjavao Skejiću da se to radi ukradenim pištoljem, nakon čega se pištolj baci.

Šošo tad dodaje da bi Skejić dobio na lotu da mu odmah prospu mozak već da će mu najprije iskasapiti dijete i ženu, dignuti sve u zrak, a onda riješiti njega. Prestravljeni Skejić im je potom predao svoje automobile "Chevrolet blazer", "Cadilac seville" i Old timer "Masserati", a nakon što ih je zaskočila policija, u Krojfovom automobilu pronašli su revolver, pištolj i streljivo.

Sva trojica okrivljenih su negirali djelo te je Botica tvrdio kako je Skejiću na ime zajedničkog ulaganja predao 300.000 tadašnjih njemačkih maraka, a traženi iznos na kraju se popeo na 800.000 američkih dolara.

Na prvom su suđenju krajem travnja 2014. godine sva trojica bili oslobođeni krivnje da bi viši sud presudu ukinuo. Na drugom suđenju su krajem 2015. godine osuđeni i to Krojf na osam mjeseci zatvora, Šošo na 10 mjeseci, a Botica na osam mjeseci. U kazne im se uračunavalo i vrijeme provedeno u istražnom zatvoru u kojem su sva trojica bila sedam mjeseci, od svibnja do prosinca 2004. godine, dok je preostali neizdržani dio kazne zamijenjen radom za opće dobro. I ta je presuda ukinuta, a sada je ponovno nepravomoćno donesena oslobađajuća presuda.

- Sud može sa sigurnošcu zaključiti, na temelju svega izloženog, da se ovdje radilo o namjeri optuženih da utuženog događaja izvrše protupravnu naplatu ovog naprijed utvrđenog duga oštećenika (počinitelj ovog kaznenog djela upotrebljava silu ili prijetnju radi naplate duga), a nikako se nije radilo o utuženom kaznenom djelu iznude jer nema dokaza o namjeri optuženika da utuženog događaja pribave sebi ili drugome znatnu protupravnu imovinsku korist, a za što ih se tereti.

Kako u postupku nije dokazano da bi optuženici počinili utuženo kazneno djelo iznude, a moglo bi se raditi o učinu drugog kaznenog djela kod kojeg je namjera optuženika usmjerena na protupravnu naplatu dugovanja utuženog događaja... Budući da optužba u tom smislu nije izmijenila optužnicu, a niti je ovaj sud to ovlašten učiniti po službenoj dužnosti jer bi time preuzeo ulogu tužitelja u postupku i jer bi povrijedio identitet optužbe i presude, to je optužene valjalo osloboditi ove optužbe - obrazložila je, uz ostalo, u svojoj presudi šibenska sutkinja Nives Vrvilo.

Nakon trećeg po redu suđenja na šibenskom Općinskom sudu, ugostitelj Miljenko Žaja Krojf (65) iz Tomislavgrada, nogometni menadžer Siniša Šošo (56) iz Sinja te Tonći Botica (60) iz Otoka oslobođeni su nepravomoćno krivnje da su, sada već (pra)davnog 21. svibnja 2004. godine u Rogoznici iznudili Nenada Skejića.

Prema optužnici ODO-a Šibenik, njih su trojica prije više od 19 godina došli u marinu "Frapa" gdje ih u slastičarni, sukladno njihovom traženju, dočekao Skejić.

On je prvo Botici rekao da mu ništa ne duguje, a radilo se o utjerivanju oko 200 tisuća dolara duga te da ako i postoji neki dug da će o tome odlučiti sud. Botica je na to kazao da on "j... sud i da će on to riješiti na brži način", a onda se u razgovor uključio Miljenko Žaja te je Skejića pitao zna li on tko je on rekavši mu da je on "Krojf" te da je o njemu mogao čitati u novinama.

Tada se u priču uključuje i Šošo, koji je Skejiću rekao da njega već dobro zna i da će ga još bolje upoznati te da on dobro zna koga je on dirao i da je njemu prosuti mozak isto kao oštećeniku popiti kavu sa ženom. Botica nakon toga govori Skejiću da više nema ništa s njim i da je otad dužan Krojfu i Šoši.

Krojf tada, kako ga se teretilo, govori Skejiću da je njemu ubiti čovjeka kao Skejiću reći djetetu dobro jutro, a Šošo je podigao majicu i kazao: "Hoćeš da ti sada prospem mozak?". Na to je Žaja rekao Šoši "pusti ima vremena za to, nemoj sada i nemoj ovdje" te je pojašnjavao Skejiću da se to radi ukradenim pištoljem, nakon čega se pištolj baci.

Šošo tad dodaje da bi Skejić dobio na lotu da mu odmah prospu mozak već da će mu najprije iskasapiti dijete i ženu, dignuti sve u zrak, a onda riješiti njega. Prestravljeni Skejić im je potom predao svoje automobile "Chevrolet blazer", "Cadilac seville" i Old timer "Masserati", a nakon što ih je zaskočila policija, u Krojfovom automobilu pronašli su revolver, pištolj i streljivo.

Sva trojica okrivljenih su negirali djelo te je Botica tvrdio kako je Skejiću na ime zajedničkog ulaganja predao 300.000 tadašnjih njemačkih maraka, a traženi iznos na kraju se popeo na 800.000 američkih dolara.

Na prvom su suđenju krajem travnja 2014. godine sva trojica bili oslobođeni krivnje da bi viši sud presudu ukinuo. Na drugom suđenju su krajem 2015. godine osuđeni i to Krojf na osam mjeseci zatvora, Šošo na 10 mjeseci, a Botica na osam mjeseci. U kazne im se uračunavalo i vrijeme provedeno u istražnom zatvoru u kojem su sva trojica bila sedam mjeseci, od svibnja do prosinca 2004. godine, dok je preostali neizdržani dio kazne zamijenjen radom za opće dobro. I ta je presuda ukinuta, a sada je ponovno nepravomoćno donesena oslobađajuća presuda.

- Sud može sa sigurnošcu zaključiti, na temelju svega izloženog, da se ovdje radilo o namjeri optuženih da utuženog događaja izvrše protupravnu naplatu ovog naprijed utvrđenog duga oštećenika (počinitelj ovog kaznenog djela upotrebljava silu ili prijetnju radi naplate duga), a nikako se nije radilo o utuženom kaznenom djelu iznude jer nema dokaza o namjeri optuženika da utuženog događaja pribave sebi ili drugome znatnu protupravnu imovinsku korist, a za što ih se tereti.

Kako u postupku nije dokazano da bi optuženici počinili utuženo kazneno djelo iznude, a moglo bi se raditi o učinu drugog kaznenog djela kod kojeg je namjera optuženika usmjerena na protupravnu naplatu dugovanja utuženog događaja... Budući da optužba u tom smislu nije izmijenila optužnicu, a niti je ovaj sud to ovlašten učiniti po službenoj dužnosti jer bi time preuzeo ulogu tužitelja u postupku i jer bi povrijedio identitet optužbe i presude, to je optužene valjalo osloboditi ove optužbe - obrazložila je, uz ostalo, u svojoj presudi šibenska sutkinja Nives Vrvilo.
