Josip Klemm, vlasnik tvrtke "Klemm sigurnost" i bivši predsjednik Udruge specijalne policije iz Domovinskog rata, morat će u zatvor na godinu dana jer je presuda zagrebačkog Županijskog suda za zloporabe povjerenja u gospodarskom poslovanju postala pravomoćna, doznaje se u ponedjeljak na sudu.
Presudu koju je u srpnju 2017. godine donijelo sudsko vijeće pod predsjedanjem sutkinje Maje Štampar Stipić u cijelosti je potvrdio Vrhovni sud.
Klemm je ranije nepravomoćno osuđen na godinu dana zatvora jer je svoju tvrtku fiktivnim ugovorima s drugim poduzećima oštetio za gotovo tri milijuna kuna. Tužiteljstvo ga je teretilo i za utaju poreza, no ta je inkriminacija u međuvremenu otpala pa je osuđen samo za štetu koju je počinio svojoj tvrtki.
Tužiteljstvo je tvrdilo da je Klemm od veljače 2005. do ožujka 2007. osmislio način na koji će iz svoje tvrtke "neosnovano obavljati isplate u svoju korist" pa je "nalagao neosnovana plaćanja sa žiroračuna" na račune drugih tvrtki koje su mu, prema ranijem dogovoru, izdavale račune za neobavljene usluge.
Istraga navodnih Klemmovih "financijskih malverzacija" pokrenuta je još 2014. no on tada nije uhićen jer je u tužiteljstvu iznio tzv. aktivnu obranu, tvrdeći da se može osjećati krivim ako je svoju tvrtku oštetio neznanjem, ali da nikada ne bi oštetio državu.
Obrazlažući nepravomoćnu presudu sutkinja Maja Štampar Stipić kazala je da su Klemmu pri izricanju kazne u obzir uzete brojne olakotne okolnosti – da je neosuđivan i ugledan poslovan čovjek, sudionik Domovinskog rata, predsjednik braniteljske udruge i obiteljski čovjek. Otegotnih okolnosti sud nije pronašao.

Josip Klemm, vlasnik tvrtke "Klemm sigurnost" i bivši predsjednik Udruge specijalne policije iz Domovinskog rata, morat će u zatvor na godinu dana jer je presuda zagrebačkog Županijskog suda za zloporabe povjerenja u gospodarskom poslovanju postala pravomoćna, doznaje se u ponedjeljak na sudu.
Presudu koju je u srpnju 2017. godine donijelo sudsko vijeće pod predsjedanjem sutkinje Maje Štampar Stipić u cijelosti je potvrdio Vrhovni sud.
Klemm je ranije nepravomoćno osuđen na godinu dana zatvora jer je svoju tvrtku fiktivnim ugovorima s drugim poduzećima oštetio za gotovo tri milijuna kuna. Tužiteljstvo ga je teretilo i za utaju poreza, no ta je inkriminacija u međuvremenu otpala pa je osuđen samo za štetu koju je počinio svojoj tvrtki.
Tužiteljstvo je tvrdilo da je Klemm od veljače 2005. do ožujka 2007. osmislio način na koji će iz svoje tvrtke "neosnovano obavljati isplate u svoju korist" pa je "nalagao neosnovana plaćanja sa žiroračuna" na račune drugih tvrtki koje su mu, prema ranijem dogovoru, izdavale račune za neobavljene usluge.
Istraga navodnih Klemmovih "financijskih malverzacija" pokrenuta je još 2014. no on tada nije uhićen jer je u tužiteljstvu iznio tzv. aktivnu obranu, tvrdeći da se može osjećati krivim ako je svoju tvrtku oštetio neznanjem, ali da nikada ne bi oštetio državu.
Obrazlažući nepravomoćnu presudu sutkinja Maja Štampar Stipić kazala je da su Klemmu pri izricanju kazne u obzir uzete brojne olakotne okolnosti – da je neosuđivan i ugledan poslovan čovjek, sudionik Domovinskog rata, predsjednik braniteljske udruge i obiteljski čovjek. Otegotnih okolnosti sud nije pronašao.
