Bivši ministar Božidar Kalmeta i petorica njegovih suoptuženika izjavili su danas da se ne osjećaju krivi zbog optužbi za izvlačenje novca iz cestarskih firmi te izradu promotivnog filmića na račun Ministarstva koje je vodio, objavila je N1.
Izjavili su to na početku ponovljenog suđenja koje je krenulo nakon što je Vrhovni sud RH srušio prvu oslobađajuću presudu Kalmeti.
Novo suđenje traženo je jer je Vrhovni sud zaključio da je vijeće Županijskog suda u Zagrebu pogriješilo, odnosno napravilo bitnu povredu odredaba kaznenog postupka kod analize iskaza ključnog svjedoka Josipa Sapunara. On je, naime, kao bivši šef uprave Hrvatskih autocesta svjedočio o tome kako se novac izvučen preko radova na autocestama dijelio među okrivljenima. Međutim, u obrazloženju presude nije točno citirano ono što je Sapunar govorio, zbog čega će se ponoviti postupak za dio optužbi koje se odnose na izvlačenje novca tijekom gradnje spojne ceste Zada 2 – Gaženica, luke Gaženica te ceste Rijeka-Rupa.
Kalmeta će ponovno odgovarati i za naručivanje filma ‘Prometna renesansa’. Naime, niži sud, kako stoji u odluci Vrhovnog suda, nije utvrdio je li taj uradak služio za promociju ministarstva ili pak HDZ-a, odnosno je li iskorišten za politički marketing.
Oslobađajući dio presude Kalmeti za muljaže povezane s građevinskom firmom Osijek Koteks te za ustrojavanje zločinačke grupe koju je sam predvodio, Vrhovni sud je potvrdio.
Sudi se ponovno i za optužbe prema kojima su Kalmetini suradnici Stjepk Boban, Milivoj Milulić i Damir Kezele novac izvlačili u periodu od 2005. do 2009. godine. Mikulić je tada bio direktor HAC-a i pomoćnik ministra, a zajedno s ovom dvojicom na prvom je suđenju bio proglašen krivim za izvlačenje novca preko Gaženice iz Viadukta. Mikulić je kažnjen s tri godine, Boban s dvije, a Kezele s ukupno tri i pol godine.
I u tom dijelu presude Županijski sud u Zagrebu je također bio pogriješio budući da je osudu utemeljio na iskazu samo jednog svjedoka kojem okrivljenici nisu mogli postavljati pitanja.
Danas je zamjenica ravnateljice USKOK-a Petra Parlov predložila da se iznova provedu svi dokazi, no obrana je zatražila rok da se tom njezinom prijedlogu očituje. Suđenje se nastavlja početkom siječnja iduće godine.

Bivši ministar Božidar Kalmeta i petorica njegovih suoptuženika izjavili su danas da se ne osjećaju krivi zbog optužbi za izvlačenje novca iz cestarskih firmi te izradu promotivnog filmića na račun Ministarstva koje je vodio, objavila je N1.
Izjavili su to na početku ponovljenog suđenja koje je krenulo nakon što je Vrhovni sud RH srušio prvu oslobađajuću presudu Kalmeti.
Novo suđenje traženo je jer je Vrhovni sud zaključio da je vijeće Županijskog suda u Zagrebu pogriješilo, odnosno napravilo bitnu povredu odredaba kaznenog postupka kod analize iskaza ključnog svjedoka Josipa Sapunara. On je, naime, kao bivši šef uprave Hrvatskih autocesta svjedočio o tome kako se novac izvučen preko radova na autocestama dijelio među okrivljenima. Međutim, u obrazloženju presude nije točno citirano ono što je Sapunar govorio, zbog čega će se ponoviti postupak za dio optužbi koje se odnose na izvlačenje novca tijekom gradnje spojne ceste Zada 2 – Gaženica, luke Gaženica te ceste Rijeka-Rupa.
Kalmeta će ponovno odgovarati i za naručivanje filma ‘Prometna renesansa’. Naime, niži sud, kako stoji u odluci Vrhovnog suda, nije utvrdio je li taj uradak služio za promociju ministarstva ili pak HDZ-a, odnosno je li iskorišten za politički marketing.
Oslobađajući dio presude Kalmeti za muljaže povezane s građevinskom firmom Osijek Koteks te za ustrojavanje zločinačke grupe koju je sam predvodio, Vrhovni sud je potvrdio.
Sudi se ponovno i za optužbe prema kojima su Kalmetini suradnici Stjepk Boban, Milivoj Milulić i Damir Kezele novac izvlačili u periodu od 2005. do 2009. godine. Mikulić je tada bio direktor HAC-a i pomoćnik ministra, a zajedno s ovom dvojicom na prvom je suđenju bio proglašen krivim za izvlačenje novca preko Gaženice iz Viadukta. Mikulić je kažnjen s tri godine, Boban s dvije, a Kezele s ukupno tri i pol godine.
I u tom dijelu presude Županijski sud u Zagrebu je također bio pogriješio budući da je osudu utemeljio na iskazu samo jednog svjedoka kojem okrivljenici nisu mogli postavljati pitanja.
Danas je zamjenica ravnateljice USKOK-a Petra Parlov predložila da se iznova provedu svi dokazi, no obrana je zatražila rok da se tom njezinom prijedlogu očituje. Suđenje se nastavlja početkom siječnja iduće godine.
