Vrhovni sud u utorak je raspravljao o žalbama na nepravomoćnu presudu iz rujna 2019. kojom je bivši HDZ-ov ministar Božidar Kalmeta oslobođen optužbi da je sa suradnicima u aferi Remorker podijelio više od 15 milijuna kuna i 850.000 eura iz tvrtki za održavanje i izgradnju cesta.
Iako je tom presudom Kalmetu sud oslobodio i za navodnu štetu Ministarstvu prometa, u kraku afere Fimi media, krivima proglasio trojicu njegovih suoptuženika. Pravomoćnu presudu u ovom slučaju najviši sud trebao bi objaviti u narednih mjesec dana.
Sudsko vijeće zagrebačkog Županijskog suda, kojim je predsjedala Gordana Mihela Grahovac, nepravomoćno je prije tri godine osudilo nekadašnjeg Kalmetinog državnog tajnika Milivoja Mikulića, koji je također bio i u upravi Hrvatskih autocesta (HAC), na tri godine zatvora, dok je bivši čelnik HAC-a i Hrvatskih cesta (HC) Stjepko Boban osuđen na dvije godine.
Nekadašnji član uprave Viadukta Damir Kezele osuđen je na tri i pol godine, a sva trojica će morati vratiti nezakonitu imovinsku korist. Postane li presuda pravomoćna, Mikulić državi treba vratiti 2,6 milijuna kuna, Kezele 730 tisuća kuna te 95 tisuća eura s računa u banci, a Boban će ostati bez kuće u Vižinadi.
Kalmeta od početka tvrdio da je žrtva političkog progona
Sud je suprotno tvrdnjama iz Uskokove optužnice zaključio da Kalmeta nije organizirao grupu za izvlačenje novca u kojoj su uz njega i trojicu nepravomoćno osuđenih, po tvrdnjama tužiteljstva, bili i oslobođeni državni tajnik te predsjednik Nadzornog odbora HAC-a Zdravko Livaković, čelnici građevinskih tvrtki Miroslav Bunić i Petar Pečin te ljudi iz HAC-a i HC-a Jurica Prskalo, Mario Lovrinčević i Sandro Vukelić.
Kalmeta je oslobođen i za dio optužnice prema kojoj je Ministarstvo prometa kojem je bio na čelu oštetio za 600 tisuća kuna narudžbom promotivnog filma "Prometna renesansa Hrvatske", od marketinške agencije Fimi media koja je, u drugom postupku, osuđena za punjenje HDZ-ova crnog fonda novcem iz državnih institucija i tvrtki.
Bivši ministar i dugogodišnji zadarski gradonačelnik od početka je odbacivao optužbe i tvrdio da je žrtva političkog progona. No optužnicom u aferi Remorker bila su obuhvaćena i trojica "pokajnika" koji su prije početka suđenja priznali nedjela i nagodili se s tužiteljstvom.
Sporan iskaz pokajnika Sapunara
Nekadašnji financijski direktor HAC-a Josip Sapunar još je u istrazi Livakovića i Mikulića prokazao kao osobe kojima je nosio novac što su ga HAC-ovi podizvođači uplaćivali na austrijski račun češke tvrtke Remorker u vlasništvu Igora Premilovca koji je poput Sapunara, nakon priznanja Uskokovih optužbi, sporazumno osuđen na povrat novca i rad za opće dobro. Nagodbu s tužiteljstvom, nakon priznanja optužbi, postigao je i bivši direktor u Viaduktu Ivan Berket.
Uskok je u svojoj žalbi na oslobađajući dio presude pred Vrhovnim sudom tvrdio da nema razloga da sud ne vjeruje Sapunaru, jer je on proglašen krivim za djela koja su se Kalmeti i ostalima stavljala na teret. Obrana je, s druge strane, isticala da je Sapunar prvo bio osumnjičenik, a zatim svjedok i to sve u jednom postupku, što po njihovu mišljenju nije u skladu sa zakonom.
"Odbacujemo Uskokovu žalbu na 139 stranica kao neosnovanu jer ona za svrhu ima samo impresioniranje Vrhovnog suda", zaključio je Kalmetin odvjetnik Krešimir Vilajtović.
Drugi krak afere Remorker proširio se na Hrvatsku gospodarsku komoru i njezina dugogodišnjeg čelnika Nadana Vidoševića koji je nepravomoćno osuđen na osam godina zatvora.

Vrhovni sud u utorak je raspravljao o žalbama na nepravomoćnu presudu iz rujna 2019. kojom je bivši HDZ-ov ministar Božidar Kalmeta oslobođen optužbi da je sa suradnicima u aferi Remorker podijelio više od 15 milijuna kuna i 850.000 eura iz tvrtki za održavanje i izgradnju cesta.
Iako je tom presudom Kalmetu sud oslobodio i za navodnu štetu Ministarstvu prometa, u kraku afere Fimi media, krivima proglasio trojicu njegovih suoptuženika. Pravomoćnu presudu u ovom slučaju najviši sud trebao bi objaviti u narednih mjesec dana.
Sudsko vijeće zagrebačkog Županijskog suda, kojim je predsjedala Gordana Mihela Grahovac, nepravomoćno je prije tri godine osudilo nekadašnjeg Kalmetinog državnog tajnika Milivoja Mikulića, koji je također bio i u upravi Hrvatskih autocesta (HAC), na tri godine zatvora, dok je bivši čelnik HAC-a i Hrvatskih cesta (HC) Stjepko Boban osuđen na dvije godine.
Nekadašnji član uprave Viadukta Damir Kezele osuđen je na tri i pol godine, a sva trojica će morati vratiti nezakonitu imovinsku korist. Postane li presuda pravomoćna, Mikulić državi treba vratiti 2,6 milijuna kuna, Kezele 730 tisuća kuna te 95 tisuća eura s računa u banci, a Boban će ostati bez kuće u Vižinadi.
Kalmeta od početka tvrdio da je žrtva političkog progona
Sud je suprotno tvrdnjama iz Uskokove optužnice zaključio da Kalmeta nije organizirao grupu za izvlačenje novca u kojoj su uz njega i trojicu nepravomoćno osuđenih, po tvrdnjama tužiteljstva, bili i oslobođeni državni tajnik te predsjednik Nadzornog odbora HAC-a Zdravko Livaković, čelnici građevinskih tvrtki Miroslav Bunić i Petar Pečin te ljudi iz HAC-a i HC-a Jurica Prskalo, Mario Lovrinčević i Sandro Vukelić.
Kalmeta je oslobođen i za dio optužnice prema kojoj je Ministarstvo prometa kojem je bio na čelu oštetio za 600 tisuća kuna narudžbom promotivnog filma "Prometna renesansa Hrvatske", od marketinške agencije Fimi media koja je, u drugom postupku, osuđena za punjenje HDZ-ova crnog fonda novcem iz državnih institucija i tvrtki.
Bivši ministar i dugogodišnji zadarski gradonačelnik od početka je odbacivao optužbe i tvrdio da je žrtva političkog progona. No optužnicom u aferi Remorker bila su obuhvaćena i trojica "pokajnika" koji su prije početka suđenja priznali nedjela i nagodili se s tužiteljstvom.
Sporan iskaz pokajnika Sapunara
Nekadašnji financijski direktor HAC-a Josip Sapunar još je u istrazi Livakovića i Mikulića prokazao kao osobe kojima je nosio novac što su ga HAC-ovi podizvođači uplaćivali na austrijski račun češke tvrtke Remorker u vlasništvu Igora Premilovca koji je poput Sapunara, nakon priznanja Uskokovih optužbi, sporazumno osuđen na povrat novca i rad za opće dobro. Nagodbu s tužiteljstvom, nakon priznanja optužbi, postigao je i bivši direktor u Viaduktu Ivan Berket.
Uskok je u svojoj žalbi na oslobađajući dio presude pred Vrhovnim sudom tvrdio da nema razloga da sud ne vjeruje Sapunaru, jer je on proglašen krivim za djela koja su se Kalmeti i ostalima stavljala na teret. Obrana je, s druge strane, isticala da je Sapunar prvo bio osumnjičenik, a zatim svjedok i to sve u jednom postupku, što po njihovu mišljenju nije u skladu sa zakonom.
"Odbacujemo Uskokovu žalbu na 139 stranica kao neosnovanu jer ona za svrhu ima samo impresioniranje Vrhovnog suda", zaključio je Kalmetin odvjetnik Krešimir Vilajtović.
Drugi krak afere Remorker proširio se na Hrvatsku gospodarsku komoru i njezina dugogodišnjeg čelnika Nadana Vidoševića koji je nepravomoćno osuđen na osam godina zatvora.
