USKOK je donio rješenje o provođenju istrage protiv 11 hrvatskih državljana (1972., 1978., 1982., 1983., 1973., 1987., 1980., 1976., 1997., 1988., 1991.) i petorice talijanskih državljana (1979., 1965., 1980., 1960., 1978.) zbog osnovane sumnje na počinjenje kaznenih djela zločinačkog udruženja, trgovanja divljim vrstama u sastavu zločinačkog udruženja te pomaganja u trgovanju divljim vrstama u sastavu zločinačkog udruženja.

Osnovano se sumnja da je I. okr., u razdoblju od ožujka do 19. srpnja 2022., u Hrvatskoj i Italiji, povezao u zajedničko djelovanje II. i  III. okr., V. do XII. okr. te XIV. i XV. okr., a posredstvom II. okr. i IV., XIII. i XVI. okr. te druge nepoznate osobe, s ciljem stjecanja nepripadne materijalne koristi za sebe i druge protuzakonitom nabavom, a potom krijumčarenjem iz Hrvatske u Italiju više divljih vrsta i to trpa, igličastog ježinca, pjegavog ježinca i ikre ježinca radi njihove preprodaje na ilegalnom tržištu u Italiji, kao i prstaca radi njihove preprodaje na ilegalnom tržištu u Hrvatskoj.

Sakupljanje trpova Zakonom o morskom ribarstvu i Pravilnikom o lovostaju trpova u potpunosti je zabranjeno. Za skupljanje pjegavog ježinca, sukladno Zakonu o zaštiti prirode i Pravilniku o sakupljanju zavičajnih divljih vrsta, potrebno je ishoditi dopuštenje nadležnog ministarstva, a prema Zakonu o zaštiti prirode i Pravilniku o strogo zaštićenim vrstama igličasti ježinci i prstaci strogo su zaštićene vrste.

Iako su to okrivljenici znali, radi realizacije dogovorenog plana, nakon što su II. i III. okr. s I. okr. dogovorili prodaju navedenih divljih morskih vrsta na području Italije, I. okr. te po njegovom nalogu V. do XII. okr. te XIV. i XV. okr. su na području Splita, Kaštela, Trogira i otoka Šolte, koristeći profesionalnu ronilačku opremu izlovljavali morske ježince i trpove, a VIII. i X. okr. i prstace. Zatim su I. okr. te po njegovom nalogu V. do VIII. okr. te X. i XII. okr. dio morskih ježinaca i trpova dovozili u Zadar i Biograd na moru, dok su odvozili do skladišta u Kaštel Starom i Kninu.

U skladištima su I. okr. te sukladno njegovim uputama V., VII., VIII. i X. okr. navedene morske vrste pakirali u PVC spremnike radi njihovog daljnjeg ilegalnog transporta u Italiju. Osim toga se u skladištima vršila i prerada ikre morskih ježinaca koja se pakirala u staklenke, a u koju svrhu su III. i V. okr., sukladno dogovoru s I. okr., prethodno angažirali više nepoznatih osoba. Nakon toga su I. okr., a po njegovom nalogu i V. do VIII. okr. te X. i XII. okr. morske ježince, trpove te ikru ježinaca, radi njihovog prijenosa iz Hrvatske u Italiju, na području Zadra, Biograda na moru i Splita predavali V. , XIII. i XVI. okr. koje je prethodno sukladno dogovoru s I. okr. angažirao II. okrivljenik. Zatim su morske organizme za novčanu naknadu, sukladno uputama I., II. i III. okr., prevozili iz Hrvatske u Italiju gdje su ih II. i III. okr. prodavali raznim kupcima na ilegalnom tržištu, dok je X. okr. po nalogu I. okr. za novčanu naknadu prstace u Splitu isporučio jednom ugostitelju.

Okrivljenici su na ilegalnom tržištu u Hrvatskoj i Italiji prodali najmanje 19.000 kilograma trpova po cijeni od najmanje 30,00 kuna po kilogramu, najmanje 3.520 kilograma morskih ježinaca po cijeni od najmanje 25,00 kuna po kilogramu, najmanje 62 kilograma ikre morskih ježinaca po cijeni od 800,00 kuna po kilogramu, te najmanje 6,35 kilograma prstaca po cijeni od 250,00 kuna po kilogramu.

Na opisani način su I. okr., V. do XII. okr., te XIV. i XV. okr. pribavili nepripadnu imovinsku korist od najmanje 709.187,00 kuna, a novac su međusobno podijelili sukladno njihovim prethodno dogovorenim ulogama u realizaciji plana, čime su Državni proračun Republike Hrvatske oštetili za najmanje 11.483.050,00 kuna.

USKOK će sucu istrage Županijskog suda u Splitu predložiti određivanje istražnog zatvora protiv 11 okrivljenika.

USKOK je donio rješenje o provođenju istrage protiv 11 hrvatskih državljana (1972., 1978., 1982., 1983., 1973., 1987., 1980., 1976., 1997., 1988., 1991.) i petorice talijanskih državljana (1979., 1965., 1980., 1960., 1978.) zbog osnovane sumnje na počinjenje kaznenih djela zločinačkog udruženja, trgovanja divljim vrstama u sastavu zločinačkog udruženja te pomaganja u trgovanju divljim vrstama u sastavu zločinačkog udruženja.

Osnovano se sumnja da je I. okr., u razdoblju od ožujka do 19. srpnja 2022., u Hrvatskoj i Italiji, povezao u zajedničko djelovanje II. i  III. okr., V. do XII. okr. te XIV. i XV. okr., a posredstvom II. okr. i IV., XIII. i XVI. okr. te druge nepoznate osobe, s ciljem stjecanja nepripadne materijalne koristi za sebe i druge protuzakonitom nabavom, a potom krijumčarenjem iz Hrvatske u Italiju više divljih vrsta i to trpa, igličastog ježinca, pjegavog ježinca i ikre ježinca radi njihove preprodaje na ilegalnom tržištu u Italiji, kao i prstaca radi njihove preprodaje na ilegalnom tržištu u Hrvatskoj.

Sakupljanje trpova Zakonom o morskom ribarstvu i Pravilnikom o lovostaju trpova u potpunosti je zabranjeno. Za skupljanje pjegavog ježinca, sukladno Zakonu o zaštiti prirode i Pravilniku o sakupljanju zavičajnih divljih vrsta, potrebno je ishoditi dopuštenje nadležnog ministarstva, a prema Zakonu o zaštiti prirode i Pravilniku o strogo zaštićenim vrstama igličasti ježinci i prstaci strogo su zaštićene vrste.

Iako su to okrivljenici znali, radi realizacije dogovorenog plana, nakon što su II. i III. okr. s I. okr. dogovorili prodaju navedenih divljih morskih vrsta na području Italije, I. okr. te po njegovom nalogu V. do XII. okr. te XIV. i XV. okr. su na području Splita, Kaštela, Trogira i otoka Šolte, koristeći profesionalnu ronilačku opremu izlovljavali morske ježince i trpove, a VIII. i X. okr. i prstace. Zatim su I. okr. te po njegovom nalogu V. do VIII. okr. te X. i XII. okr. dio morskih ježinaca i trpova dovozili u Zadar i Biograd na moru, dok su odvozili do skladišta u Kaštel Starom i Kninu.

U skladištima su I. okr. te sukladno njegovim uputama V., VII., VIII. i X. okr. navedene morske vrste pakirali u PVC spremnike radi njihovog daljnjeg ilegalnog transporta u Italiju. Osim toga se u skladištima vršila i prerada ikre morskih ježinaca koja se pakirala u staklenke, a u koju svrhu su III. i V. okr., sukladno dogovoru s I. okr., prethodno angažirali više nepoznatih osoba. Nakon toga su I. okr., a po njegovom nalogu i V. do VIII. okr. te X. i XII. okr. morske ježince, trpove te ikru ježinaca, radi njihovog prijenosa iz Hrvatske u Italiju, na području Zadra, Biograda na moru i Splita predavali V. , XIII. i XVI. okr. koje je prethodno sukladno dogovoru s I. okr. angažirao II. okrivljenik. Zatim su morske organizme za novčanu naknadu, sukladno uputama I., II. i III. okr., prevozili iz Hrvatske u Italiju gdje su ih II. i III. okr. prodavali raznim kupcima na ilegalnom tržištu, dok je X. okr. po nalogu I. okr. za novčanu naknadu prstace u Splitu isporučio jednom ugostitelju.

Okrivljenici su na ilegalnom tržištu u Hrvatskoj i Italiji prodali najmanje 19.000 kilograma trpova po cijeni od najmanje 30,00 kuna po kilogramu, najmanje 3.520 kilograma morskih ježinaca po cijeni od najmanje 25,00 kuna po kilogramu, najmanje 62 kilograma ikre morskih ježinaca po cijeni od 800,00 kuna po kilogramu, te najmanje 6,35 kilograma prstaca po cijeni od 250,00 kuna po kilogramu.

Na opisani način su I. okr., V. do XII. okr., te XIV. i XV. okr. pribavili nepripadnu imovinsku korist od najmanje 709.187,00 kuna, a novac su međusobno podijelili sukladno njihovim prethodno dogovorenim ulogama u realizaciji plana, čime su Državni proračun Republike Hrvatske oštetili za najmanje 11.483.050,00 kuna.

USKOK će sucu istrage Županijskog suda u Splitu predložiti određivanje istražnog zatvora protiv 11 okrivljenika.

Uhićenja zbog krijumčarenja trpova i u našoj županiji

USKOK je donio rješenje o provođenju istrage protiv 11 hrvatskih državljana (1972., 1978., 1982., 1983., 1973., 1987., 1980., 1976., 1997., 1988., 1991.) i petorice talijanskih državljana (1979., 1965., 1980., 1960., 1978.) zbog osnovane sumnje na počinjenje kaznenih djela zločinačkog udruženja, trgovanja divljim vrstama u sastavu zločinačkog udruženja te pomaganja u trgovanju divljim vrstama u sastavu zločinačkog udruženja.

Osnovano se sumnja da je I. okr., u razdoblju od ožujka do 19. srpnja 2022., u Hrvatskoj i Italiji, povezao u zajedničko djelovanje II. i  III. okr., V. do XII. okr. te XIV. i XV. okr., a posredstvom II. okr. i IV., XIII. i XVI. okr. te druge nepoznate osobe, s ciljem stjecanja nepripadne materijalne koristi za sebe i druge protuzakonitom nabavom, a potom krijumčarenjem iz Hrvatske u Italiju više divljih vrsta i to trpa, igličastog ježinca, pjegavog ježinca i ikre ježinca radi njihove preprodaje na ilegalnom tržištu u Italiji, kao i prstaca radi njihove preprodaje na ilegalnom tržištu u Hrvatskoj.

Sakupljanje trpova Zakonom o morskom ribarstvu i Pravilnikom o lovostaju trpova u potpunosti je zabranjeno. Za skupljanje pjegavog ježinca, sukladno Zakonu o zaštiti prirode i Pravilniku o sakupljanju zavičajnih divljih vrsta, potrebno je ishoditi dopuštenje nadležnog ministarstva, a prema Zakonu o zaštiti prirode i Pravilniku o strogo zaštićenim vrstama igličasti ježinci i prstaci strogo su zaštićene vrste.
