Iako se kao najvažnija novina novog ovršnog zakona navodi mogućnost da dužnik umjesto stana ili kuće koji su predmet ovrhe zbog neplaćenih dugova ponudi vjerovniku naplatu na neki drugi način, kako bi zadržao krov nad glavom, to je moguće i po sadašnjem zakonu.

Što ako nema imovine?

Problem je što se ta mogućnost uglavnom ne primjenjuje. Tako nam tvrde u Udruzi “Veronika Vere” koja štiti prava građana žrtava pravosuđa.

- Imali smo slučajeva građana koji su nam se obratili za pomoć, gdje je sud uvažio naš prijedlog da se umjesto prodaje nekretnine u kojoj ovršenik živi, njegov dug namiri prodajom neke druge imovine. No, prema našim saznanjima, uglavnom se primjenjuje rješenje prema kojem se nekretnina oduzima, a njezin vlasnik deložira kako bi se prodajom nekretnina namirio dug – kaže predsjednica “Veronike Vere” Nada Landeka, koja pozdravlja namjeru predlagača izmjena Ovršnog zakona da jače zaštiti prava ovršenika.

Građani, ističe Vesna Landeka, koji se nađu pod prijetnjom ovrhe, uglavnom pristaju na sve jer ih je netko uvjerio da nemaju izbora.

- Nadam se da će novi ovršni zakon spriječiti da se dužnike deložira zbog dugova koji su često daleko manji od vrijednosti nekretnine koja se dobije njezinom prodajom. Očekujemo da sudovi, umjesto primjene najgoreg scenarija za ovršenike, ustraju na zaštiti njihova dostojanstva - zaključuje Landeka.

U prilog njezinim riječima idu i naglasci s okruglog stola o izmjenama Ovršnog zakona koji su organizirali Ured pučke pravobraniteljice i Hrvatski pravni centar.

Tom prilikom pomoćnica ministra pravosuđa Renata Duka najavila je kako će se spomenutim zakonskim izmjenama dužnicima omogućiti da, primjerice, naplatu duga od deset tisuća kuna na ime nekretnine u kojoj žive, osiguraju prodajom automobila ili neke druge imovine. Ako, prema njezinim riječima, ovršenik nema nikakve druge imovine za namiru duga, onda bi se morao iseliti, ali bi mogao zatražiti pravo na stanovanje nakon što se nekretnina proda.

Zadar kao Hrvatska

Samo na području koje je pod nadležnosti Općinskog suda u Zadru tijekom 2012. izvršeno je 375 ovrha nad nekretninama dužnika, što je prije izbijanja ekonomske krize bila brojka na razini cijele države.

Iako se kao najvažnija novina novog ovršnog zakona navodi mogućnost da dužnik umjesto stana ili kuće koji su predmet ovrhe zbog neplaćenih dugova ponudi vjerovniku naplatu na neki drugi način, kako bi zadržao krov nad glavom, to je moguće i po sadašnjem zakonu.

Što ako nema imovine?

Problem je što se ta mogućnost uglavnom ne primjenjuje. Tako nam tvrde u Udruzi “Veronika Vere” koja štiti prava građana žrtava pravosuđa.

- Imali smo slučajeva građana koji su nam se obratili za pomoć, gdje je sud uvažio naš prijedlog da se umjesto prodaje nekretnine u kojoj ovršenik živi, njegov dug namiri prodajom neke druge imovine. No, prema našim saznanjima, uglavnom se primjenjuje rješenje prema kojem se nekretnina oduzima, a njezin vlasnik deložira kako bi se prodajom nekretnina namirio dug – kaže predsjednica “Veronike Vere” Nada Landeka, koja pozdravlja namjeru predlagača izmjena Ovršnog zakona da jače zaštiti prava ovršenika.

Građani, ističe Vesna Landeka, koji se nađu pod prijetnjom ovrhe, uglavnom pristaju na sve jer ih je netko uvjerio da nemaju izbora.

- Nadam se da će novi ovršni zakon spriječiti da se dužnike deložira zbog dugova koji su često daleko manji od vrijednosti nekretnine koja se dobije njezinom prodajom. Očekujemo da sudovi, umjesto primjene najgoreg scenarija za ovršenike, ustraju na zaštiti njihova dostojanstva - zaključuje Landeka.

U prilog njezinim riječima idu i naglasci s okruglog stola o izmjenama Ovršnog zakona koji su organizirali Ured pučke pravobraniteljice i Hrvatski pravni centar.

Tom prilikom pomoćnica ministra pravosuđa Renata Duka najavila je kako će se spomenutim zakonskim izmjenama dužnicima omogućiti da, primjerice, naplatu duga od deset tisuća kuna na ime nekretnine u kojoj žive, osiguraju prodajom automobila ili neke druge imovine. Ako, prema njezinim riječima, ovršenik nema nikakve druge imovine za namiru duga, onda bi se morao iseliti, ali bi mogao zatražiti pravo na stanovanje nakon što se nekretnina proda.

Zadar kao Hrvatska

Samo na području koje je pod nadležnosti Općinskog suda u Zadru tijekom 2012. izvršeno je 375 ovrha nad nekretninama dužnika, što je prije izbijanja ekonomske krize bila brojka na razini cijele države.
