Zastupnica Vlade pred Europskim sudom za ljudska prava Štefica Stažnik odbacila je kao netočne medijske navode da je postupak protiv Republike Hrvatske kojeg je pred Europskim sudom pokrenula Vesna Balenović završen njezinom pobjedom i da je sud obvezao hrvatsku Vladu da sklopi nagodbu s Balenović.

Netočne informacije da je postupak protiv Vlade završen u korist Balenović 14. svibnja objavile su dnevne novine Večernji list i Novi list te HTV u svojim informativnim emisijama, priopćilo je danas Ministarstvo pravosuđa.

Zastupnica Vlade tvrdi da Europski sud nije donio nikakav pravorijek u predmetu Balenović niti je obvezao Vladu na sklapanje s Balenović bilo kakve nagodbe.

Zapravo, kaže se u priopćenju, taj se postupak nalazi tek u početnoj fazi, a Europski sud proslijedio je Vladi zahtjev, odnosno tužbu Balenović na odgovor.

Sukladno uobičajenoj proceduri, sud je pozvao Vladu i Balenović da ga do 8. srpnja ove godine obavijeste jesu li zainteresirani za sklapanje prijateljskog rješenja predmeta, odnosno za nagodbu.

Radi se, dakle, samo o pozivu Suda za iskazivanje načelnog i neobvezujućeg interesa za sklapanje nagodbe. Ukoliko stranke ne pokažu interes za nagodbu, Sud će kao i svim drugim predmetima nastaviti s postupkom i donijeti odluku, stoji u priopćenju.

Ujedno se pojašnjava da su prema poslovniku suda pregovori o eventualnoj nagodbi vođeni putem suda povjerljive su naravi pa Vlada ne smije obavještavati javnost o njima dok oni traju, a ista obveza odnosi se i na Vesnu Balenović.

Zastupnica Vlade pred Europskim sudom za ljudska prava Štefica Stažnik odbacila je kao netočne medijske navode da je postupak protiv Republike Hrvatske kojeg je pred Europskim sudom pokrenula Vesna Balenović završen njezinom pobjedom i da je sud obvezao hrvatsku Vladu da sklopi nagodbu s Balenović.

Netočne informacije da je postupak protiv Vlade završen u korist Balenović 14. svibnja objavile su dnevne novine Večernji list i Novi list te HTV u svojim informativnim emisijama, priopćilo je danas Ministarstvo pravosuđa.

Zastupnica Vlade tvrdi da Europski sud nije donio nikakav pravorijek u predmetu Balenović niti je obvezao Vladu na sklapanje s Balenović bilo kakve nagodbe.

Zapravo, kaže se u priopćenju, taj se postupak nalazi tek u početnoj fazi, a Europski sud proslijedio je Vladi zahtjev, odnosno tužbu Balenović na odgovor.

Sukladno uobičajenoj proceduri, sud je pozvao Vladu i Balenović da ga do 8. srpnja ove godine obavijeste jesu li zainteresirani za sklapanje prijateljskog rješenja predmeta, odnosno za nagodbu.

Radi se, dakle, samo o pozivu Suda za iskazivanje načelnog i neobvezujućeg interesa za sklapanje nagodbe. Ukoliko stranke ne pokažu interes za nagodbu, Sud će kao i svim drugim predmetima nastaviti s postupkom i donijeti odluku, stoji u priopćenju.

Ujedno se pojašnjava da su prema poslovniku suda pregovori o eventualnoj nagodbi vođeni putem suda povjerljive su naravi pa Vlada ne smije obavještavati javnost o njima dok oni traju, a ista obveza odnosi se i na Vesnu Balenović.

Sve ostale informacije o tijeku postupka, i svim obvezujućim odlukama Europskog suda za ljudska prava, su javne i dostupne na internet stranici tog suda (www.echr.coe.int).
