 Iako ovo nije jedina niti prva presuda u korist tužitelja u tzv. slučaju franak, ali njezina pravomoćnost omogućuje ovršenje banke, što u većini drugih presuda to nije slučaj, pišu 24 sata.

-Ovo je jedna od rijetkih pravomoćnih presuda protiv banke u tužbama zbog preplaćenih kamata po kreditima, izvijestio je odvjetnik Tomislav Bogdan, koji je pred Županijskim sudom u Osijeku vodio parnicu Osječanina protiv Zagrebačke banke.
Naime, dok presuda nije pravomoćna, tužitelj ne može napraviti ništa, dakle ne može tražiti povrat preplaćenih kamata.

Zbog kamate koju je mijenjala jednostrano, prema presudi osječkog Županijskog suda, banka mora isplatiti gotovo 12.854 kune sa zateznom kamatom te mora pokriti 13.925 kuna sudskih troškova.

Osobito je važno to što je sud utvrdio kako je podnošenjem kolektivne tužbe prekinuta zastara pred Visokim trgovačkim sudom, dakle do 2019. godine mogu se podizati tužbe protiv banaka, istaknuo je odvjetnik Bogdan.

 Iako ovo nije jedina niti prva presuda u korist tužitelja u tzv. slučaju franak, ali njezina pravomoćnost omogućuje ovršenje banke, što u većini drugih presuda to nije slučaj, pišu 24 sata.

-Ovo je jedna od rijetkih pravomoćnih presuda protiv banke u tužbama zbog preplaćenih kamata po kreditima, izvijestio je odvjetnik Tomislav Bogdan, koji je pred Županijskim sudom u Osijeku vodio parnicu Osječanina protiv Zagrebačke banke.
Naime, dok presuda nije pravomoćna, tužitelj ne može napraviti ništa, dakle ne može tražiti povrat preplaćenih kamata.

Zbog kamate koju je mijenjala jednostrano, prema presudi osječkog Županijskog suda, banka mora isplatiti gotovo 12.854 kune sa zateznom kamatom te mora pokriti 13.925 kuna sudskih troškova.

Osobito je važno to što je sud utvrdio kako je podnošenjem kolektivne tužbe prekinuta zastara pred Visokim trgovačkim sudom, dakle do 2019. godine mogu se podizati tužbe protiv banaka, istaknuo je odvjetnik Bogdan.
