Štrajk radnika Luke Zadar, kojeg su pokrenuli jer kineski vlasnici nisu htjeli podignuti minimalnu plaću od oko 700 eura, Županijski sud u Zadru proglasio je nezakonitim te su oni, do nove sindikalne akcije, primorani obavljati svoje poslove.

Radnici su štrajk pokrenuli kao zadnju opciju nakon propalih pregovora, tvrdeći da vlasnici ionako planiraju uvoz jeftine radne snage iz Azije. Međutim, Županijski sud u Zadru procijenio je da se nisu ispunili uvjeti za štrajk te im je naložio da se vrate svojim obvezama, javlja portal 057info.

– Odlukom vijeća  Županijskog suda u Zadru utvrđeno je da je nezakonit štrajk tuženika Sindikata prometa i veza Hrvatske sa sjedištem u Zagrebu, a koji je tuženik organizirao i najavio za dan 19. ožujka 2024., s početkom u 7:00 sati pa do ispunjenja zahtjeva.

Istom odlukom zabranjuje se tuženiku Sindikatu prometa i veza Hrvatske sa sjedištem u Zagrebu organizacija i provedba štrajka najavljenog za dan 19. ožujka 2024. godine s početkom u 7 sati pa do ispunjenja zahtjeva, a ujedno je naloženo tuženiku nadoknaditi tužitelju Luka Zadar d.d. troškove parničnog postupka. Također je određena i privremena mjera zabrane tuženiku Sindikatu prometa veza Hrvatske sa sjedištem u Zagrebu provođenje štrajka najavljenog i organiziranog za dan 19. ožujka 2024., a koja privremena mjere traje do okončanja parničnog postupka koji se vodi među istim strankama pred Županijskim sudom u Zadru radi utvrđenja i zabrane nezakonitog štrajka.

Iako Vijeće smatra da nije bilo sporno da radnici imaju pravo na štrajk ukoliko se sve obveze iz Kolektivnog ugovora uredno ne ispunjavaju, u konkretnom slučaju u tome ih ograničava odredba čl. 105. Kolektivnog ugovora, kojim je propisano i ugovoreno da će za vrijeme  primjene i trajanja Kolektivnog ugovora stranke poštivati načela socijalnog mira i da neće poduzimati nikakav oblik industrijske akcije, te odredba čl. 107. st. 1. i 2. Kolektivnog ugovora kojom su stranke prihvatile da se sindikati suzdržavaju od štrajka ukoliko se odredbe tog Ugovora uredno ispunjavaju, te da obveza socijalnog mira vrijedi do započinjanja novih kolektivnih pregovora.

Jedan od razloga koji je Sud uzeo u obzir je kako je u konkretnom slučaju manji dio djelatnika tužitelja tražio isplatu dijela plaće kao i naknade plaće, kako to proizlazi iz listi koje je priložio sindikalni povjerenik. Drugi razlog je ravnoteža interesa i ciljeva koji u štrajku mogu postići djelatnici i položaj poslodavca, koja u konkretnom slučaju ne postoji, jer radnici koji nisu zadovoljni isplaćenim naknadama mogu pokrenuti individualne sporove.

Također Vijeće smatra da tuženik nije postupio u dobroj vjeri (u smislu odredbe članka 193. Zakona o radu), jer je poslodavcu uvjetovao prihvaćanje isključivo svoga prijedloga. Iz svih naprijed navedenih razloga, Vijeće ovog suda je zaključilo da je štrajk nezakonit, odgovorili su za portal 057info na upit iz Županijskog suda.

Na koji će se način priča rasplesti tek će se vidjeti. Moguće je da Sindikat odradi predradnje kojima će štrajk biti zakonit, a i da u konačnici radnici potraže lukrativnija zaposlenja, a umjesto njih dođu radnici iz Nepala i Bangladeša, kao u nekim drugim djelatnostima.

Štrajk radnika Luke Zadar, kojeg su pokrenuli jer kineski vlasnici nisu htjeli podignuti minimalnu plaću od oko 700 eura, Županijski sud u Zadru proglasio je nezakonitim te su oni, do nove sindikalne akcije, primorani obavljati svoje poslove.

Radnici su štrajk pokrenuli kao zadnju opciju nakon propalih pregovora, tvrdeći da vlasnici ionako planiraju uvoz jeftine radne snage iz Azije. Međutim, Županijski sud u Zadru procijenio je da se nisu ispunili uvjeti za štrajk te im je naložio da se vrate svojim obvezama, javlja portal 057info.

– Odlukom vijeća  Županijskog suda u Zadru utvrđeno je da je nezakonit štrajk tuženika Sindikata prometa i veza Hrvatske sa sjedištem u Zagrebu, a koji je tuženik organizirao i najavio za dan 19. ožujka 2024., s početkom u 7:00 sati pa do ispunjenja zahtjeva.

Istom odlukom zabranjuje se tuženiku Sindikatu prometa i veza Hrvatske sa sjedištem u Zagrebu organizacija i provedba štrajka najavljenog za dan 19. ožujka 2024. godine s početkom u 7 sati pa do ispunjenja zahtjeva, a ujedno je naloženo tuženiku nadoknaditi tužitelju Luka Zadar d.d. troškove parničnog postupka. Također je određena i privremena mjera zabrane tuženiku Sindikatu prometa veza Hrvatske sa sjedištem u Zagrebu provođenje štrajka najavljenog i organiziranog za dan 19. ožujka 2024., a koja privremena mjere traje do okončanja parničnog postupka koji se vodi među istim strankama pred Županijskim sudom u Zadru radi utvrđenja i zabrane nezakonitog štrajka.

Iako Vijeće smatra da nije bilo sporno da radnici imaju pravo na štrajk ukoliko se sve obveze iz Kolektivnog ugovora uredno ne ispunjavaju, u konkretnom slučaju u tome ih ograničava odredba čl. 105. Kolektivnog ugovora, kojim je propisano i ugovoreno da će za vrijeme  primjene i trajanja Kolektivnog ugovora stranke poštivati načela socijalnog mira i da neće poduzimati nikakav oblik industrijske akcije, te odredba čl. 107. st. 1. i 2. Kolektivnog ugovora kojom su stranke prihvatile da se sindikati suzdržavaju od štrajka ukoliko se odredbe tog Ugovora uredno ispunjavaju, te da obveza socijalnog mira vrijedi do započinjanja novih kolektivnih pregovora.

Jedan od razloga koji je Sud uzeo u obzir je kako je u konkretnom slučaju manji dio djelatnika tužitelja tražio isplatu dijela plaće kao i naknade plaće, kako to proizlazi iz listi koje je priložio sindikalni povjerenik. Drugi razlog je ravnoteža interesa i ciljeva koji u štrajku mogu postići djelatnici i položaj poslodavca, koja u konkretnom slučaju ne postoji, jer radnici koji nisu zadovoljni isplaćenim naknadama mogu pokrenuti individualne sporove.

Također Vijeće smatra da tuženik nije postupio u dobroj vjeri (u smislu odredbe članka 193. Zakona o radu), jer je poslodavcu uvjetovao prihvaćanje isključivo svoga prijedloga. Iz svih naprijed navedenih razloga, Vijeće ovog suda je zaključilo da je štrajk nezakonit, odgovorili su za portal 057info na upit iz Županijskog suda.

Na koji će se način priča rasplesti tek će se vidjeti. Moguće je da Sindikat odradi predradnje kojima će štrajk biti zakonit, a i da u konačnici radnici potraže lukrativnija zaposlenja, a umjesto njih dođu radnici iz Nepala i Bangladeša, kao u nekim drugim djelatnostima.

Štrajk radnika Luke Zadar, kojeg su pokrenuli jer kineski vlasnici nisu htjeli podignuti minimalnu plaću od oko 700 eura, Županijski sud u Zadru proglasio je nezakonitim te su oni, do nove sindikalne akcije, primorani obavljati svoje poslove.
