Zbog osnovane sumnje da je počinio kazneno djelo pokušaja ubojstva u stjecaju s počinjenim kaznenim djelom nanošenja teške tjelesne ozljede, sudac istrage Županijskog suda u Dubrovniku suglasio se s prijedlogom dubrovačkog Županijskog državnog odvjetništva te je hrvatskom državljaninu, Ivici J. (56) iz Metkovića odredio istražni zatvor u trajanju do mjesec dana. Istražni zatvor je određen zbog opravdane bojazni da "u uvjetima verbalnog i fizičkog sukoba koji traje dugo, postoji realna opasnost da bi okrivljenik boravkom na slobodi u uvjetima susjedstva s ugostiteljskim objektom u kojem se okupljaju osobe s kojima je u sukobu" počinio teže kazneno djelo, odnosno dovršio već pokušano kazneno djelo ubojstva.

Kako smo uspjeli doznati, okrivljenik se sumnjiči da je višestrukim udarcima čekićem u glavu prvom oštećeniku nanio lakše tjelesne ozljede, a s više udaraca po šaci, teške tjelesne ozljede nanio drugom oštećeniku. Također, neslužbeno smo doznali da je, unatoč činjenici da su kazna djela počinjena na teritoriju susjedne Bosne i Hercegovine, jurisdikcija nad ovim slučajem prepuštena dubrovačkom pravosuđu (dubrovačkom Županijskom državnom odvjetništvu i dubrovačkom Županijskom sudu) jer su okrivljenik i oštećenici hrvatski državljani i prebivaju u Hrvatskoj, odnosno u Dubrovačko-neretvanskoj županiji.

Sudac istrage je zaključio kako je prijedlog Odvjetništva osnovan i da su ispunjeni uvjeti za određivanje istražnog zatvora, na što su upućivali i podaci iz kaznene prijave R.G. Policijskoj postaji Metković 25.veljače te medicinska dokumentacija o ozljedama I.G. i R.G. kao i fotoelaborat pretrpljenih ozljeda. Također, zaključeno je kako nema mjesta primjeni neke od mjera opreza jer su, temeljem iskaza dvojice oštećenika može zaključiti da je postojala namjera ozljeđivanja dugim željeznim čekićem kojeg je u noći kad se dogodio incident u pograničnom naselju Gabela Polje pritvoreni I.J. koristio, ispunjeni i posebni uvjeti za određivanje istražnog zatvora. Naime, sudac istrage je zaključio kako se spomenutim čekićem kao i brojem zamaha usmjerenim u glavu mogla prouzročiti smrt.

Kako smo doznali, po završetku pravosudne istrage i podizanju optužnice, ako se u dokaznom postupku dokaže da je okrivljenik doista imao namjeru usmrćenja, prijeti mu izricanje vremenske kazne od najmanje pet godina zatvora.

Zbog osnovane sumnje da je počinio kazneno djelo pokušaja ubojstva u stjecaju s počinjenim kaznenim djelom nanošenja teške tjelesne ozljede, sudac istrage Županijskog suda u Dubrovniku suglasio se s prijedlogom dubrovačkog Županijskog državnog odvjetništva te je hrvatskom državljaninu, Ivici J. (56) iz Metkovića odredio istražni zatvor u trajanju do mjesec dana. Istražni zatvor je određen zbog opravdane bojazni da "u uvjetima verbalnog i fizičkog sukoba koji traje dugo, postoji realna opasnost da bi okrivljenik boravkom na slobodi u uvjetima susjedstva s ugostiteljskim objektom u kojem se okupljaju osobe s kojima je u sukobu" počinio teže kazneno djelo, odnosno dovršio već pokušano kazneno djelo ubojstva.

Kako smo uspjeli doznati, okrivljenik se sumnjiči da je višestrukim udarcima čekićem u glavu prvom oštećeniku nanio lakše tjelesne ozljede, a s više udaraca po šaci, teške tjelesne ozljede nanio drugom oštećeniku. Također, neslužbeno smo doznali da je, unatoč činjenici da su kazna djela počinjena na teritoriju susjedne Bosne i Hercegovine, jurisdikcija nad ovim slučajem prepuštena dubrovačkom pravosuđu (dubrovačkom Županijskom državnom odvjetništvu i dubrovačkom Županijskom sudu) jer su okrivljenik i oštećenici hrvatski državljani i prebivaju u Hrvatskoj, odnosno u Dubrovačko-neretvanskoj županiji.

Sudac istrage je zaključio kako je prijedlog Odvjetništva osnovan i da su ispunjeni uvjeti za određivanje istražnog zatvora, na što su upućivali i podaci iz kaznene prijave R.G. Policijskoj postaji Metković 25.veljače te medicinska dokumentacija o ozljedama I.G. i R.G. kao i fotoelaborat pretrpljenih ozljeda. Također, zaključeno je kako nema mjesta primjeni neke od mjera opreza jer su, temeljem iskaza dvojice oštećenika može zaključiti da je postojala namjera ozljeđivanja dugim željeznim čekićem kojeg je u noći kad se dogodio incident u pograničnom naselju Gabela Polje pritvoreni I.J. koristio, ispunjeni i posebni uvjeti za određivanje istražnog zatvora. Naime, sudac istrage je zaključio kako se spomenutim čekićem kao i brojem zamaha usmjerenim u glavu mogla prouzročiti smrt.

Kako smo doznali, po završetku pravosudne istrage i podizanju optužnice, ako se u dokaznom postupku dokaže da je okrivljenik doista imao namjeru usmrćenja, prijeti mu izricanje vremenske kazne od najmanje pet godina zatvora.

Istražni zatvor za pokušaj ubojstva u Gabela Polju: čekićem u glavu nanio lakše, a udaracima po šaci teške tjelesne ozljede drugom oštećeniku

Zbog osnovane sumnje da je počinio kazneno djelo pokušaja ubojstva u stjecaju s počinjenim kaznenim djelom nanošenja teške tjelesne ozljede, sudac istrage Županijskog suda u Dubrovniku suglasio se s prijedlogom dubrovačkog Županijskog državnog odvjetništva te je hrvatskom državljaninu, Ivici J. (56) iz Metkovića odredio istražni zatvor u trajanju do mjesec dana. Istražni zatvor je određen zbog opravdane bojazni da "u uvjetima verbalnog i fizičkog sukoba koji traje dugo, postoji realna opasnost da bi okrivljenik boravkom na slobodi u uvjetima susjedstva s ugostiteljskim objektom u kojem se okupljaju osobe s kojima je u sukobu" počinio teže kazneno djelo, odnosno dovršio već pokušano kazneno djelo ubojstva.

Kako smo uspjeli doznati, okrivljenik se sumnjiči da je višestrukim udarcima čekićem u glavu prvom oštećeniku nanio lakše tjelesne ozljede, a s više udaraca po šaci, teške tjelesne ozljede nanio drugom oštećeniku.
