Na drugom katu zgrade "depadansa" opet gore svitla, kako mještani govore, a vijore se i bandire, hrvatska, Općine Jelsa i Udruge hrvatskih branitelja dragovoljaca Domovinskog rata.

Sada je u mjestu sve mirno, jer je stotinjak građana predvođenih načelnikom Nikšom Peronjom (SDP) vratilo u posjed upravo taj kat, ali i veliko dvorište iza zgrade, što su prije desetak dana ne poštujući pravnu proceduru zauzeli djelatnici Tvornice čarapa "Ključ" iz Sarajeva (BiH). Uglavnom, objekt na tom dijelu jelšanske rive je trenutno pod kontrolom zaštitarske tvrtke "Bilić-Erić Security", a o svemu tome oglasio se i prvi čovjek Jelse.

- Općina je, zajedno s Općinskim državnim odvjetništvom, odnosno sa zamjenikom općinskog državnog odvjetnika Ljubom Prkom i predstavnikom Ministarstva državne imovine te sa zaštitarima i uz prisustvo policije koja je čuvala javni red i mir, vratila posjed sve dijelove "depadansa" koji su bili uzurpirani.

Tvrtka "Ključ" uzurpirala je drugi kat zgrade gdje su bila četiri ureda u posjedu Općine i sanitarni čvor, te uredi arhive u posjedu hotelijerske tvrtke "Jelsa", ali i cijelo dvorište koje je bilo u posjedu Općine. Da stvar bude gora, pravni zastupnik te sarajevske tvrtke je izjavio da oni u konačnici žele cijelu zgradu – navodi Peronja.

Načelnik tvrdi da je Općina uknjižena na polovinu zgrade, ostatak je u dokazanom i dokumentiranom, odnosno pravno kvalificiranom posjedu tvrtke "Jelsa" više od 60 godina. To su činjenice i upisom tog objekta u temeljni kapital "Jelse" je hrvatska država priznala vlasništvo, a i Vladina arbitražna odluka o podjeli imovine na otoku Hvaru, nedvosmisleno kaže čija je koja imovina, dakle, u polovini općinska.

- Pravni zastupnici tvornice "Ključ" mahali su nepravomoćnim rješenjem Općinskog suda o brisanju društvenog vlasništva i upisu Tvornice čarapa, međutim, i Općina i "Jelsa" i Državno odvjetništvo uložili su žalbe za koje čvrsto vjerujemo da će biti usvojene u sljedećim danima, jer je to naprosto pravno neodrživo i vratit će se upis na tome dijelu na "društveno vlasništvo".

Također je nadležni sud izdao privremenu mjeru u korist Općine i "Jelse" iako smo pri vraćanju zgrade u naš posjed po Zakonu o vlasništvu koristili dopušteni institut samopomoći, gdje je zgrada sada pod zaštitom Republike Hrvatske prema Zakonu odnosno Uredbi o zabrani raspolaganja imovinom republika bivše SFRJ iako se ovdje jednostavno radi o pogrešnom, zaostalom upisu koji ćemo vrlo brzo riješiti – smatra načelnik koji dodaje:

- U cijelom slučaju ja kao načelnik uopće nisam bitan, samo trenutno obavljam tu funkciju i predmetna zgrada nije moja, nije niti od nijednog pojedinca, ovo je jelšanska zgrada i dužni smo je čuvati i štiti kao Jelšani, te ostaviti generacijama iza nas i to smo sada uspjeli, to ne zaboravite! Idemo dalje, Forca Jelsa!

Međutim, druga strana, odnosno odvjetnik Nikola Hraste, pravni zastupnik tvrtke "Ključ", ima potpuno drugačije mišljenje. On kaže da je "takav cirkus koji se dogodio u Jelsi teško komentirati".

- Ne želim se upuštati u programe političkih moćnika, ali bez presedana je da se policija, DORH, Općina, tvrtka "Jelsa" i zaštitari koriste institutom "samopomoći" u prostoru zemljišnoknjižnog vlasnika treće osobe, a pri tom noseći hrvatsku zastavu. Mi to smatramo porazom hrvatske pravne države i računamo s pozitivnim ishodom sudskog postupka koji je u tijeku - tvrdi Hraste.

Na drugom katu zgrade "depadansa" opet gore svitla, kako mještani govore, a vijore se i bandire, hrvatska, Općine Jelsa i Udruge hrvatskih branitelja dragovoljaca Domovinskog rata.

Sada je u mjestu sve mirno, jer je stotinjak građana predvođenih načelnikom Nikšom Peronjom (SDP) vratilo u posjed upravo taj kat, ali i veliko dvorište iza zgrade, što su prije desetak dana ne poštujući pravnu proceduru zauzeli djelatnici Tvornice čarapa "Ključ" iz Sarajeva (BiH). Uglavnom, objekt na tom dijelu jelšanske rive je trenutno pod kontrolom zaštitarske tvrtke "Bilić-Erić Security", a o svemu tome oglasio se i prvi čovjek Jelse.

- Općina je, zajedno s Općinskim državnim odvjetništvom, odnosno sa zamjenikom općinskog državnog odvjetnika Ljubom Prkom i predstavnikom Ministarstva državne imovine te sa zaštitarima i uz prisustvo policije koja je čuvala javni red i mir, vratila posjed sve dijelove "depadansa" koji su bili uzurpirani.

Tvrtka "Ključ" uzurpirala je drugi kat zgrade gdje su bila četiri ureda u posjedu Općine i sanitarni čvor, te uredi arhive u posjedu hotelijerske tvrtke "Jelsa", ali i cijelo dvorište koje je bilo u posjedu Općine. Da stvar bude gora, pravni zastupnik te sarajevske tvrtke je izjavio da oni u konačnici žele cijelu zgradu – navodi Peronja.

Načelnik tvrdi da je Općina uknjižena na polovinu zgrade, ostatak je u dokazanom i dokumentiranom, odnosno pravno kvalificiranom posjedu tvrtke "Jelsa" više od 60 godina. To su činjenice i upisom tog objekta u temeljni kapital "Jelse" je hrvatska država priznala vlasništvo, a i Vladina arbitražna odluka o podjeli imovine na otoku Hvaru, nedvosmisleno kaže čija je koja imovina, dakle, u polovini općinska.

- Pravni zastupnici tvornice "Ključ" mahali su nepravomoćnim rješenjem Općinskog suda o brisanju društvenog vlasništva i upisu Tvornice čarapa, međutim, i Općina i "Jelsa" i Državno odvjetništvo uložili su žalbe za koje čvrsto vjerujemo da će biti usvojene u sljedećim danima, jer je to naprosto pravno neodrživo i vratit će se upis na tome dijelu na "društveno vlasništvo".

Također je nadležni sud izdao privremenu mjeru u korist Općine i "Jelse" iako smo pri vraćanju zgrade u naš posjed po Zakonu o vlasništvu koristili dopušteni institut samopomoći, gdje je zgrada sada pod zaštitom Republike Hrvatske prema Zakonu odnosno Uredbi o zabrani raspolaganja imovinom republika bivše SFRJ iako se ovdje jednostavno radi o pogrešnom, zaostalom upisu koji ćemo vrlo brzo riješiti – smatra načelnik koji dodaje:

- U cijelom slučaju ja kao načelnik uopće nisam bitan, samo trenutno obavljam tu funkciju i predmetna zgrada nije moja, nije niti od nijednog pojedinca, ovo je jelšanska zgrada i dužni smo je čuvati i štiti kao Jelšani, te ostaviti generacijama iza nas i to smo sada uspjeli, to ne zaboravite! Idemo dalje, Forca Jelsa!

Međutim, druga strana, odnosno odvjetnik Nikola Hraste, pravni zastupnik tvrtke "Ključ", ima potpuno drugačije mišljenje. On kaže da je "takav cirkus koji se dogodio u Jelsi teško komentirati".

- Ne želim se upuštati u programe političkih moćnika, ali bez presedana je da se policija, DORH, Općina, tvrtka "Jelsa" i zaštitari koriste institutom "samopomoći" u prostoru zemljišnoknjižnog vlasnika treće osobe, a pri tom noseći hrvatsku zastavu. Mi to smatramo porazom hrvatske pravne države i računamo s pozitivnim ishodom sudskog postupka koji je u tijeku - tvrdi Hraste.
